A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at 12:00
P.M.. FRIDAY. AUGUST 10.2007. in the Conference Room, 2 FAIRGROUNDS ROAD,
Nantucket, MA, on the Application of the following:
DANIEL T. DUNHAM AND THOMAS E. DUNHAM
BOARD OF APPEALS FILE NO. 075-07
Applicants are seeking relief by VARIANCE pursuant to Nantucket Zoning By-law Section
139-16A (Intensity regulations - minimum lot size) in order to validate the locus as a separately
marketable and buildable lot from all adjacent parcels. Due to a lot line adjustment done in 1978
with the then westerly abutting property owner, the once conforming locus was inadvertently made
nonconforming with a current lot area of about 4,585 square feet in a zoning district that requires a
minimum lot size of 5,000 square feet. Applicants are seeking variance relief to validate the lot in its
current configuration. The existing single-family dwelling is conforming in all other respects except
as to front yard setback with the structure being sited as close as about 8.3 feet in a district that
requires a minimum front yard setback of ten feet.
The Premises is located at 3 SWAIN STREET, Assessor's Map 42.4.1, Parcel 80, shown as
Lot 21 on Plan Book 6, Page 49. The property is zoned Residential-I.

Variance application pursuant to Chapter 139, I!ag.e 32: Applicants' parents purchased the property at
3 Swain Street in 1948. In 1978, they signed and recorded a boundary line agreement with their neighbors.
A copy of said boundary line agreement is attached hereto as Exhibit" A". According to the plan attached
to the boundary line agreement, the area of the lot is 4584 square feet. It is difficult to know the exact area
of the lot before the boundary line agreeme / ecause there is only one dimension on the 1921 plan that is
used in the deed. It appears from scali the 1921 plan, that the original area was 5380 square feet. Based
on these numbers, when the Dunha s accommodated their neighbors in 1978, they inadvertently created a
zoning problem because they ma e a conforming lot that contained in excess of 5000 square feet into a non-
conforming lot. Applicants se a variance to legitimize existing lot containing 4585 as a valid building lot
with all the benefits of a pre xisting non-conforming lot of record.

tucket, Massachusetts, and JOSEPH W. DAMSXER and BETTY P. DAMSKE~
(herein called Damsker), residing at 230 Midway Island, Clear-

WHEREAS Dunham and Oamsker mutually deaire to fix and estab-
lish the contiguous boundary line between their properties:

in the northerly corner of the intersection of Walsh street and
Swain Street, and thence running in a northerly direction a dis-
