A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at 12:00
P.M.. FRIDAY. MARCH 16.2007, in the Conference Room, 2 FAIRGROUNDS ROAD,
Nantucket, MA, on the Application of the following:

The Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law
Section 139-33A (alteration/expansion of a pre-existing nonconforming use/structure). Applicant
proposes to construct conforming additions, totaling about 342 square feet, to the existing single-
family dwelling and conforming additions, totaling about 1,246 square feet, to the detached garage.
The garage would remain an ancillary structure and not be used for human habitation. The
nonconforming ground cover ratio of about 4.03% would increase to about 5.7% in a district that
allows a maximum ground cover of 4%. The property is also nonconforming as to side yard setback
with a solar panel sited as close as about 11.7 feet from the easterly side yard lot line in a district that
requires a minimum side yard setback of 15 feet. In all other respects the property and structures are
conforming to dimensional requirements of the Zoning By-law.
The Premises is located at 85 MlLLBROOK ROAD, Assessor's Map 40, Parcel 26.2, Land
Court Plan No. 8852-P, Lot 24. The property is zoned Limited-Use-General-2.

ADDENDUM TO APPLICATION OF BARBARA B. SPITLER
The applicant requests the Board of Appeals to grant a Special
Permit under Nantucket Zoning By-law ~ 139-33.A, in order to
enable the applicant to construct additions to the existing
single-family dwelling and detached garage upon the locus.
Until the passage of Article 32 at the April, 2006 Annual Town
Meeting, the locus was situated partly in the Limited Use
General-2 zoning district and partly in the Residential-2 zoning
district; the existing structures were entirely within the
Residential-2 district. The ground cover of the existing
structures, which pre-existed the publication of the notice of
the Planning Board's first public hearing on Article 32, is
about 3,960 square feet (2,930 for the dwelling; 1,030 for the
garage); the locus contains about 98,152 square feet in lot
area, for a ground cover ratio of about 4.03%; the maximum
ground cover ratio in the Limited Use General-2 (~LUG-2") zoning
district is 4%. The maximum ground cover ratio in the
Residential-2 (~R-2") zoning district is 12.5%, and the portion
of locus which was formerly situated in the R-2 district
contains about 71, 600 square feet; accordingly, the locus was
conforming as to ground cover ratio until the Article 32
rezoning, and was rendered nonconforming in that respect
thereby. A solar panel upon locus is situated as close as about
11.7 feet from the easterly side lot line; minimum side yard
setback in the LUG-2 district is 15 feet. The locus and
structures thereon are in conformity with all other dimensional
zoning requirements. The applicant proposes to construct
additions to the dwelling containing a total of about 342 square
feet, and an addition to the garage containing about 1,246
square feet; total ground cover will thus be increased to about
5,548 square feet, for a ground cover ratio of about 5.7%. The
garage as enlarged will continue to be an accessory structure,
not used for human habitation. As the existing improvements
upon locus already exceed the present maximum ground cover
ratio, as a pre-existing, nonconforming condition, the
enlargement thereof may be accomplished by Special Permit under
~ 139-33.A.
