NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will
be held at 1:00 P.M.. FRIDAY. JANUARY 6. 2006. IN THE CONFERENCE
ROOM, TOWN ANNEX BIDLDING, 37 Washington Street, Nantucket,
Massachusetts. on the Application of the following:

Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-9B(2)( 0) to allow a seasonal take-out food service establishment to be
conducted in a portion of a commercial structure located on Straight Wharf. The structure
is located at the northeasterly comer of the solid fill wharf area and currently contains
public bathrooms. The new take-out establishment would occupy the about 600 square-
foot space formerly occupied by Nantucket All Serve General Store, which was located
in the northerly portion of the structure. Applicant proposes to provide up to 24 exterior
seats for patrons located to the west of the structure. Applicant is also seeking relief by
SPECIAL PERMIT under By-law Section 139-18.B (Off-Street Parking Requirements)
to waive the additional parking spaces and validate the lack of parking on Straight Wharf;
under Section 139-20 waiving the loading zone requirement; and under Section 139-33.A
(alteration/expansion of pre-existing, nonconforming uses/structures). The second floor
of the structure would continue to be used as office and storage spaces ancillary to this
first floor use. A nearby shed enclosure would be removed but the structure itself is not
proposed to be expanded. The new use would require 12 additional parking spaces. The
previous retail use of the space required three spaces and one for employees. The Locus
is pre-existing, nonconforming as to use, parking, setbacks, ground cover, and loading
zone requirements. The Wharf is a large lot that contains several different commercial
uses such as restaurants, retail spaces and marina facilities, as well as docking space for
ferry service. The lot also contains several second floor apartments. See also BOA File
Nos. 005-89 and 007-03 that related to separate structures located on Straight Wharf on
the same lot.
The Premises is located at STRAIGHT WHARF, Assessor's Map 42.2.4,

Addendum
Straight Wharf - Allserve Building
Applicant requests a Special Permit to allow a take-out food establishment to be
conducted in a portion of one of the buildings on Straight Wharf (the "premises")
pursuant to Section 139-9B( 0), a waiver of the additional parking and any loading zone
that would be required in connection with that use pursuant to Section 139-18B and 139-
20C, and relief pursuant to Section 139-33A to alter the preexisting nonconforming
structure and uses.
The premises are located on Straight Wharf as shown on the attached plan and
currently are utilized for retail and restroom uses. The applicant now proposes to
convert the retail portion of the first floor of the building previously occupied by the
Allserve General Store (indicated in green on the attached plan) to a take-out food
establishment. The second floor of the building will continue to be used as office and
storage ancillary to this first floor use. A nearby shed enclosure will be removed but the
building itself will not be expanded. Tables accommodating 24 seats are proposed in
the outdoor seating area indicated in purple on the plan. The take-out food
establishment use requires a Special Permit in this RC zone, and triggers a requirement
of 12 parking spaces (5 spaces for the take-out station, 1 for employees, and 6 for the
seating).
This sort of seasonal take-out food establishment use is consistent with the other
uses on Straight Wharf. No on-site parking is proposed and none can be provided. The
proposed take-out food establishment will serve existing pedestrian traffic on Straight
Wharf and will not increase the number of people utilizing the Wharf. There are readily
accessible public loading zones in the immediate neighborhood that will service the
premises adequately.
To the extent required, the Applicant also requests that the plot plan be
approved under the Minor Site Plan Review provisions of Section 139-23.

Dear Linda:
Enclosed on behalf of NIR Retail LLC are the original and four copies of
the Application for a Special Permit to change the retail use known as the
Allserve General Store so as to permit a take-out food establishment to be
conducted in a portion of one of the buildings on Straight Wharf, and a waiver of
the additional parking and any loading zone that would be required in
connection with that use.
Also enclosed is the $300 filing fee check, the certified abutters list and
two sets of mailing labels.
Please notice this Application for the January 6, 2006 hearing, and if you
