A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will
be held at 12:00 P.M.. FRIDAY, MARH 10,2006, IN THE CONFERENCE ROOM,
TOWN ANNEX BIDLDING, 37 Washington Street, Nantucket, Massachusetts, on the
Application of the following:

The Applicant (Heiden) is seeking relief by SPECIAL PERMIT under Nantucket
Zoning By-law Section 139-33A (expansion/alteration of a pre-existing nonconforming
structure/use). Applicant proposes to change the use of the existing single-family
dwelling upon the locus to use as a commercial structure that would contain retail store
and office uses with both uses permitted by right without the necessity of zoning relief.
However, as the structure is sited at one comer (a bay window) as close as about 4.75 feet
from the northwesterly side yard lot line in a district that requires a minimum side yard
setback of five feet, any change of use, even to a permitted use would require relief by
special permit. In addition, to the extent necessary, Applicant is also seeking relief by
SPECIAL PERMIT under Section 139-20 from the off-street loading requirements. All
required parking would be provided on site. The Locus/structure is conforming to all
other Zoning By-law dimensional requirements.
The Premises is located at 125 ORANGE STREET, Assessor's Map 55, Parcel
394, Plan .Book19, Page 121, Lot C. The property is zoned Residential-Commercial.
