NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held
at 1:00 P.M.. FRIDAY. JANUARY 5. 2007. in the Conference Room, 2
FAIRGROUNDS ROAD, Nantucket, MA, on the Application of the following:
OLD NORTH WHARF COOPERATIVE, INC.

The Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning
By~law Section 139-33A (alteration/expansion of a pre~existing nonconforming
structure/use) in order to alter and extend a said to be pre-existing waterfront structure,
consisting of a catwalk, wharf and piers. These structures are said to pre-exist the current
provisions of Section 139-22B, which prohibit extensions and creation or new
appurtenant structures to existing docks, piers and wharves. The Applicant proposes to
relocate and construct a minor expansion to an existing catwalk; realign aT-pier so that it
is perpendicular to other wharfs and piers; extend the main wharf to include a wave
attenuation fence; and rebuild the northern pier in its existing footprint with addition of
an about 10' x 40' float and ramp with piles. In the alternative, the Applicant requests
relief by VARIANCE from the provisions of Section 139-33B. See also BOA File No.
014-92 (File Nos. 089-84, 029-88, 096-88 and 015-92 related to landward uses and
structures and not relevant to this Application).
The Premises is located at 29A, 29B AND 29C OLD NORTH WHARF,

ADDENDUM TO APPLICATION OF OLD NORTH WHARF COOPERATIVE, INC.
The applicant requests relief by Special Permit under Nantucket

DECISION:
, The Zoning Board of Appeals, at a public hearing held on
Friday, February 7, 1992, at 1:00 P.M. in the Town and County
Building, Nantucket, made the following decision upon the
Application of ALFRED F. SANFORD, III., EDWARD J. SANFORD AND
JEANETTE S. FOWLKES, TRUSTEES OF OLD NORTH WHARF TRUST u/d/t dated
October 20, 1992 with an address of Zero Main Street, Nantucket,
MA 02554, recorded as Document No. 20275 at the Nantucket Registry
District for the Land Court, Board of Appeals file no. (014-92) in
connection with property located at Old North Wharf, Nantucket, MA.
1. Applicants seek a SPECIAL PERMIT under Section 139-33A
of the Nantucket Zoning By-Law to reconstruct the four
pile-supported cottages known as "Zenas Coffin", "Peru", "Edward
Carey" and "Seaquin", together with the access cat-walks thereto,
which structures were destroyed by the coastal storm of October
3l/November 1, 1991. The structures were located on piles in
Nantucket Harbor adjacent to, accessed from and considered a part
of Old North Wharf off Easy Street, Assessor's Parcels 42.3.1 - 29,
30, 32 and 33, which are respectively Lots 2, 3, 7 and 5 on Land
Court Plan No. 10,2232-A (for title see Certificates of Title No.
8511 and 8655 at the Nantucket Registry District), all of which are
zoned Residential-Commercial.
2. Our findings are based on the Application papers
including the site plan showing the approximate locations of the
cottages to be reconstructed pursuant to this Application, a copy
of which is attached hereto as Exhibit "A", and representations and
testimony received at our hearing.
3. The pre-storm uses on the property consisted of eleven
single family residential cottages, the Wharf Rat Club and an
office and utility building. Adequate parking for all pre-existing
uses is provided on the lot. No work is proposed pursuant to this
permit other than to rebuild the pre-storm residential structures
in their pre-existing locations and in substantially the same
configuration, together with the access cat-walks thereto all as
shown on the plan attached as Exhibit "A". Each of these cottages
is a single family residential structure entitled to be
reconstructed by Special Permit under Section l39-33A of the
Nantucket Zoning By-Law.
4. The Planning Board recommendation on this Application
was favorable, and according to Applicant, the Conservation
Commission has reviewed the project and issued an Order of
Conditions allowing the proposed work and the Applicants have been
told that they can proceed with the proposed reconstruction by the

Waterways Division of the Massachusetts Department of Environmental
Protection under Chapter 91 of the General Laws.
5. As this reconstruction project is to restore
residential structures destroyed by the storm in substantially the
same configuration, we find that it is in harmony with the intent
and purpose of the Zoning By-Law to allow this relief and that the
proposed project will not be substantially more detrimental to the
neighborhood.
Accordingly, by a Unanimous vote, this Board hereby GRANTS,
to the Applicants the requested SPECIAL PERMIT under Section
l39-33A to alter and reconstruct four pile-supported cottages and
the access cat-walks thereto in substantial conformity with the
plan attached hereto as Exhibit "A".
