A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at 1:00
P.M.. FRIDAY. JUNE 8.2007. in the Conference Room, 2 FAIRGROUNDS ROAD, Nantucket,
MA, on the Application of the following:
JOHN L. COLTON
BOARD OF APPEALS FILE NO. 051-07
Applicant is seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-law
Section 139-16C(2) to validate an unintentional setback intrusion of not greater than five feet and
not closer than four feet from a lot line in order to validate the siting of an existing single-family
dwelling. A corner portion of the deck on the southerly portion of the house is sited as close as about
17.5 feet from the southwesterly side yard lot line in a zoning district that requires a minimum side
yard setback of 20 feet. In all other respects, the structures and lot conform to all other dimensional
requirements of the Zoning By-law.
The Premises is located at 308 POLPIS ROAD, A!iisessor's Map 20, Parcel 75, Land Court
Plan No. 40907-C, Lot 9. The property is zoned Limited-Use-General-3.

The applicant requests a Special Permit under Nantucket zoning By-law 139-
16.C(2), in order to validate the construction of a single-family dwelling
upon the locus, with southwesterly side yard setback of about 17.5 feet;
minimum side yard setback in this zoning district is 20 feet. The setback
intrusion was the result of a survey error by a licensed surveyor, who sited
and set the corners of the structure without taking into account the design
of the structure as including a porch, a corner of which intrudes into the
setback area. The locus, and the dwelling thereon, conform to all other
dimensional requirements of the By-law.
