Applicant is seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-law
Section 139-16C(2) to validate the side yard setback of an existing about 156 square-foot utility
shed, constructed prior to 1990, and sited as close as about 7.6 feet from the southwesterly side yard
lot line, in a district that requires a minimum sid~ y~d setback of ten feet for subminimum lots. In
addition, Applicant is seeking relief by V ARIANCE to validate the siting of the shed within the
required 35-foot front yard setback area and sited as close as about 25 feet from the front yard lot
line along Kelly Road.
The Premises is located at 16 KELLY ROAD, Assessor's Map 54, Parcel 100, Plan Book

ADDENDUM
Applicant is seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning
By-law Section 139-l6C(2) to validate the side yard setback of an existing about 156
square-foot utility shed, constructed prior to 1990, that is sited as close as about 7.6 feet
from the southwesterly side yard lot line, in a district that requires a minimum side yard
setback often feet for subminimum lots. In addition, Applicant is seeking relief by
VARIANCE to validate the siting ofthe shed within the required 35-foot front yard
setback area as it is sited as close as about 25 feet from the front yard lot line along
Kelley Road.
Applicant constructed the shed just after the construction of the conforming
existing single-family dwelling in 1986 in its present location without benefit of a
building permit. The structure is arguably protected from enforcement action as the
structure is over ten years old. However, Applicant recently received permission to make
conforming alterations to the house from the HDC and the ZEO has refused to sign off on
the building permit for the work that would be conforming in all respects, and unrelated
to the siting nonconformity ofthe shed, until the shed situation is rectified.
Applicant delayed filing an appeal in February and missed the 30-day deadline for
such an appeal and is now before the ZBA to validate the siting of the shed. Applicant
argues that the Building Permit should be issued for the conforming work on the house
regardless of the status of the protected shed structure as they are unrelated, and
particularly as the shed is protected from enforcement action by MGL c 40A section 7
and can remain in its present location. However, as the Applicant wishes to complete the
expansion of his year-round dwelling, he is being forced to seek relief from the ZBA. The
greenhouse referenced in the violation letter has been removed.
Applicant states that the shed is embedded in the old growth bushes and trees, not
visible from the street and has no impact upon the neighborhood. Moving it would
require that more area would have to be disturbed to place it in a conforming location. In
addition, the HDC issued approval to renovate the shed in its present location. The
abutter most affected by the siting of the shed for almost 20 years has submitted a letter
stating that she had no issue with the shed remaining in its present location and Kelley
Road is the closest abutter on the northwest. A review of the area would indicate that this
lot is unique in the LUG-3 zoning district, with only a few other lots having such a small
lot area, with other nearby much larger lots located in the less intense LUG-l zoning
district. Applicant states that leaving the shed where it has been for almost 20 years on a
lot sited at the end of a dead-end would create no negative impact in this rural area and
relief could be granted without substantial detriment to the public. Applicant also states
that it would cause a substantial hardship to have to relocate the shed.

DECISION:
The Board of Appeals, at a Public Hearing held on Friday,
August 15, 1986 at 1: 30P .M. in the Town and County Building,
Nantucket made the following decision upon the application of
Roger S. Hoffman (080-86) of P.O. Box 2051, Nantucket, MA 02584.
1. This is an application for a Variance pursuant to Section
139-32 requesting relief from Section 139-16 (Intensity Regulations)
of the Zoning By-Law. The Applicant seeks a variance to cure
a technical defect which arose when Lot 23 was unintentionally
held in common ownership with Lot 24 for a short period of time
after the zoning freeze period expired. The property owned by
the Applicant is Lot 23 shown on Plan recorded at Plan Book 16,
Page 90, numbered 16 Kelley Road, Assessors Map 54, Parcel 100
and is located LUG III zone. The LUG III zone requires a minimum
three acre lot size.
2. Based upon a review of the Application, supporting documents,
plans and testimony, the Board finds that the property consists
of a vacant lot with an area of approximately one-half acre which
was created by a subdivision in the late 1960s. When Nantucket
adopted zoning the area was zoned for 5,000 square foot lots,
subsequently the area was zoned LUG requiring 50,000 square foot
lots, and in approximately 1975 the area was designated LUG III
requiring 120,000 square foot lots.
A predecessor in title acquired Lot 23 and an abutting lot
and held them in common ownership for a short period of time after
the zoning freeze period expired. Applicant acquired the premises
early in 1984 and just recently understood the significance of
the 10ts1pre-existing non-conforming status.
3. Variance relief may be granted to remove an alleged defect
in marketability of title by a prior owner's unintentional merger
of undersized lots. The Planning Board's recommendation is
favorable, and no opposition was heard.
4. The Board finds that the shape of and size of the lot and
the technical zoning violation which affects the marketability
of title, do not generally affect this LUG III zoning district
in which the property is located, and a literal enforcement of
the by-law would involve a substantial hardship to the Applicant

and create non-marketable, non-buildable property. The desired
relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the
intent or purpose of the by-law.
The Board specifically finds that this applicant acted in good
faith in acquiring the property and obtaining a building permit.
The Boarddistinquishesthis application from previous similar
applications because in this instance the Applicant is not the
developer and did not create the non-conformity. Also the abutting
lot which suffers the same disability is already built upon.
5. For the reasons set forth herein, the Board by unanimous
vote, hereby GRANTS the Applicant the requested relief from Section
169-16 (Intensity Regulations) of the Zoning By-Law by VARIANCE
with respect to Lot 23, 16 Kelley Road, in order to cure a technical
zoning violation permitting said property to be marketable and
buildable as a separate lot.
