. P.M.. FRIDAY. JULY 13. 2007. in the Conference Room, 2 FAIRGROUNDS ROAD, Nantucket,
MA, on the Application of the following:
ROBERT E. TONKIN FOR mMSELF, AND AS EXECUTOR OF THE ESTATE OF
DOROTHY B. TONKIN, OWNERS; AND FOR NANTUCKET BRAND LLC, LAWRENCE
M. MAURY, MANAGER, CONTRACT PURCHASER
BOARD OF APPEALS FILE NO. 059..07
Applicant (Nantucket Brand LLC) is seeking reliefby SPECIAL PERMIT pursuant to
Nantucket Zoning By-law Section 139-33A (alteration/expansion of a pre-existing nonconforming
use/structure) to validate the 1970's conversion of the second-floor storage space to retail use; add a
third floor rear dormer withIn the existing footprint of the structure but in the portion of the structure
located above 30 feet but lower than the existing ridge height of 39 feet and would be sited within
the required five-foot rear yard setback area; and to convert the basement to primarily retail use, with
ancillary storage space for the retail establishment; SPECIAL PERMIT relief pursuant to Zoning
By-law Section 139-18 waiving the 18 required parking spaces; and, to the extent necessary,
validation of the lack of a loadlng ~one by a grant of SPECIAL PERMIT relief pursuant to Zoning
By-law Section 139-20. The third floor apartment would be maintained. There would be up to three
separate commercial tenants in the building. In addition, the existing rear two-story stairway
structure would be removed and reconstructed so as to provide adequate basement, first and second
floor egress. The existing staircase structure is sited at zero feet from the rear yard lot line and
would, once reconstructed, be sited at zero. Therefore, Applicant is seeking relief by VARIANCE
pursuant to Zoning By-law 139-16A to replace the stairway within the required five-foot rear yard
setback area. The structure is nonconforming as to lot area, containing about 1,386 square feet of lot
area in a district that requires a minimum lot size of 3,750 square feet; as to ground cover with the
lot containing about 91 % ground cover ratio in a district that allows a maximum ground cover of
75%; as to frontage with the lot containing about 20.84 feet of frontage along Main Street in a
district that requires a minimum frontage of 35 feet; as to setback requirements with the structure
being sited within the required five-foot rear yard setback area; as to height with the structure having
a ridge height of about 39 feet in a district that allows a maximum height of 30 feet without relief; as
to green space, with no green space provided in a district that requires a minimum open space ratio
of 200,/0; and as to parking and loading zone with no spaces provided on site. The lot is conforming as
to side and front yard setback requirements. The Premises is located at 33 MAIN STREET,
Assessor's Map 42.3.1, Parcel 211, no plan of record, Deed Reference Book 470, Page 90. The

ADDENDUM
The existing structure is currently being used for a retail business on the first and second
floors. The third floor has been historically used as a one-bedroom apartment, which
contains kitchen and bathroom facilities. The basement is not currently being used, but
has been historically used for commercial storage and showroom space for a previous
owner's furniture business prior to 1972.
In the 1970's, after the current owner purchased the building, what had been storage
space on the second floor was converted to retail space without benefit of any relief from
the Zoning Board of Appeals. Applicant is now seeking relief by SPECIAL PERMIT
pursuant to Nantucket Zoning Board By-law Section 139-33A to validate the conversion
ofthe second-floor storage space to retail use; add a rear third floor dormer within the
existing footprint of the structure but within the required five-foot rear yard setback area
and in the area over 30 feet and below the existing ridge height of about 39 feet; and to
convert the basement to primarily retail use, with ancillary storage area. Though retail
use is a permitted use as a matter of right, the expansion and change of uses in this
structure needed in the 1970' sand still needs a grant of Special Permit relief as the
structure is pre-existing nonconforming as to dimensional requirements of the Zoning
By-law. Special Permit relief for a waiver ofthe parking would have also been necessary
to convert the second floor space. A new handicap elevator would be provided to access
all three commercial levels and the apartment on the Federal Street side of the structure.
There would be up to three commercial tenants on site.
In addition, the existing rear two-story stairway structure will be removed and
reconstructed so as to provide adequate basement, first and second floor egress. The
existing staircase structure is sited at zero feet from the rear yard lot line and would, once
reconstructed, site at zero. Therefore, Applicant is seeking relief by VARIANCE
pursuant to Zoning By-law 139-16A to replace the stairway within the required five foot
rear yard setback area.
In addition, Applicant is seeking reliefby SPECIAL PERMIT pursuant to Nantucket
Zoning By-law Section l39-18A, to waive all ofthe 18 required parking spaces (16 retail,
one for employees, one for the apartment); and by SPECIAL PERMIT pursuant to
Section 139-20 to waive the loading zone requirement.
The structure is nonconforming as to lot area, containing about 1,386 square feet oflot
area in a district that requires a minimum lot size of3,750 square feet; as to ground cover
with the lot containing about 91 % ground cover ratio in a district that allows a maximum
ground cover of75%; as to frontage with the lot containing about 20.84 feet of frontage
along Main Street in a district that requires a minimum frontage of35 feet; as to setback
requirements with the structure being sited within the required five-foot rear yard setback
area; as to height with the structure having a ridge height of about 39 feet in a district that
allows a maximum height of 30 feet without relief; as to green space, with no green space
provided in a district that requires a minimum open space ratio of 20%; and as to parking
and loading zone with no spaces provided on site. The lot is conforming as to side and
front yard setback requirements.
