At a Public Hearing ofthe NANTUCKET ZONING BOARD OF APPEALS held at
12:00 PM on Friday, April 13, 2007, in the Conference Room, 2 Fairgrounds Road, Nantucket,
Massachusetts on the Application of GABRIELA LEVENTI, c/o Sarah F. Alger, P.C., Two
South Water Street, Nantucket, Massachusetts 02554, Board of Appeals File No. 034-07, the
BOARD made the following DECISION:
1. The Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law
Section 139-33A (alteration/expansion of a pre-existing nonconforming use/structure). Applicant
proposes to substantially renovate, alter and extend the said to be pre-existing single-family
dwelling and separate studio structure. Applicant proposes to construct new foundations under
both structures, which may increase the height of the structures within the required setback areas.
Applicant also proposes changes in roof line, roof pitch and fenestration within portions of the
existing footprints which lie within the required side and rear yard setbacks, including the
addition of a second floor, with dormers, to the studio, and other changes not affecting zoning
compliance. Neither structure would be closer to any of the lot lines following the proposed
work. In the alternative, and to the extent necessary, Applicant also requests a VARIANCE
pursuant to Section 13 9-16A to complete the proj ect as proposed. The dwelling is
nonconforming as to side yard setback, being sited as close as about 1.10 feet from the lot line on
Nantucket Avenue where a minimum often feet is required for lots fronting on two streets in this
zoning district under the definition of "Yard, Front" in By-law Section 139-2; and the studio is
nonconforming as to side and rear yard setbacks, being sited as close as about 1.07 feet from the
southeasterly side yard lot line and as close as about 1.90 feet from northeasterly rear yard lot
line, where a minimum side and rear yard setback of five feet is required. The locus otherwise
conforms to the dimensional requirements of the Zoning By-law.
The Premises is located at 55 CLIFF ROAD, Assessor's Map 30, Parcel 64, Plan Book
22, Page 118. The property is zoned Residential-I.
2. Our decision is based upon the application and accompanying materials, and
representations and testimony received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern were presented. Except for
the presentation by the Applicant's representative, no support or opposition was presented at the
public hearing and there were no letters on file.
3. Applicant, through counsel, stated that she proposes to substantially renovate the
structures on the lot, a single-family dwelling and a separate garage. Such renovation would
include lifting the structures to put new foundations, with new basement space, under each and to
do other renovations as described in the Historic District Commission Certificates of
Appropriateness No. 50,037 (house) and 50,038 (garage). There would be a slight increase in the
height of the dwelling within the required ten-foot side yard setback area along Nantucket
Avenue (with a front yard setback required for all lots in the Residential-l zoning district that
abut multiple streets or ways), and within the required five-foot southeasterly side and
northeasterly rear yard setback areas for the garage. No nonconforming portion of the structures
would come any closer to a lot line than presently sited. The garage height would be increased
from about 18' 4" to about 22' 4" in order to construct dormers and provide artist studio space on
the second floor of the garage. Applicant also proposes changes in roof line, roof pitch, and
fenestration within portions of the existing footprint of the dwelling which lie outside of the
required side yard setbacks and other changes not affecting zoning compliance.
The dwellings on the Premises were constructed prior to 1938, as they are clearly visible
on the aerial photographs from 1938 and 1957 in the Town of Nantucket records in substantially
the same configurations as exist today. At that time, as there was no zoning in effect in the Town
of Nantucket, both structures were lawfully constructed within the currently required setback
areas and are therefore entitled to grandfathered status as pre-existing nonconforming.
4. Therefore, based upon the foregoing, the Board finds that there would be an increase in
the nonconformity related to the required setbacks, with the increase in height within the
required setback areas due to the placement of new foundations under the structures as well as
other changes within the existing footprints, specifically the increase in height and construction
of new dormers on the garage. In addition, the Board finds that the proposed alterations and
expansions of the structures, as described above, would not be substantially more detrimental to
the neighborhood than the existing nonconformities. The Board further finds that no variance
relief is necessary to complete the project as proposed and allows withdrawal of that portion of
the request for relief.
5. Accordingly, by a vote of four in favor (Sevrens, O'Mara, Wiley, Tupper) and one
opposed (Koseatac), the Board GRANTS the requested reliefby SPECIAL PERMIT pursuant to
Nantucket Zoning By-law Section 139-33A allowing the alteration and extension of the pre-
existing nonconforming structures as proposed and herein described above. Relief is hereby
conditioned upon the following:
a. There shall be no exterior construction between June 15th and September 15th
related to this project herein described, in any given year;
b. The house and separate garage/studio structure shall be done in substantial
conformance with Historic District Commission Certificates of Appropriateness
Nos. 50,037 and 50,038, respectively, as may be amended from time to time;
c. The renovated structures shall be no closer to the lot lines than currently sited;
d. There shall be no shower or bathtub located within the garage/studio structure
without further relief from this Board; and
e. There shall be no human habitation of the garage/studio structure without further
relief from this Board.

Applicant requests a finding and a special permit under Mass.
Gen. Laws c.40A, ~6, and Nantucket Zoning By-law (the "By-law")
~139-33.A. Applicant seeks to alter and extend the pre-
existing, nonconforming single-family dwelling and separate
studio structure on the locus, pursuant to plans approved by the
Nantucket Historic District Commission, Certificates of
Appropriateness ##50037 and 50038. Applicant proposes to lift
both structures and replace them in the same locations on new
foundations, which may result in an increase in the height of
both structures. Applicant also proposes changes in roof line,
roof pitch, and fenestration within portions of the existing
footprints which lie within the required side and rear yard
setbacks, including the addition of a second floor, with
dormers, to the studio, and other changes not affecting zoning
compliance. Neither structure will be closer to any of the lot
lines following the proposed work, nor will any of the proposed
changes be substantially more detrimental to the neighborhood
than the existing nonconformi ties. In the al ternati ve, and to
the extent necessary I Appl icant also requests a variance under
By-law ~l39-32.A from the provisions of By-law ~139-l6.A to
undertake such alterations. The dwelling is nonconforming as to
side yard setback, having setback from Nantucket Avenue of about
1.l0 feet at the closest point, where lO feet is required for
lots fronting on two streets in this zoning district under the
definition of "Yard, Front" in By-law ~139-2, and the studio is
nonconforming as to side and rear yard setbacks, having a side
setback on the southeast of about 1.07 feet at the closest point
and rear yard setback on the northeast of about 1.90 feet at the
closest point, where a minimum side and rear yard setback of 5
feet is required. The locus otherwise conforms to the
dimensional requirements of the By-law.
