NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at 1:00
P.M.. FRIDAY. APRIL 13.2007. in the Conference Room, 2 FAIRGROUNDS ROAD,
Nantucket, MA, on the Application of the following:

Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law Section
139-33A (alteration/expansion of a pre-existing nonconforming use/structure). Applicant proposes to
renovate an existing secondary dwelling that is sited as close as about 14.6 feet from the
southwesterly side yard lot line in a district that requires a 20-foot side yard setback. An about 144
square-foot addition would be constructed on the southerly side of the cottage and an about 96
square- foot open porch would be constructed on the northerly side of the structure. Both additions
would be conforming as to the setback requirement. Two new conforming dormers would also be
added on the northeasterly side of the cottage. However, two new dormers are proposed to be
constructed in order to gain light into the second floor living space on the southwesterly side of the
structure that would be constructed within the required 20-.foot setback area but would not come any
closer to the lot line than the existing structure with the dormer expansion taking place within the
existing footprint of the cottage. In addition, and to the extent necessary, the Applicant is seeking the
same relief as stated above, in order to remove and replace the roof system of the separate ancillary
storage shed. There would be no change in the siting and no expansion of the footprint of the shed as
part of this Application. The shed is sited as close as about 0.1 feet from the southwesterly side yard
lot line and as close as about 0.3 feet from the northwesterly side yard lot line in a district that
requires a minimum side yard setback of 20 feet. In all other respects, the locus and structures,
including a primary dwelling, are conforming as to dimensional zoning requirements.
The Premises is located at 290 POLPIS ROAD, Assessor's Map 25, Parcel 3, Land Court
Plan 40267-A, Lot 1. The property is zoned Limited-Use-Geneml-3.

ADDENDUM TO ZBA APPLICATION
MARIANNE BOESKY
The Applicant, Marianne Boesky, requests Special Permit relief for her property located
at 290 Polpis Road (the "Locus"), Parcel 3 on Nantucket Town Assessor's Map 25, Lot 1 on
Land Court Plan 40267.
The Applicant is seeking relief by Special Permit under Nantucket Zoning By-law ~139-
33(A)(4). The Applicant proposes to renovate the existing single family secondary dwelling on
the Property. More specifically, the Applicant proposes to build a 144 square foot addition to the
first floor of the existing secondary dwelling on the south side of the dwelling as shown on the
attached architectural plans attached hereto as Exhibit E.. In addition to this 144 square foot
addition, the Applicant also proposes to add a 96 square foot open porch on the north side on the
secondary dwelling, also shown on Exhibit E. Both the proposed 144 square foot addition and
the 96 square foot open porch would be conforming as to the setback requirement. Additionally,
two (2) new conforming dormers would also be added to the northeasterly side of the cottage.
However, two (2) new dormers are proposed on southwesterly side of cottage, each being 4'
wide by 2' deep and located within the current 20' side yard setback, but no closer to the
westerly lot line than the existing structure, 14' 6". The proposed renovation and addition to the
existing footprint is in accordance with and pursuant to the Certificate of Appropriateness No.
49845 issued by the Nantucket Historic District Commission on January 30, 2007, a copy of
which is attached hereto as Exhibit A. The Applicant also seeks permission from the Board, by
Special Permit if necessary, to re-roof the shed on the property, which is a pre-existing, non-
conforming structure, located as close as 0.1" to the northerly lot line, as more fully set forth
below.
The subject property is located in the Limited Use General- 3 (LUG-3) Zoning District.
The structures on the Property were erected well prior to 1971. Subsequently, after the
Nantucket Zoning By-Law was created, the intensity regulations of the LUG-3 Zoning District
changed several times throughout the years from no side/rear yard setback required, to a rear and
side yard setback requirement of ten (10) feet, to the now current rear and side yard setbacks for
the LUG-3 Zoning District of twenty (20) feet. The attached Plot Plan from Michael S.
Bachman, Exhibit B hereto, shows that the existing secondary dwelling on the Property is
located as close as fourteen feet, six inches (14' 6") from the westerly lot line and within the
required twenty (20) foot side yard setback. Additionally, the shed is shown as close as 0.1'
from the westerly lot line and within the required twenty (20) foot side yard setback.
Both the lot and the structures on the Property are considered pre-existing, non-
conforming and are grandfathered with respect to the current requirements of the LUG-3 Zoning
District as they were all erected in their current locations well prior to 1971. The main dwelling,
secondary dwelling and shed are shown on Plot Plan prepared by Michael S. Bachman, dated
July 14, 2000, Exhibit B hereto. Attached as Exhibit C hereto is a zoning affidavit of Jane Lamb,
of 38 Wauwinet Road, who has lived at Chaos Comer, 38 Wauwinet Road, for over eighty-one
(81) years. Mrs. Lamb's affidavit confirms that the structures have been in their present location

for over fifty (50) years... Also attached, as Exhibit D hereto, is a copy of the book entitled
"Nantucket, A Camera Impression" by Samuel Chamberlain, from 1955 showing a picture of the
main dwelling and second dwelling on the Property. Accordingly, all structures on the locus are
considered pre-existing, non-conforming as to location
Granting the proposed Special Permit will not be substantially more detrimental to the
neighborhood than the existing, non-conforming dwelling on the Property. The proposed
renovation and addition to the existing secondary dwelling is moderate in size. The renovated
dwelling will be in harmony with other houses in this area of the island. Also, by granting the
requested Special Permit, the Board would be acting in a manner consistent with the spirit and
intent of the Zoning By-Law. The Applicant is not proposing any work or change to the
footprint or change the use of the shed on the Property other than permission to re-roof the shed.o
Accordingly, the Applicant respectfully requests the Board to grant the requested Special
Permit.

2. I make this affidavit of my own personal knowledge and belief.
3. I have been familiar with that certain parcel of land, together with the buildings
thereon, located in Nantucket, Nantucket County, Massachusetts, now known
and numbered as 290 Polpis Road (the "Premises") for over fifty (50) years as I
previously visited the former owners of the Premises for various social
engagements.
4. Both the lot and the structures on the Premises, including the main house,
cottage and shed, as shown on the building location plan drawn by Michael S.
Bachman, dated July 14,2000, a copy of which is attached hereto as Exhibit A,
have existed in their current locations and configurations since at least 1971.
