APpli9ation'Of RICHARD C. AND KARINA AUSTIN, POR THEMSELVES AS OWNERS
AND FO~SALLYANNE AOSTIN, of P.O. Box 193, Nantucket, KA 02554, the
Board'a,ade tl:le following Decision:
1. " Appiicant (Sallyanne Austin) is seeking a SPECIAL PERMIT under
Nantudket~oning By-Law U39-8B(2) (Neighborhood service establishment)
and. tbe subject of BOA File No. 078-98, and a SPECIAL PERMIT under
N"Ptuclce~: ;Z~ing By-Lav A 139-33A (alteration/expansion of a
pre-~xi8tlng nonconforming structure/use) and the subject of BOA File
N<;l' .09-5-98. Applicant propo!>es to convert a 613;t square-foot garage
!>tructure located on the !>Outherly portion of the Lot to use as a
hair/nail salori,with up to three (3) employee!> on site at peak shift.
APplicant viII provide the five (5) required off-street parking space.
on site with the proposed parking area being located to the north Of
the existing single-family dwelling. There will continue to be one (1)
access to the property. In addition and to the extent necessary,
Applicant is also Seeking a SPECIAL PERMIT under Nantucket Zoning
By-Lav 'II39-20C waiVing the loading zone requirements. The structure i.
non-confOrming as to side yard setback with the garage being sited 3.'i
feet at its closest point trom the southerly 8ide yard lot line in a
district that requires a,lIlinimum setback ot ten (10) feet.
The Premises 18 located at 19 SURPSIDP; ROAD, Anessor'. Map 55,
Parcel 265, Plan File 131, Lots 7 and 8, Plan Book 9, Page 8. The
property is zoned Residential-l0.
2. The Decision i. ba.ed upon the Application and the .aterlal.
8ubmitted with it and the testi.ony and evidence presented at the
hearing. The Planning Board.ade a negative reco..endatlon until the,
Applicant be required to'.ub.it an adequate alte plan which the
Applicant Co.plied with at the Nove.bar 4, 1998 .eeting. A letter va.

no letters in opposition or in support of the Application on file. The
direct abutter to the,rear vas present at the earlier hearing. and
expressed concern about the use of a private vay for .cc.... acreening
of the parking area and noise. Her attorney vas present at the October
16. 1998 hear~ng.
3. Applicant proposed to convert the use of the exi.ting garage to
a hair and nail salon and vhile maintaining the aingle-fallily dwelling
upon the Locus as her hOlle. The existing garage door vould be removed.
and a fence placed across the drivevay entrance at that point. as yell
as other changes to the structure to bring it into building code
cOllpliance. There would be no changes to the footprint of that portion
of the garage that is situated within the required ten-foot side yard
setback area in vhich the structure intruded by 6.5 feet at its close.t
point to the southerly side yard lot line. There vould be a lIaximulI of
three (3) employees on site at peak shift. A turn around area vould be
provided to enable vehicles to avoid baCking out onto the bike path
that runs along the front of the structure and no vehicular access
vouldbe allowed onto the private yay to the north knovn as Cobble
Court.
4. Therefore. the Board finds that, ba.ed upon the foregoing, .
grant of relief by Special Perllit to allow the conversion Of 'the garage
into u.e as a h~ir .nd nail salon vould b. in harmony vith the general
purpose and intent of the Zoning By-Lav and wouldtnot be substantially
lIore detrimental to the neighborhood than the existing nonconforming ,
nature of the garage. The Board notes that there would be no further '
intrusion into the side yard setback area and the area was comprised of
.ixed commercial and residential uses. The Board determined that reli.f
by Special Permit to vaive the loading zone requirement was not needed
as it vas not applicable.
5. Accordingly, the Board. by a unanimous vote, GRANTS the
requested relief by SPECIAL PERMIT under Nantucket Zoning By-Lav
1139-8B(2) and 1139-33A to convert the garage structure as proposed,
upon the folloving conditions:
a. The existing vegetation along the property line that
',abuts Cobble Court shall be lIaintain.d and along the rear lot line the
exi.ting v.getatiQn' shall be augmented vith arbor vitae and be
.aintained to provide dense acreening of the parking area frail the
abutter to the rearl
b. There shall be no vehicular entrance into the drivevay in
front of the garage and the entwance' ahall be restricted by a fence
upon conversion 'ofth. garage to the hair and naU .alon/
c. The project shall, be completed in substantial confor.ance
