NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at 1:00
P.M.. FRIDAY. APRIL 13.2007. in the Conference Room, 2 FAIRGROUNDS ROAD,
Nantucket, MA, on the Application of the following:

BOARD OF APPEALS FILE NO. 031-07
The Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law
Section 139-33A(8) in order to reconfigure lot lines. Applicants propose to exchange a portion of
their lot, containing a single-family dwelling, for a portion of the immediately abutting lot (shown as
42 Pine Street, Assessor's Map 55.4.1, Parcel 121, and the subject of the companion case in BOA
File No. 032-07), having the same area of about 47 square feet. Both lots would continue to have the
same lot area as at present, with the subject lot containing about 2,006 square feet of area and with
42 Pine Street containing about 2,995 square feet of area, in a district that requires a minimum lot
size of 5,000 square feet. Applicants are also seeking reliefby SPECIAL PERMIT pursuant to
Nantucket Zoning By-law Section 139-33E(2)(a) to be allowed to demolish and reconstruct the
single-family dwelling, increasing the existing ground COVyr from about 25.87% (about 519 square
feet) to about 43.12% (about 865 square feet), with the maximum allowable for undersized lots
being 30%. The existing structure is sited within the required westerly five-foot side yard setback
area and at zero feet from the rear yard lot line and the new structure would comply with all setback
requirements. The lot is currently nonconforming as to frontage with the lot having no frontage on a
street or way. After the reconfiguration, the lot would be less nonconforming, have a new frontage of
about 47.27 feet in a district that requires a minimum frontage of 50 feet. Required parking would be
provided on site.
The Premises is located at 8 JEFFERSON LANE, Assessor's Map 55.4.1, Parcel 200, Plan
No. 04-54, Lot A. The property is zoned Residential Id-Historic.

ADDENDUM TO APPLICATION OF CANDACE A. MILLER
AND EDWARD M. BERNARD
The applicants propose to exchange a portion of their pre-
existing, nonconforming lot of record, containing a dwelling
pre-existing the 1972 adoption of the Nantucket Zoning By-law,
for a portion of the adj acent lot having the same area. The
portion to be exchanged by the applicant is shown as Lot E upon
a plan by Charles W. Hart and Associates, Inc., dated December
1, 2006, a copy of which is filed herewith. Lot E will be
combined with the abutter's remaining adjacent land shown as Lot
D on the Hart plan. The portion of the abutter's land which is
to be conveyed to the applicants is shown as Lot F on the Hart
plan, and it will be combined with the applicants' adjacent land
shown as Lot G on the Hart plan. The present area of the
applicant's land is about 2,006 square feet; 5,000 square feet
is the minimum area in the Residential-Old Historic zoning
district. The combined Lots F and G will continue to have lot
area of about 2,006 square feet. The locus is now nonconforming
as to frontage, having no frontage upon any street or way; the
conveyance of Lot F to the applicants will result in the
combined Lots F and G having frontage of about 47.27 feet;
minimum frontage in this district is 50 feet. The dwelling upon
the locus is also nonconforming as to side yard setback, having
setback of about three feet from the westerly lot line, and as
to rear yard setback, having zero setback from the southerly lot
line, with five feet being the minimum side and rear setback
required in this district. The conveyance of Lot E by the
applicants will result in side yard setback being reduced to
about two feet; however, the applicants propose to demolish the
existing structure and to replace it with a dwelling that will
conform to all applicable setback requirements. The Nantucket
Historic District Commission has approved the proposed
demolition and new dwelling. Accordingly, the applicant
requests a Special Permit under By-law ~ 139-33.A(8), for the
change in boundaries of a pre-existing nonconforming lot,
without creating any new nonconformity nor increasing any
existing nonconformity (subject to a condition requiring the
demolition of the existing dwelling, which will eliminate all
existing setback nonconformi ties) . The applicants also request
a Special Permit under By-law ~ 139-33.E(2) (a), to allow ground
cover of up to 50% of lot area, the maximum ground cover ratio
in this district, in order for the new dwelling to have ground
cover of about 865 square feet as approved by the HDC, for a
ground cover ratio of about 43.12%; the maximum for an
undersized lot of record being 30%. Present ground cover upon
the locus is about 519 square feet, for a ground cover ratio of
about 25.87%.
