At a Public Hearing of the Nantucket Zoning Board of Appeals, held at 12:00
P.M., Friday, March 16, 2007, in the Conference Room, 2 Fairgrounds Road, Nantucket,
Massachusetts, on the Application of the RICHARD A. VALERO AND GALE L.
VALERO, of 1 Goose Pond Lane, Nantucket, MA 02554, Board of Appeals File No.
016-07, the Board made the following Decision:
1. The Applicant is seeking relief by VARIANCE under Nantucket Zoning By-law
Section 139-16A (Intensity regulations - setback) in order to validate a side setback
intrusion of the single-family dwelling. The Applicant constructed an about 462 square-
foot two-story addition onto the southwesterly side of the structure in 2000 pursuant to a
validly issued building permit. The addition was mistakenly sited as close as about 4.2
feet at one comer in a district that requires a minimum side yard setback of five feet. The
lot contains a separate single-family dwelling that fronts on Spruce Street. In addition the
locus is nonconforming as to other setback requirements with the subject house
nonconforming as to side yard setback on the northeasterly side with the set of second
floor egress stairs sited less than one-foot from that lot line, and with the other dwelling
sited as close as about 2.2 feet from the southwesterly side yard lot line. In all other
respects the lot and structures are conforming to the dimensional requirements of the
Zoning By-law.
The Premises is located at 1 GOOSE POND LANE, Assessor's Map 55, Parcel
412, Plan Book 19, Page 1, Lot 3. The property is zoned Siasconset-Residential-l.
2. The Decision is based upon the Application and the material submitted with it and
the testimony and evidence presented at the Hearing. The Planning Board made no
recommendation finding that the matter did not present any issues of planning concern.
There was one letter on file from the immediate abutter to the south. He stated that he had
no opposition to the grant of the requested relief.
3. Applicant stated that he had constructed a new two-story addition onto his single-
family dwelling in 2000 pursuant to duly issued Building Permit No. 715-00 to expand
the interior living space of the dwelling. Applicant stated that he had every intention of
meeting the side yard setback requirement as the Building Permit indicated that the side
line setback would be five feet. When the Applicant sought the Certificate of Occupancy
recently the new "Building Location Plan", drawn by Leo C. Asadoorian of Blackwell
and Associates, Inc., registered land surveyor, dated February 4,2003, a reduced copy of
which is attached hereto as Exhibit A, it was shown that the comer of the addition was
sited as close as about 4.2 feet from the southwesterly side yard lot line in a district that
requires a minimum side yard setback of five feet. Though a substantial portion of the
addition was conforming to the setback requirement, one comer of the structure intruded.
Having set the foundation batter boards himself without the assistance of a licensed
surveyor at the time, Applicant stated that he had measured the setback off of the old
fence located along the southwesterly lot line having thought that the fence was exactly
on the lot line. Applicant stated that it would be a substantial financial hardship ifhe were
to be forced to remove a portion of the addition. Applicant stated that the error was
unintentional and siting made more difficult as the lot line and house angled away from
each other at that point and were not parallel to each other. He stated that there was no
impact on the neighborhood given the mixed commercial use of the area and the fact that
his family owned most of the surrounding property with the addition itself blocked from
view from Orange Street due to the abutter's intervening structures.
4. Therefore, based upon the foregoing, the Board found that the new addition was
constructed in 2000 without benefit of a licensed surveyor to site the foundation. As the
intrusion was so sited after 1990 and without such benefit of a licensed surveyor, with the
placement of the addition having been done by the Applicant himself measuring off of
the existing fence, the Board finds that no special permit relief is available to validate the
setback intrusion. The Board finds that, though the intrusion was unintentional, a grant of
variance relief would be necessary to allow the addition to remain sited within the
required five-foot side yard setback area. The Board considered the equities in the case
and found that the desirable variance relief may be granted without substantial detriment
to the neighborhood specifically and the public good in general and without nullifying or
substantially derogating from the intent or purpose of the By-law, and that there was
sufficient uniqueness concerning the Locus, and owing to circumstances relating to this
structure and Lot, but not affecting generally the zoning district in which it is located, that
a literal enforcement ofthe provisions of the Zoning By-law would involve substantial
financial hardship to the Applicant if the two-story addition was forced to be removed.
The Board noted that the intrusion was minimal, and did not have a negative impact on
the neighborhood, particularly in light of the letter of support on file from the neighbor
most affected as noted above.
5. Accordingly, by a vote of four in favor (Waine, Koseatac, Wiley, Tupper) and one
opposed (Sevrens), the Board GRANTS the requested reliefby VARIANCE pursuant to
Nantucket Zoning By-law Section 139-16A to validate the siting of the addition as shown
upon Exhibit A.

The Applicant is seeking relief by VARIANCE under Nantucket Zoning By-law Section
139-16A (Intensity regulations - setback) in order to validate a side setback intrusion of
the single-family dwelling. The Applicant constructed an about 462 square-foot two-story
addition onto the southwesterly side of the structure in 2000 pursuant to a validly issued
building permit. The addition was mistakenly sited as close as about 4.2 feet at one
comer in a district that requires a minimum side yard setback of five feet. The lot
contains a separate single-family dwelling that fronts on Spruce Street. Applicant's house
is part of a family compound that has been controlled by the family since the early
1970' s. Applicant set the batter boards himself for the addition and did not use a surveyor
until the structure was completed and the Applicant was seeking a CO. He measured off
of the existing fence, which had been in its present location for over 35 years. The house
is not parallel to the southwesterly side yard lot line and just a comer of the structure was
sited within the setback area with a majority of the addition sited outside the five-foot
setback area.
In addition the locus is nonconforming as to other setback requirements with the subject
house nonconforming as to side yard setback on the northeasterly side with the set of
second floor egress stairs sited less than one-foot from that lot line, and with the other
dwelling sited as close as about 2.2 feet from the southwesterly side yard lot line. In all
other respects the lot and structures are conforming to the dimensional requirements of
the Zoning By-law.
