DECISION:
1 . At a Public Hearing of the Nantucket Zoning Board of Appeals, originally noticed
for February 9, 2007, continued to February 13, 2007, due to a lack of a quorum, the
continued to 12:00 P.M., Friday, March 16, 2007 without opening, at which meeting a
Decision was rendered, DORIS J. LENNON, TRUSTEE, LIVING TRUST OF JOSEPH
R LENNON AND DORIS J. LENNON, with a mailing address of 6102 NW 68 Terrace,
Tamarac, FL 33321, Board of Appeals File No. 009-07, the Board made the following
Decision:
2. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law
Section 139-88 (2) to validate the existing beauty shop and be able to use the shop
space for other neighborhood service establishments such as "barber, beauty, shoe
repair, tailor shops, funeral homes, photographer's studios, art gallery, art salon,
antique/craft shop, and upholsterers' shops", and/or similar low intensity use such as
professional office for an architect, lawyer, chiropractor, massage or physical therapist.
The existing shop consists of about 549 square feet of space. The dwelling was
constructed in 1977 and in 1979 a building permit was issued for construction of an
addition for "in home business" use, specifically as a "resident beautician". No
certificate of occupancy was ever issued for the addition. The prior owner operated her
beauty salon until 1986 and since then the shop has been used as a beauty salon by up
to two nonresident beauticians. The shop has three stations to service customers. In
addition Applicant is seeking relief by VARIANCE pursuant to Zoning By-law Section
139-16A (Intensity regulations-rear yard setback) in order to validate the siting of the
1979 addition that was sited as close as about 3.9 feet from the northeasterly rear yard
lot line, in a district that now requires a minimum rear yard set back of ten feet. In all
other respects the lot and dwelling are conforming to the requirements of the Zoning By-
law. To the extent necessary, Applicant is also seeking relief by SPECIAL PERMIT
under Zoning By-law Section 139-20 (loading zone) in order to waive the loading zone
requirements should the Board deem said Section applicable. The required parking
would be provided on site.
The Premises is located at 2 WAYDALE ROAD, Assessor's Map 55, Parcel 214,
Plan Book 18, Page 136, Lot 22. The property is zoned Residential - 10.
2. Our Decision is based upon the application and accompanying materials, and
representations and testimony received at our public hearing. There was no Planning
Board recommendation. There were no letters received regarding this matter. Except
for the presentation of the Applicant through its representative, there was no support or
opposition presented at the public hearing.
3. Applicant, through her representative, stated that pursuant to 1979 Building
Permit No. 1346-79 (the "Permit") the addition that contains the beauty salon, consisting
of approximately 549 square feet of ground cover, was constructed with three stations
to service salon customers. The Permit stated that the addition was for the "resident
beautician" and for an "in home business". The then Building Inspector did not require
that the Applicant seek special permit relief for the neighborhood service establishment.
No Certificate of Occupancy was ever issued and the violations were not known until
recently. The owner/occupant at the time, Evelyn Lennon, operated the beauty salon
until her death in 1986. After that date the beauty salon continued to be used by one or
two nonresident beauticians until the fall of 2006. Applicant is seeking to have the use
validated under Section 139-8B(2).
The Applicant is also requesting the ability to be able to change the use within
the scope of those allowed in Section 139-8B(2) to other neighborhood service
establishments without having to return to this Board each time, given that the property
is for sale and a new owner may not choose to continue with the current beauty salon
use. Any new use would be of a similar low intensity. Applicant submitted a "Plan of
Land", done by Hayes Engineering, Inc., dated January 2, 2007, a reduced copy of
which is attached hereto as Exhibit A, that showed that the property could
accommodate up to six parking spaces. However, there was no space for a conforming
loading zone should the Board find that one was necessary for this use. In the past the
Board has not required such a space for this type of use.
Applicant, through her representative, stated that prior to the April 1979 Annual
Town Meeting, the side line setback requirement had been increased from three feet in
1977 to five feet in 1978. In 1979, the requirement had been changed again to a
minimum side and rear yard setback of ten feet in the R-10 zoning district.
Nevertheless, the then Building Inspector erroneously noted that the rear setback was
five feet. The addition had been constructed as close as about 3.9 feet, though there
seemed to be an attempt to meet the setback requirement as the structure was sharply
angled to parallel the rear lot line. In any case, surveyors were not regularly employed
at that time to ensure setback compliance during the foundation stage. Though arguably
protected from enforcement action under the curative provisions of the Mass General
Laws Chapter 40A, Section 6, the property is noncomplying and not grandfathered,
necessitating a grant of variance relief to validate the siting of the addition. Applicant
argues that to require removal or reconstruction of the addition, which has been in
existence for almost thirty years, would cause the Applicant substantial hardship,
financial and otherwise and desirable relief could be granted without substantial
detriment to the public good and without nullifying or substantially derogating from the
intent or purpose of the By-law.
4. Therefore, based upon the foregoing, the Board of Appeals finds that the use as
a neighborhood service establishment, specifically a beauty salon, would be in harmony
with the general purpose and intent of the Zoning By-law and a grant of relief would be
consistent with similar grants of relief in the same neighborhood for similar uses. In
addition, though the Board does not generally require loading zones for this type of use,
the Board finds that a grant of special permit relief to waive the loading zone to the
extent necessary would be in harmony with the general purpose and intent of the
Zoning By-law and not create an unsafe traffic situation. Further, the Board finds that
the requested variance relief may be granted to validate the siting of the existing
structure that is sited as close as about 3.9 feet from the rear yard lot line and finds that
there is an uniqueness in the topography of the structures, with the unusual placement
of the dwelling in 1978 which created an odd angle from which the 1979 addition was to
be constructed, and the fact that to require removal or reconstruction of a portion of the
structure, which has been in existence for almost thirty years, would cause the Applicant
substantial hardship, financial and otherwise and desirable relief can be granted without
substantial detriment to the public good and without nullifying or substantially derogating
from the intent or purpose of the Zoning By-law.
The Board was uncomfortable granting the ability to be able to alter the uses in
the space currently occupied by the beauty salon without having to seek a modification
of the relief first. The Board preferred to validate the existing use as a beauty salon with
the proviso that any alteration of the use would require further relief from this Board.
5. Accordingly, by UNANIMOUS vote, the Board GRANTS the requested SPECIAL
PERMIT relief pursuant to Nantucket Zoning By-law Section 139-8B(2) for a
neighborhood service establishment (validating the existing use that has operated on
the site since 1979), specifically, as a beauty salon; by the same vote, GRANTS the
requested SPECIAL PERMIT relief pursuant to Section 139-20, to waive any
requirement for an off-street loading zone; and by the same vote, GRANTS the
requested VARIANCE relief pursuant to Section 139-16A to validate the siting of the
existing structure and addition. Relief herein granted is conditioned upon the following:

a. The siting of the structure/addition and parking (excluding the loading
zone) shall be substantially as shown upon the "Plan of Land", done by
Hayes Engineering, Inc., dated January 2, 2007, are reduced copy of
which is attached hereto as Exhibit A;
a. There shall be no further expansion of the structure/addition within
the required setback areas without further relief from this Board;
b. There shall be no change in use of the beauty salon area without further
relief from this Board unless to a use allowed as a matter or right, such as
living space; and
c. There shall be no more than three employees working in the beauty
salon at peak shift without further relief from this Board.

ADDENDUM
Applicant is seeking relief by Special Permit pursuant to Section 139-8B. 2 for a
neighborhood service establishment (beauty shop or similar use such as barber, beauty,
shoe repair, tailor shops, funeral homes, photographer's studios, art gallery, art salon,
antique/craft shop, and upholsterers' shops) and/or low impact office space such as
architect, lawyer, chiropractor, massage, physical therapy, consisting of approximately
549 +/- square feet. Building Permit No. 728-77 was issued in 1977 for a single family
dwelling and a Certificate of Occupancy was issued in 1978. Building Permit No. 1346-
79 was issued in 1979 for an addition for "in home business" use "resident beautician",
but no Certificate of Occupancy was ever issued. Evelyn Lennon, a prior
owner/occupant used it for a beauty salon until her death in 1 986. Since 1 986 it has
been used as a beauty salon by one or two nonresident beauticians. The beauty shop
has three (3) stations to service customers.
Applicant is seeking Variance relief pursuant to Section 139-32 to approve the siting of
the structure which has existed since 1979. The rear setback of the addition which was
built in 1979 has a rear lot line set back of 3.9 to 4.4 feet. In all other instances the
structure meets setbacks and groundcover requirements. The Board may find that
circumstance relating to the soil conditions, shape or topography of such land or
structures but not affecting generally the zoning district in which it is located, a literal
enforcement of the provisions of the zoning by-law would involve substantial hardship,
financial or otherwise, to the applicant and desirable relief may be granted without
substantial detriment to the public good and without nullifying or substantially derogating
from the intent or purpose of such bylaw.
Applicant is also seeking Special Permit relief pursuant to Section 139-20 to waive the
Off-street loading facilities requirement or in the alternative to allow the proposed
driveway to also serve as the Off-street loading facility or to approve a modified loading
zone. The Applicants' proposed uses require nominal deliveries for any purpose and the
use has been in existence since 1979 without a loading zone.

ADDENDUM
Applicant is seeking relief by Special Permit pursuant to Section 139-8B. 2 for a
neighborhood service establishment (beauty shop or similar use such as barber, beauty,
shoe repair, tailor shops, funeral homes, photographer's studios, art gallery, art salon,
antique/craft shop, and upholsterers' shops) and/or low impact office space such as
architect, lawyer, chiropractor, massage, physical therapy, consisting of approximately
549 +/- square feet. Building Permit No. 728-77 was issued in 1977 for a single family
dwelling and a Certificate of Occupancy was issued in 1978. Building Permit No. 1346-
79 was issued in 1979 for an addition for "in home business" use "resident beautician",
but no Certificate of Occupancy was ever issued. Evelyn Lennon, a prior
owner/occupant used it for a beauty salon until her death in 1986. Since 1986 it has
been used as a beauty salon by one or two nonresident beauticians. The beauty shop
has three (3) stations to service customers.
Applicant is seeking Variance relief pursuant to Section 139-32 to approve the siting of
the structure which has existed since 1979. The rear setback of the addition which was
built in 1979 has a rear lot line set back of 3.9 to 4.4 feet. In all other instances the
structure meets setbacks and ground cover requirements. The Board may find that
circumstance relating to the soil conditions, shape or topography of such land or
structures but not affecting generally the zoning district in which it is located, a literal
enforcement of the provisions of the zoning by-law would involve substantial hardship,
financial or otherwise, to the applicant and desirable relief may be granted without
substantial detriment to the public good and without nullifying or substantially derogating
from the intent or purpose of such bylaw.
Applicant is also seeking Special Permit relief pursuant to Section 139-20 to waive the
Off-street loading facilities requirement or in the alternative to allow the proposed
driveway to also serve as the Off-street loading facility or to approve a modified loading
zone. The Applicants' proposed uses require nominal deliveries for any purpose and the
use has been in existence since 1979 without a loading zone.
