A Public Hearing of the NANTUCKET ZONINGB()ARD OF APPEALS will be held at 12:06
P.M.. FRIDAY. JULY 13.2007. in the Conference Room, 2 FAIRGROUNDS ROAD, Nantucket,
MA, on the Application of the following:
MNP, LLC, DANIEL F. KNISE AND KATHLEEN KNISE, MANAGERS
BOARD OF APPEALS FILE NO. 066-07
Applicants are seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-law
Section 139-33A(8). Applicants propose to reconfigure their lot lines in order to merge an abutting
parcel of land with the locus. The locus (17 Ames Avenue) contains about 10,461 square feet of lot
area and is improved with a single-family dwelling and an ancillary structure. The abutting parcel (2
Rhode Island Avenue) contains about 4,920 square feet of lot area and is vacant. The resulting lot
from the merger would be less nonconforming and contain about 15,381 square feet oflot area in a
district that requires a minimum lot size of 20,000 square feet. The locus is also nonconforming as to
side and rear yard setback with the dwelling being sited as close as about five feet from the
southwesterly side yard lot line and with an oil tank and concrete pad sited over the rear yard lot line
in a district that requires a minimum side and rear yard setback of ten feet. The locus conforms as to
ground cover and front and northeasterly side yard setback; requirements.
The Premises is located at 17 AMES AVENUE, Assessor's Map 60.2.4, Parcel 17, Land
Court Plan No. 2408-M, Block No. 31, Lots 23 - 28, inclusive; and 2 RHODE ISLAND

and 30. The property is zoned Residential-2.

ADDENDUM
The Applicant, MNP, LLC, a Massachusetts limited liability company,
Daniel F. Knise and Kathleen Knise, Managers, seeks a Special Permit pursuant
to Section 139-33A(8) of the Nantucket Zoning By-Law. The Applicant proposes
to purchase the abutting non-conforming vacant land resulting in a single lot of
land that will be less non-conforming in the zoning district. The proposed new lot
will not create any new non-conformities. The properties are located at 17 Ames
Avenue, (the "Premises") and 2 Rhode Island A venue ("RIA"). The Premises and
RIA are located in the Residential-2 District.
The Premises consists of a lot of land approximately 1 0,461 ~ square feet
and is improved by a single-family dwelling. The lot of land is non-conforming as
to lot size being situated in a Zoning District with minimum lot size of20,000
square feet. The Premises is currently conforming as to ground cover ratio having
a ground cover ratio of approximately 11.7 % in a Zoning District that allows a
12.5% ground cove ratio.
The Applicant is seeking purchase the immediately abutting property
known and numbered as 2 Rhode Island Avenue ("RIA"). RIA is a vacant
property approximately 4920+/- square feet in size. When combined, the
resulting lot will be 15,381 +/- square feet in size, still undersized in the zoning
district but less nonconforming than the current configurations.
The proposed change in the size and shape of the lot would not be more
detrimental to the neighborhood than the property as it currently exists.
Furthermore, the combination of the Premises with RIA would not increase any
nonconformities; rather it would make an undersized lot less nonconforming in
the district. By granting the requested Special Permit, the Board would be acting
in a manner consistent with the spirit and intent of the Zoning By-Law.
The Applicant respectfully requests that the Board act in favor of the
requested Special Permit.
