A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at 1:00
P.M.. FRIDAY. APRIL 13.2007. in the Conference Room, 2 FAIRGROUNDS ROAD,
Nantucket, MA, on the Application of the following:

The Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law
Section 139-33A(8) in order to reconfigure lot lines. Applicant proposes to exchange a portion of its
lot, containing a single-family dwelling, for a portion of the immediately abutting lot (shown as 8
Jefferson Lane, Assessor's Map 55.4.1, Parcel 200, and the subject of the companion case in BOA
File No. 031-07), having the same area of about 47 square feet. Both lots would continue to have the
same lot area as at present, with the subject lot containing about 2,995 square feet of area and with 8
Jefferson Lane containing about 2,006 square feet of area, in a district that requires a minimum lot
size of 5,000 square feet. The existing structure is nonconforming and is sited within the required
westerly five-foot side yard setback area, with frontage taken from Jefferson Lane.
The Premises is located at 42 PINE STREET, Assessor's Map 55.4.1,. Parcel 121, Plan No.
04-54, Lot A. The property is zoned Residential-Old-Historic.

ADDENDUM TO APPLICATION OF LE SELECT PROPERTIES, LLC
The applicant proposes to exchange a portion of its pre-
existing, nonconforming lot of record, containing a dwelling
pre-existing the 1972 adoption of the Nantucket Zoning By-law,
for a portion of the adj acent lot having the same area. The
portion to be exchanged by the applicant is shown as Lot F upon
a plan by Charles W. Hart and Associates, Inc., dated December
1, 2006, a copy of which is filed herewith. Lot F will be
combined with the abutter's remaining adjacent land shown as Lot
G on the Hart plan. The portion of the abutter's land which is
to be conveyed to the applicant is shown as Lot E on the Hart
plan, and it will be combined with the applicant's adjacent land
shown as Lot D on the Hart plan. The present area of the
applicant's land is about 2,995 square feet; 5,000 square feet
is the minimum area in the Residential-Old Historic zoning
district. The combined Lots D and E will continue to have lot
area of about 2,995 square feet. The dwelling upon the locus is
also nonconforming as to side yard setback as measured from Pine
street (as frontage is held from Jefferson street in order to
comply with minimum frontage of 50 feet), having zero setback
from Pine street, with five feet being the minimum required in
this district. The locus is conforming as to all other
dimensional zoning requirements. Accordingly, the applicant
requests a Special Permit under By-law ~ 139-33.A (8), for the
change in boundaries of a pre-existing nonconforming lot,
without creating any new nonconformity nor increasing any
existing nonconformity.
