DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, February 10, 2006, at 12:00 P.M., in the
Conference Room, in the Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts, the Board made the following
Decision on the Application of ANDREA GIROUX and DONALD GIROUX,

Nantucket, Massachusetts 02554, File No. 007-06:
2. Applicants are seeking SPECIAL PERMIT relief under
Nantucket Zoning By-law Section 139-16C(1) in order to reduce the
southerly rear yard setback requirement from ten feet to about
six feet in order to validate the siting of an existing single-
family dwelling. The house is otherwise conforming to all setback
requirements. However, a new addition was constructed onto the
rear of the dwelling in 2004 along with a below grade timber
retaining wall and stairs that provide access to the cellar door,
which are sited as close as about 6.2 feet from the rear yard lot
line. The locus is conforming in all other respects.
The Premises is located at 40 Hummock Pond Road,
Assessor's Map 56, Parcel 291, Land Court Plan No. 14830-X. The
property is zoned Residential-2.
3. Our Decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board made no
recommendation as there had been no meeting in time to render an
opinion. There were no letters of support or in opposition
presented at the public hearing and no public comment. Mrs.
Giroux stated that she had spoken to the owner of the abutting
lot to the rear and that owner had stated that they had no
objection to relief being granted.
4. Applicants, through counsel and personal testimony,
stated that the original single-family dwelling was built in the
1980s, and the addition was built in 2004 pursuant to a validly
issued building permit. However, a below grade timber retaining
wall and below grade timber and stone stairs providing sole
access to the cellar door in the basement at the rear of the
addition were added. The structure itself is conforming in all
respects. During the construction process the method of accessing
the basement level was changed and Applicants stated that they
were unaware that such below grade walls and stairs were
prohibited in the required ten-foot rear yard setback area at the
time, thinking they would be considered a landscaping element and
thus exempt. When the new ~Building Location Plan", dated January
4, 2006, revised January 18, 2006, and done by Charles W. Hart,
(a reduced copy of which is attached hereto as Exhibit A) was
done in order to obtain the Certificate of Occupancy, it revealed
that the timber retaining wall and stairs were within the
required ten foot setback and sited as close as about 6.2 feet
from the rear lot line. Subsequently, The Zoning Enforcement
Officer (~ZEO") made a determination that such sub-grade
structures counted in his determination for setback compliance
and advised the Applicants that zoning relief was required to
validate the wall and stairs. The ZEO also stated that window
wells could be sited within setback areas currently without the
necessity of zoning relief. Applicants would also have to
construct a railing around the basement entrance but such fence
could be located within the setback area without relief from this
Board.
5. Therefore, the Board finds that reducing the southerly
rear yard setback requirement from ten feet to six feet to
validate the sub-grade retaining wall and stairs that provide
exterior access to the basement level would not be substantially
more detrimental to the neighborhood, having little impact, and
be in harmony with the general purpose and intent of the
Nantucket Zoning By-law.
6. According, the Board of Appeals, by a UNANIMOUS vote,
GRANTS the requested relief by SPECIAL PERMIT under Nantucket
Zoning By-law Section 139-16C (1) to reduce the southerly rear
yard setback from ten feet to six feet to validate the siting of
the sub-grade wall and stairs in the required rear yard setback
area, subject to the following conditions:
(a) The siting of the sub-grade stairs and retaining
wall to the basement level are sited in
substantial conformance with Exhibit Ai and
(b) There shall be no further building or expansion
of the wall and stairs within the required ten-
foot rear yard setback area.

Applicants are seeking relief by SPECIAL PERMIT pursuant to Nantucket Zoning By-
law Section 13 9-16C(l )to reduce the ten-foot rear yard setback distance from 10 feet to 5
feet. Applicants constructed an addition to a single-family dwelling in 2004 which
included an entryway to the basement. The steps to the basement as well as the timber
retaining wall encroach into the required 10 foot rear yard setback area and are 6.2 feet :l:
from the rear yard lot line at the closest point. Applicants were unaware that the steps
and retaining wall were intrusions into the setback under the Nantucket Zoning By-law.
The lot is conforming in all other respects. The Premises is located at 40 Hummock
