A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at 1:00
P.M.. FRIDAY. JUNE 8. 2007. in the Conference Room, 2 FAIRGROUNDS ROAD, Nantucket,
MA, on the Application of the following:
PETER H. TULLOCH AND VIRGINIA C. TULLOCH, TRUSTEES OF VILLAGE WAY
NOMINEE TRUST

Applicants are seeking reliefby SPECIAL PERMIT pursuant to Nantucket Zoning By-law
Section 139-33A (alteration/expansion of a pre-existing/nonconforming structure/use). Applicants
propose to renovate the existing single-family dwelling by constructing an about 1,100 square-foot
second-floor addition within the existing footprint and without coming any closer to the westerly
side yard lot line than the existing structure. The existing ridge height of the one-story portion of the
dwelling would be increased to about 25 feet within said required setback area. A new foundation
would also be constructed under the entire dwelling. There would be other altemtions of the structure
outside of the required setback areas and would not req~ relief from this Board to be completed.
In addition, pursuant to the aforementioned section, the Applicants are seeking validation of an about
,
12 square-foot addition constructed in 1978 without benefit ~f prior relief having been granted that
increased the nonconforming ground cover. The locus is nonconforming as to lot size with the lot
containing an area of about 47,282 square feet (Lot 4), in a district that requires a minimum lot size
of 120,000 square feet; as to frontage, with the lot having about 169.34 feet of frontage along a
"Way" in a district that requires a minimum frontage of 200 feet; as to ground cover with the lot (Lot
4) containing a ground cover ratio of about 4.11% (about 2,225 square feet) in a district that allows
a maximum ground cover of 3 % or 1,500 square feet for undersized lots, whichever is greater; and
as to setback, with the structure being sited as close as about three feet from the westerly side yard
lot line in a district that requires a minimum side yard setback for subminimum lots of ten feet.
The Premises is located at 5 VILLAGE WAY, Assessor~s Map 14, Parcels 3 and 47, Lot 4
on Land Court Plan 16220-A, Lot 4A on Land Court Plan No. 16220-B. The property is zoned

ADDENDUM TO APPLICATION OF PETER H. TULLOCH et 81, TRUSTEES
The applicants propose to alter the existing single-f~ly
dwelling upon the locus by upward expansion, with no change in
the existing footprint. A portion of the alteration would be
performed within the westerly setback area as the ridge height
of the one-story portion of dwelling would be increased to a
height of about 25 feet and a new foundation placed under the
entire structure. Said work would not increase the setback
nonconformity. The locus is undersized in area, containing about
65,660 square feet as of January 5, 2005 (subject to change, as
the locus is a waterfront lot), including Lots 4, 4A and the
unconstructed Way between Lots 4 and 4A, in which no other
properties have rights); the existing dwelling has ground cover
of about 2,225 square feet, for a ground cover ratio of about
3.39%; maximum ground cover ratio in this zoning district is 3%.
The dwelling was constructed prior to the 1972 adoption of the
Nantucket Zoning By-law; however, an addition was constructed in
1978, which increased the already-nonconforming, pre-existing
ground cover of about 2,213 square feet by about 12 square feet.
Notwithstanding the increase in nonconformity, the Building
Department issued a Certificate of Occupancy for this work, on
July 18, 1978. Accordingly, the applicants request a Special
Permit under By-law ~139-33 .A, for the enlargement of the pre-
existing nonconforming structure in order to ratify and confirm
the existing ground cover of the structure, as enlarged in 1978,
and for the upward expansion of the structure within its
existing footprint. The locus is also nonconforming as to
frontage, having frontage of 169.34 feet on the Way along its
southern boundary; 200 feet is the minimum frontage in this
zoning district. The dwelling is also nonconforming as to
westerly side yard setback, being sited about 3.0 feet from the
westerly lot line, with 10 feet being the minimum side yard
setback for pre-existing, undersized lots of record in this
zoning district.

I, PETER H. TULLOCH, Co-Trustee of Five Village Way Nominee Trust, hereby depose
and say:
1. I am a resident of Vero Beach, Florida.
2. I make this affidavit of my own personal knowledge and belief.
3. I have been familiar with that certain parcel of land, together with
the building thereon, located in Nantucket, Nantucket County, Massachusetts,
now known and numbered as 5 Village Way (the "Premises") since 1970 as I
frequented the island, and particularly Pocomo, during this time.
4. My wife, Virginia C. Tulloch and I are the Co-Trustees of Five Village Way
Nominee Trust, owner of 5 Village Way, Nantucket, Massachusetts 02554. We
purchased the Premises on April 28, 1977.
5. The structure .upon the Premises has existed in its current location and
approximate configuration since at least 1970, as evidenced by the Nantucket
Assessor's Office assessment of the building on the Premises from 1970 in the amount
of $2,500.00 (copy attached hereto). '

Place, Summit, New Jersey, are tho owners of land shown as Lot 4 on L.e.
Plan 16220-A, and Lot 4A on L.C. Plan 16220-B, their ownership being
evidenced by Certificate of Title No~ 7950 on file at the Nantucket Registry
District' for tbe Land Court; and

WHEREAS, Lot 4A is vacant land adjacent to Lot 4, separated only
by a paper road, and is of sufficient'area so that if it were added to the
area of Lot 4, the Tullochs proposed addition would not violate any pro-
visions of the Nantucket Zoning By-Law;
NOW, THEREFORE, in consideration of the for$going and of the
