The Applicants are seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-
law Section 139-33A(8) (reconfiguration of a pre-existing nonconforming lot). Applicants propose
to acquire a parcel of about 14.0 acres from the immediately abutting lot to the west (shown as Lot 2
on Land Court Plan No. 13215-B, Assessor's Map 9.5, Parcel 2 and the subject of companion
Application in BOA File No. 085-07), and reconfiguring lot lines in order to merge the parcel with
the locus to create a larger lot. The locus is an about 27-acre parcel of land, improved with one
single-family dwelling, located on Tuckemuck Island. The locus conforms to all use and
dimensional requirements of the LUG-3 zoning district except as for frontage, arguably having no
frontage on a "street" as defined in the Nantucket Zoning By-law in a district that requires a
minimum frontage of 200 feet. The parcel to be acquired and a substantial portion of the Premises
are subject to existing conservation restrictions in favor of the Nantucket Land Council, Inc.
The Premises is located on TUCKERNUCK ISLAND, Assessor's Map 93, Parcell.1, and
is shown upon Land Court Plan 9371-D as Lot 8. The lot is situated in a Limited-Use-General-3
zoning district.

Application of Whimbrel Nominee Trust
Tuckernuck Island, Nantucket
Applicant seeks SPECIAL PERMIT relief under Nantucket Zoning By-law
Section 139-33(A)(8) (change to a pre-existing, nonconforming lot) to acquire a
parcel of land from an abutter to merge with the Premises. The Premises
conform to the Nantucket Zoning By-law in all respects but for frontage. The
owner of the abutting land has also applied for special permit relief to create the
parcel to be acquired.
The Premises are a 272:, parcel of land, improved with one single-family
dwelling, located on Tuckernuck Island. The Premises conform to all use and
dimensional requirements of the LUG-3 zoning district but for frontage, arguably
having no frontage on a "street" as defined in the Nantucket Zoning By-law.
Applicant proposes to acquire a 14.0 acre parcel of abutting land that would
merge with the Premises. The parcel to be acquired and a substantial portion of
the Premises are subject to conservation restrictions in favor of the Nantucket
Land Council, Inc.
The proposed merger of the parcel to be acquired and the Premises will
not create any new nonconformity or increase the existing nonconformity of lack
of frontage.
The Premises are located on Tuckernuck Island, Assessor's Map 93, Parcel
1.1, Lot 8 on Land Court Plan No. 9371-D. The property is zoned LIMITED USE
GENERAL-3.
