DECISION:
1. At public hearing of the Nantucket Zoning Board of Appeals, on
Friday, March 10,2006, at 12:00 P.M., in the Conference Room in the Town
Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board
made the following Decision on the application in BOA File No. 023-06 of
WILLIAM M. MOORE, JR., of 2780 Dickerson School Road, Dickerson, MD
20842, in connection with property known as 3 West Chester Street, Nantucket,
Massachusetts.
2. Applicant is seeking relief by SPECIAL PERMIT under Nantucket
Zoning By-law Section 139-33A (alteration/ expansion of a pre-existing
nonconforming structure/use); and to the extent necessary, a VARIANCE from
the provisions of Section 139-16A (Intensity regulations - setbacks). Applicant
proposes to renovate and expand an existing secondary single-family dwelling
by placing a new foundation under it and add a second floor that would raise the
ridge height from about 15 feet to about 22 feet without coming any closer to the
westerly lot line than the existing structure. Portions of the additions to the
cottage would not reduce the scalar separation between the two dwellings any
further but would in part be a vertical extension within the required separation
area. Other work, including additions to the footprint would be done outside of
the required setback areas and would not be in violation of the allowed
maximum ground cover ratio of 50% for this conforming lot and thus would not
need any relief from this Board. The Locus is also nonconforming as to side yard
setback with the primary dwelling being sited as close as about 1.3 feet from the
easterly side yard lot line and the with the cottage being sited as close as about
1.3 feet from the westerly side yard lot line in a district that requires a minimum
side yard setback of five feet; as to the 12-foot scalar separation between the
primary and secondary dwellings with the two structures being attached by
decking. The Locus conforms to all other dimensional requirements of the
Zoning By-law, other than parking, with parking having been waived in the
Decision in BOA File No. 096-93.
The Premises are located at 3 WEST CHESTER STREET, Assessor's Map
42.4.3, Parcel 21, Lot 1 on Plan Book 21, page 48 and the land on Plan Book 12,
Page 5. The property is zoned Residential-aId-Historic.

3. Our Decision is based upon the application and accompanying
materials, representations and testimony received at our public hearings. The
Planning Board made no recommendation finding that the application did not
present any issues of planning concern. No abutter comment was received either
in favor of or against the application and there were no letters on file.
4. Applicant, through counsel, represented that the Locus, consisting
of two lots which when combined for zoning purposes, has about 6,270 square
feet of lot area, conforms to the R-2 dimensional requirements for ground cover,
area and frontage. The two dwellings on the Locus where both built prior to the
1972 enactment of the Nantucket Zoning By-law, and the current Zoning By-law
provisions related to primary and secondary dwelling relationship would not
apply. They are currently sited approximately five feet apart and connected by a
wooden walkway. The Board, by grant of a Special Permit in the Decision in
BOA File No. 096-93 (recorded in Book 434, page 221 at the Nantucket Registry),
permitted the vertical expansion of the larger single-family dwelling which is
situated within the required westerly five-foot side yard setback area at
approximately 1.3 feet from the lot line. The smaller cottage is situated
approximately 1.3 feet from the westerly property line at its closest point and the
proposed project is a renovation of that cottage. The ridge height of the cottage
would increase from about 15 feet to about 22 feet as a second floor is added and
the foundation replaced but would come no closer to the westerly side yard lot
line than the existing structure. No changes are proposed with respect to the
separation of the buildings, but there would be a vertical expansion within the
required 12-foot scalar separation area but would not decrease the distance. A
conforming addition would be constructed on the north side of the cottage and a
conforming porch would be constructed on the west side of the cottage neither of
which, and would not require a grant of relief by this Board. The existing cottage
has a ground cover of approximately 500 square feet, and as proposed, the
ground cover would increase to approximately 585 square feet in full compliance
with the ground cover requirements for the Locus. Applicant represented that
all of the proposed alterations to the cottage have been approved by the Historic
District Commission in Certificate of Appropriateness No. 47,580.
5. Therefore, based upon the foregoing, the Board finds, given the
modest size of the house and the proposed alterations, that the proposed project
would not be substantially more detrimental to the neighborhood than the
existing nonconforming structure. The distance between the two dwellings
would not be decreased and a substantial portion of the work would take place
outside of the required setback areas.
6. In BOA File No. 103-93, the decision for which was integrated into
with the decision in BOA File No. 96-93 recorded in Book 434, page 223 at the
Nantucket Registry, the Board granted a Variance to waive all requirements for
off-street parking on the site. No conforming parking is proposed with this
project, even though some space may be made available for a car to park on-site

off Wyer's Lane. The number of parking spaces that would be required to
support the use of the Locus for two dwellings is not altered by this project. The
Board finds that the existing Variance from 1993 waiving any requirement to
provide conforming off-street parking for either dwelling remains in effect.
7. Accordingly, by a UNANIMOUS vote, the Board of Appeals
GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-33A, to allow the increase in height and expansion of the pre-
existing nonconforming smaller dwelling on the property as proposed, based
upon the following conditions:
(a) The dwelling shall be renovated in substantial conformity with the
plans approved by the Historic District Commission in Certificate
of Appropriateness No. 47,580, as may be amended from time to
time; and
(b) The improvements shall be done in substantial conformity with the
"Proposed Site Plan", done by Nantucket Architecture Group,
dated January 13, 2006, a reduced copy of which is attached hereto
as Exhibit A.

Application of William M. Moore, Jr.

The applicant is seeking a Special Permit pursuant to Section 139-33A, and a
Variance pursuant to Section 139-32 to the extent necessary, to renovate the
smaller of the two single-family dwellings on the site. This cottage is located
within the side yard setback (approximately 1.3 feet from the westerly property
line) and approximately 4 feet from the other dwelling on the site. The proposal
is to construct a new foundation, add a second floor, and make certain other
modifications and additions that are outside of the side yard setback area. The
height of the building will increase from approximately 15 feet height to no more
than 22 feet high. A site plan showing the proposed improvements prepared by
Nantucket Architecture Group and a plot plan of existing conditions prepared by
Charles W. Hart & Associates are attached.
To the extent necessary, modification of the previously granted relief by special
permit and variance, which had been previously granted to permit the
renovation and expansion of the larger dwelling on the site is also requested.
The decision in ZBA File No. 096-03, a copy of which is attached. The locus is a
conforming lot resulting from the merger of two undersized lots.

following Decision: '
1. The Applicants are seeking relief (in Case No. 096-93)
by special permit or finding under Nantucket zoninCJ By-law
Section 139-33.A, to allow the elteration of an existing
single-family ~esidential st~ucture, nonconforming as to rear
"yard setback (5 feet are required: actual setback is 1.3 feet).
by demolishing a single-sto~y portion of the structure which
'intrudes into this rear setback area and by reconstructing it,
vith a second story, within the existing footprint. In addition,
in Case No. 103-93, the Applicants seek va~iance relief from the
off-street parking requirements of Section 139-18.A(1), which
vould require the provision of tvo ~ff-st~eet parking apaces, one
for each of the tll,O dwellings upon the subject property, by
reason of the enlargement of the principal ollelling., The subject
p~operty {the "LOCUS') is ,situat.ed at 3 West Chester st.reet.,

2. This 'Oecision is based upon the applications and
matters submitted vith them, and the evidence presented at. t.he
pub~ic hearing. 'Tvo, letters in support of t.ne applicants'
,requests lIere received, and t.here vas no opposition. The
Planning Board made no recommendat.ion on ei~h.r application.
3. , We find that the buildings upo~ t.he LocUS pre-elist the
Zoning By-law. Because the' alteration of the principal dwelling
."ill involve lIorlt being done, including raising the height of' the
building, ."ithin the rear yard setback area, ."e find that this
v.ork ."ill intensift the zoning nonconformitiu upC?n the LoCUS,
even ~hough the footprint vill not be expanded. Hovever, lie find
that the' proposed alteration and enlargement within the elisting
footprint will not be substantially more 'detri=ent.al to the
neiqhbOl:hOod than the existing nonconforminq condition, and, by
