DECISION:
1. At a ptib1.ichearing of the Nantucket Zoning Board of
Appeals, held on Friday, April 13, 2007 at 12:00 P.M., in the
Conference Room, in the Town Annex Building, 2 Fairgrounds Road,
Nantucket, Massachusetts, the Board made the following Decision
on the application of RICHARD BEAUDETTE AND RICHELLE D'ELIA, of
PO Box 702, Nantucket, Massachusetts 02554, Board of Appeals File
No. 035-07:
2. The Applicant is seeking relief by SPECIAL PERMIT pursuant
to Nantucket Zoning By-law Section 139-16C(2) to validate a
nonconforming front yard setback distance for the single-family
dwelling that is sited as close to the front yard lot line along
Anna Drive as about 17.9 feet. The structure itself is conforming
to the 20-foot front yard setback requirement but the front stoop
intrudes into the required setback area. The house was
constructed in 1986 with the Certificate of Occupancy having been
issued in 2005, despite the front yard setback intrusion. The
property and structures are conforming in all other respects to
the dimensional requirements of the Zoning By-law.
The Premises is located at 3 ANNA DRIVE, Assessor's Map ~~,
Parcel 245.4, Plan Book 20, Page 23, Lot 5. The property is zoned
Residential-10.
3. Our decision is based upon the application and accompanying
materials, and representations and testimony received at our
public hearing. There was no Planning Board recommendation, on
the basis that no matters of planning concern were presented.
Except for the presentation by the Applicant, no support or
opposition was presented at the public hearing and there were no

letters on file. Applicant submitted an affidavit from the
predecessor in title, Bradford Murray, dated March 29, 2007, in
which he stated that he had lived on Anna Drive from 1954 to
2004. His father had owned the property on the northern side of
Anna Drive and subdivided it into several lots, one of which is
the locus. His family had built the dwelling on the locus in
1986, upon which he had worked, and that it had existed since
that time in the configuration it had today. Mr. Murray also
stated that they had mistakenly thought the property had a 10-
foot front yard setback as it had once been in the Residential-1
zoning district and sited the dwelling and front stoop
accordingly. No surveyor had been employed to site the dwelling.
4. Applicant represented that the dwelling in question was
constructed pursuant to duly issued Building Permit No. 4978-86
( "the Permit") and constructed in 1986. The Permit erroneously
stated that the zoning district was Residential-1, with a
required a front yard setback of ten feet. Unbeknownst to the
then owner, the zoning district had been changed about three
months prior to issuance of the Permit to Residential-10, with a
required front yard setback of 20 feet. The deck attached to the
dwelling was unintentionally placed in the front yard setback as
the owner and builder at the time of construction relief on the
Premises being situated within the Residential-1 zoning district.
At the time of construction, the owner did not obtain the
services of a surveyor to site the dwelling as set forth in the
affidavit of Bradford Murray, noted above. A review of the 1998
and 2004 aerials in the Town records indicated that the front
stoop had been unchanged during that time period as well.
Applicant represented that the dwelling and front stoop had
existed for a period of over 20 years, and thus protected from
enforcement action under the curative statute in M.G.L. Chapter
40A, Section 7. A Certificate of Occupancy had been issued on
September 15, 2005 without comment about the front yard setback
intrusion. However, the property is still considered noncomplying
and relief is necessary to validate the current situation,
particularly as the Applicant intends to do further work on the
property that would entail obtaining a new building permit.
5. Therefore, based upon the foregoing, the Board finds that
the situation meets the threshold criteria for the granting of
special permit relief, in that the intrusion was unintentional,
less than five feet into the required front yard setback area and
not wi thin four feet of the lot line. In addition, the Board
finds that as the front stoop was so sited prior to 1990, no
reliance upon a licensed surveyor's siting of the foundation
needed to have occurred as stated in Zoning By-law Section 139-
16C(2) in order to receive a grant of special permit relief. The
Board further finds that the burden of correcting the intrusion

substantially outweighs any benefit to an abutter of eliminating
the intrusion with Anna Drive, a private way, being the abutter
to the northeast. Since the setback violation was in the front
yard and the violation has existed for over twenty years, no
benefit to an abutter from removing the intrusion was apparent.
6. Accordingly, by UNANIMOUS vote, the Board of Appeals GRANTS
the requested relief by SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-16C(2), validating the siting of the dwelling and
front stoop, subject to the following conditions:
(a) The siting of the primary dwelling shall be
substantially as shown upon the "As-Built Plot
Plan", done by Robert A. Emack, professional land
surveyor, dated March 28, 2007, a reduced copy of
which is attached hereto as Exhibit A; and
(b) Only the existing dwelling and front stoop, as
shown upon Exhibit A, is hereby validated; no
other construction shall take place in the front
yard setback area in the absence of further relief
from the Board of Appeals.

ADDENDUM
The Applicants, Richard Beaudette and Richelle D'Elia, request a special permit
pursuant to Sections 139-30A and 139-16(C)(2) of the Nantucket Zoning By-law for their
property located at 3 Anna Drive, ("hereinafter the Property"). The Property is shown as
Lot 5 on plan recorded at the Nantucket Registry of Deeds in Plan Book 20, Page 23.
Attached hereto as Exhibit A.
The Property is located in the Residential- 10 (R-IO) zoning district. The front
yard setback in the R-1O district is twenty (20) feet. There is currently one single family
dwelling on the Property which is currently situated 17.9 feet from the front yard lot line.
More specifically, the front deck ofthe dwelling intrudes into the front yard setback by
2.1 feet as shown on an As-built Plot Plan prepared by John J. Shugrue of Nantucket
Surveyors dated July 25, 2005. Attached hereto as Exhibit B. The dwelling was issued
a building permit in 1986 and a Certificate of Occupancy issued in 2005. Copies
attached as Exhibit C. The house was unintentionally constructed with the front deck
intruding into the setback by 2.1 feet. It appears that either the owner at the time of
construction mistakenly deemed the property to be situated in the R-l zoning district (see
building permit application attached as Exhibit D), or the owner measured the setback
distance from the roadway rather than the actual lot line. See Affidavit of Bradford

The applicant is seeking a Special Permit pursuant to section 139-16(C)(2) /0
validate the minor setback intrusion. The intrusion is less than five feet and is almost
eighteen feet from the front yard lot line. In addition, the burden of correcting the
intrusion substantially outweighs any benefit to abutters of eliminating the intrusion as it
has existed for over twenty years.
The applicant respectfully requests that the Board grant them the requested
Special Permit.
