ADDENDUM TO APPEAL OF ALICE B. BURNHAM
The applicant brings this appeal from a writing entitled ~Notice
of Zoning Code Violation And Order to Cease, Desist and Abate"
dated January 31, 2007, issued by the Zoning Enforcement
Officer, which purported to order the applicant to cease and
desist all activities related to alleged violations of the
following sections of the Nantucket Zoning By-law:
~ 139-16: Violation of 30% ground cover ratio and setback
requirements;
~ 139-26: Construction/renovation of decking without the
required permits; and
~ 139-28: Occupation

The applicant, through her agents, obtained Building Permit No.
135-04 in 2004 for the alteration of a dwelling constructed in
1988 under Building Permit No. 6344-88, for which a Certificate
of Occupancy was issued. The applicant's agents assumed, on the
strength of the issuance of the Certificate of Occupancy, that
the dwelling had been constructed in conformity with Building
Permi t No. 6344-88. In fact, there were discrepancies between
the dwelling as constructed and as described in the application
for Building Permit No. 6344-88, as to ground cover, front yard
setback, and rear yard setback, and as a result the work done
under Building Permit No. 135-04 does not conform as to ground
cover and setbacks, although it is consistent with the permit
application.
Accordingly, since the alterations constructed pursuant to
Building Permit No. 135-04 are consistent with the building
permit issued by the Building Department, the applicant contends
that the attempted enforcement action undertaken by the Zoning
Enforcement Officer is inappropriate and creates an undue
hardship upon the applicant.

Mr./Mrs./Ms. Alice Burnham, and all persons having notice of this order:
As owner/occupant of the premises/structures located at 12 ~ Sherburne Tpk. (Map#
30, Parcel# 174.1), you are hereby notified that you are in violation of the Nantucket
Zoning Code f139-16, -26 and -28 and are ORDERED this date, 01/31/07, to:
1. IMMEDIA TEL Y CEASE AND DESIST all functions connected with this
violation on, or at, the above mentioned premises.

- Bring structure into compliance with the Zoning Code or receive
the appropriate relief from the Zoning Board of Appeals.
- Obtain all required permits.
- Receive an Occupancy permit for the structure.
Zoning violations may result in fines of up to $300 per day, as allowed in ~139-25 of
the Zoning Code.
If you are aggrieved by this notice and order, you may show cause as to why you should
not be required to comply by filing an appeal with the Nantucket Zoning Board of
Appeals, as specified in ~139-31 of the Zoning Code, within thirty (30) days of this order.

Applicant is APPEALING an order of the Zoning Enforcement Officer ("ZEO") dated
January 31, 2007, in which the ZEO purported to order the Applicant to cease and desist all activities
related to the alleged violations of the following sections of the Nantucket Zoning By-law: Section
139-16A, violation of the 30% ground cover ratio and setback requirements; Section 139-26,
construction and renovation of decking without the required permits; and Section 139-28, occupation
of an altered structure without a Certificate of Occupancy. Applicant asserts that since the alterations
were constructed pursuant to validly issued Building Permit No. 135-04 and are consistent with the
building permit issued by the Building Department, the attempted enforcement action undertaken by
the ZEO is inappropriate and creates an undue hardship upon the Applicant. A single-family
dwelling was constructed upon the Locus in 1988. A Certificate of Occupancy was issued, and
altered pursuant to a building permit issued in 2004. A deck on the northwesterly side of the
structure is sited as close as about 0.2 feet from the side yard lot line along Sherburne Turnpike in a
district that requires a minimum side yard setback of five feet and a porch on the southerly side of
the structure is sited as close as about 7.0 feet from the front yard lot line along Hamblin Road in a
district that requires a minimum front yard setback of ten feet. The existing ground cover is about
1,760 square feet for a ground cover ratio of about 32.8%, in a district that allows a maximum
ground cover of about 1,607 for a ground cover ratio of 30%. The 2004 addition to expand the
kitchen on the northeasterly side of the structure put the ground cover over the maximum allowed.
Additions to the existing front and rear decks were made at the same time. The Locus is conforming
as to lot size and frontage.
The Premises is located at 12 ~ SHERBURNE TURNPIKE, Assessor's Map 30, Parcel
174.1, Land Court Plan 14101-B, Lot 1. The property is zoned Residential-I.

ADDENDUM TO APPEAL OF ALICE B. BURNHAM
The applicant brings this appeal from a writing entitled ~Notice
of Zoning Code Violation And Order to Cease, Desist and Abate"
dated January 31, 2007, issued by the Zoning Enforcement
Officer, which purported to order the applicant to cease and
desist all activities related to alleged violations of the
following sections of the Nantucket Zoning By-law:
~ 139-16: Violation of 30% ground cover ratio and setback
requirements;
~ 139-26: Construction/renovation of decking without the
required permits; and
~ 139-28: Occupation

The applicant, through her agents, obtained Building Permit No.
135-04 in 2004 for the alteration of a dwelling constructed in
1988 under Building Permit No. 6344-88, for which a Certificate
of Occupancy was issued. The applicant's agents assumed, on the
strength of the issuance of the Certificate of Occupancy, that
the dwelling had been constructed in conformity with Building
Permi t No. 6344-88. In fact, there were discrepancies between
the dwelling as constructed and as described in the application
for Building Permit No. 6344-88, as to ground cover, front yard
setback, and rear yard setback, and as a result the work done
under Building Permit No. 135-04 does not conform as to ground
cover and setbacks, although it is consistent with the permit
application.
Accordingly, since the alterations constructed pursuant to
Building Permit No. 135-04 are consistent with the building
permit issued by the Building Department, the applicant contends
that the attempted enforcement action undertaken by the Zoning
Enforcement Officer is inappropriate and creates an undue
hardship upon the applicant.
