NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will
be held at 12:00 P.M.. FRIDAY, FEBRUARY 10,2006, IN THE CONFERENCE
ROOM, TOWN ANNEX BUILDING, 37 Washington Street, Nantucket,
Massachusetts, on the Application of the following:

Applicant is seeking reliefby SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-33A (expansion/alteration of a pre-existing nonconforming
structure/use). Applicant proposes to demolish a nonconforming "Quonset Hut" and a
metal gas storage shed, having a total combined ground cover of about 1,323 square feet,
and that are used in conjunction with Applicant's plumbing, heating and gas business.
Applicant proposes to then construct a new storage structure, having a total ground cover
of about 1,360 square feet. The new structure would comply with all dimensional zoning
requirements and all of the required parking and loading zone would be provided on site.
The lot also contains a separate commercial shop used in conjunction with Applicant's
business. Currently there is no second story space in this structure or proposed for the
new structure. An about 180 square-foot addition was constructed onto this commercial
structure without benefit of any permits having been sought from this Board, to provide
office space for the business. Applicant is seeking validation by Special Permit under the
same section stated above for this addition. No other changes are proposed to the
shop/office under this Application. The Locus is nonconforming as to use with the lot
containing a commercial use in a residential zoning district; and as to side and rear yard
setback with the Quonset Hut being sited closer than ten feet from the rear yard lot line
(to be removed from the site), with a shed (to be moved to a conforming location) being
currently sited as close as about 7.4 feet from the easterly side yard lot, and with the
metal building (proposed to be removed from the site) currently sited as close as about
7.9 feet from the southerly rear yard lot line, in a district that requires a minimum side
and rear yard setback of ten feet. The lot is conforming to all other dimensional zoning
requirements.
The Premises is located at 5 RAMOS COURT, Assessor's Map 55, Parcel 213.1,
Plan 56-C, Lot 4. The property is zoned Re~~ \jj ~

Applicant is seeking relief by Special Permit under ~139-33.A to alter and extend a pre-existing non-
conforming use. Similar relief, which has now expired, was granted in File No. 039-00. Applicant proposes
to demolish a "Quonset Hut" and a metal gas storage shed, having a total combined ground cover of about
1323 square feet, and construct a new storage structure, having about 1,360 square feet of ground cover.
All proposed construction will comply with required intensity and parking regulations. In addition to the
buildings proposed to be demolished, there currently exists upon the property a 2580 square foot
storage/shop building (of which about 180 square feet were added in 2003), an 82 square foot lawnmower
shed, and about 730 square feet of outdoor storage, all of which will remain. All structures will be used in
conjunction with applicant's plumbing business. To the extent necessary, applicant requests a Special
Permit to validate the 2003 addition constructed pursuant to Bldg. Permit No. 561-03, for which a
Certificate of Occupancy has issued.
