The Applicants are seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-
law Section 139-16C (Intensity regulations - setbacks). Applicants are seeking reliefto reduce the
southerly rear yard setback of the primary dwelling from ten feet to five feet in order to allow
placement of the existing HV AC Units, gas tanks and brick timber steps as currently sited as close as
about eight feet from that lot line. In all other respects the lot and the primary dwelling and the
secondary dwelling conform to the dimensional zoning requirements.
The Premises is located at 42 DUKES ROAD, Assessor's Map 56, Parcel 249, and is shown
upon Land Court Plan 14973-H as Lot 49. The lot is situated in a Residential-2 zoning district.

ADDENDUM
The Applicants are seeking Special Permit relief pursuant to Nantucket
Zoning By-law Section 139-16 (Intensity Regulations), Subsection C (Exceptions
for Yards).
The property is located at 42 Dukes Road, Nantucket, Map 56, Parcel 249
and is zoned Residential - 2.
The Applicants are seeking Special Permit relief to reduce the rear lot
setback distance from 10' to 5' as provided in Section 139-16, C. The existing
HV AC Units, gas tanks and brick timber steps as shown on the Zoning Board of
Appeals Site Plan dated July 25, 2007 encroach into the required 10' set back by
several feet and Special permit relief is requested to allow them to be sited
substantially as shown on the Plan.
If necessary, the Applicant requests site plan review and approval
pursuant to Zoning By-law Section 139-23.
