A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at 1:00 P.M.. FRIDAY. JUNE 8.2007. in the Conference Room, 2 FAIRGROUNDS ROAD, Nantucket, MA, on the Application of the following: WALTER W. GRANT BOARD OF APPEALS FILE NO. 053-07 Applicant is seeking a MODIFICATION of the VARIANCE relief granted pursuant to Nantucket Zoning By-law Section 139-16A in the Decision in BOA File No. 022-97 ("Decision"), that allowed the existing single-family dwelling to be moved to a site about 23 feet at its closest point from the front yard lot line along Nonantum Avenue in a district that requires a minimwn front yard setback of 30 feet; and to a point no closer than three feet from the westerly side yard lot line, in a district that requires a minimwn side yard setback of ten feet. The move was allowed due to severe erosion of the bluff area affecting the southerly portion of the property. A then proposed new addition to the easterly side of the structure was also allowed to be sited no closer than 23 feet from the front yard lot line. Applicant now proposes to construct an addition onto the westerly side of the dwelling that would be sited as close as about 1.7 feet from that lot line and as close as about 21.5 feet from the front yard lot line. hi addition, Applicant is seeking further Modification of the Decision in order to validate the actual front yard setback <ij.stance of about 20.3 feet as opposed to the previously approved 23 feet and actual westerly side yard setback distance of about 1.7 feet as opposed to the previously approved three feet. The structure is now si ted, with front yard setback measured from Nonantum Avenue, about 20.3 feet from the northerly front yard lot line, with 30 feet being the minimum required in this zoning district, and about 1.7 feet from the westerly side yard lot line as measured from Dunham Street, the unconstructed way along the westerly side of the locus, with ten feet being the minimum required in this district. The locus, and the dwelling, conform to all other dimensional zoning requirements. Accordingly, the applicant requests Modification of the Variance granted in the Decision to expand the dwelling wi thin the northerly and westerly required setback areas without reducing the separation from the lot boundaries at the closest points. To the extent necessary, Applicant is also seeking to Modify the Decision in order to validate the current siting of the structure as the original Decision allowed a minimum westerly side yard setback of three feet and a northerly front yard setback of 23 feet.
