At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, July 13, 2007, at 12:00 P.M., in the Conference Room at Two Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the Application of TOWN OF NANTUCKET, of 16 Broad Street, Nantucket, MA 02554, AND FOR THE SIASCONSET WATER COMMISSION - WANNACOMET WATER COMPANY, of 1 Milestone Road, Nantucket, MA 02554, Board of Appeals File No. 063-07: 2. Applicant (Siasconset Water Commission) is seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-law Section 139-17 (Height limitations), specifically as Section 139-17C(3) relates to "water towers and stand pipes", in order to construct a new water tower that would have a maximum height of about 164.75 feet above grade. The Premises is located at 50 MAIN STREET, SIASCONSET, Assessor's Map 73, Parcel 15, Plan at Deed Book 116, Page 457. The property is zoned 'Sconsett-Residential-2. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board made no recommendation as the matter was not of planning concern. Other than the presentation made by the Applicant and its representatives, there was no public comment and no letters on file. 4. Applicant states that the proposed project consists of the construction of a new 400,000 gallon elevated composite water tank on a Town-owned parcel ofland adjacent to the Siasconset Water Department's existing water supply wells and office. The existing parcel is vacant and was formerly used as a softballlbaseball field, with that use having been discontinued in 199H. The proposed location of the storage tank on the parcel is shown on the "Plot Plan", prepared by Leo Asadoorian, professional land surveyor, dated June 2, 2007, a reduced copy of which is attached hereto as Exhibit A. The height of the proposed tank, measured to the top of the handrail on the roof, would be about 164.75 feet above ground level. The new water tower has been proposed to address recognized deficiencies in the existing water system by improving water pressure within the distribution system, increasing the system's ability to meet peak demands, reduce the frequency of pump operation, provide additional storage to meet short period pump or control malfunctions and most importantly by improving fire protection capabilities within the system, particularly within the old historic village area of Siasconset. Thus, the safety and well-being of the inhabitants of the village ofSiasconset would be significantly improved. The proposed water tower project would succeed in addressing several specific water supply related objectives and recommendations that were identified in "The Nantucket Comprehensive Community Plan" prepared by the Nantucket Planning and Economic Development Commission, and approved at Town Meeting in January 2001. The new storage tank would replace the system's existing 80-year old standpipe at the intersection of New St. and Lincoln St., whose current poor condition and small size makes rehabilitation an impractical long-term solution. An inspection of this standpipe conducted in 2005 indicated that the structural integrity of various elements of the existing tank have been compromised from corrosion and associated metal loss, and the long term structural integrity of these components was at best highly questionable. Once the new storage tank is constructed, the existing standpipe could be dismantled and removed, eliminating any danger associated with further deterioration of this structure. The Siasconset water system has grown significantly since the construction of the existing tank in 1927 and the usable volume of water provided by this tank (57,000 gallons) is insufficient for the demands of the current system, particularly during periods of peak water use, or during water system emergencies (i.e., water main break, short period pump or control malfunctions, etc.). The current system also cannot provide the necessary level of fire protection at various locations within the system, from both a volume and pressure standpoint. Due to the configuration and height of the proposed elevated water storage tank, the entire 400,000 gallon would be within the usable range and would provide the necessary volume for peak demand periods, emergencies, and fire protection. The Department of Environmental Protection's "Guidelines and Policies for Public Water Systems ", recommends that water distribution systems should provide a minimum of 35 pounds per square inch (psi) of normal working pressure, and 20 psi minimum pressure under fire flow conditions, to all consumers. The height of the current storage tank does not allow these guidelines to be met. The height of the new storage tank would be such that these requirements would be substantially met. By increasing the usable storage volume to 400,000 gallons and raising the height of the water tank the proposed water tank would result in the following improvements in system operation: . Improved water pressure throughout the system . Increased available water to meet peak demands . Increased available water for emergency situations . Improved fire protection capabilities throughout the system · An overall improvement in the safety and well-being of Siasconset' s inhabitants As the tank chosen is a multi-use structure, the base column ofthe tank is available for uses other than just support for the tank itself. In cooperation with the Nantucket Police Department, the Siasconset Water Department has agreed to allow the tank to be utilized as part of a new emergency communications system that the Police Department is planning. At the Siasconset tank a communications control room would be constructed within the tank column, and two antennas would be mounted on the roof. The antenna arrangement would consist of one four-foot diameter dish antenna and one 10-foot whip antenna. The whip antenna would be the uppermost antenna, the top of which would be about 14.5 feet above the top handrail. 5. Therefore, based upon the foregoing, the Board specifically finds that there are unique circumstances relating to the use of the proposed structure as a water tower that requires a height in excess of the maximum allowed of 30 feet. There is a need to meet deficiencies in the existing water system and most importantly, provide improvement in the fire protection capabilities within the system. The Board further finds that the requested relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of this By-law. In addition, the grant of special permit relief would be in harmony with the general purpose and intent of the Zoning By-law. In making this finding and granting of Special Permit relief, the Board considered the detailed rationale presented by the Applicant for this particular design. 6. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-law Section 139-17 to allow the construction of the new water tower and communication system antennae as proposed with a height in excess ofthe maximum allowed of 30 feet, subject to the following conditions: a. The project shall be built in substantial conformance with Exhibit A; and b. The water tower shall have a maximum structural height of no more than 165 feet as defined in the Nantucket Zoning By-law in Section 139-17, with the proposed communication system to extend an additional maximum of 15 feet for a maximum height above grade of about 180 feet.
