NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will
be held at 1:00 P.M., FRIDAY, APRIL 7,2006, IN THE CONFERENCE ROOM,
TOWN ANNEX BUILDING, 37 Washington Street, Nantucket, Massachusetts, on the
Application of the following:
PETER H. TULLOCH AND VlGINIA C. TULLOCH, TRUSTEES OF FIVE
VILLAGE WAY NOMINEE TRUST
BOARD OF APPEALS FILE NO. 035-06
Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-33A (alteration/expansion of a pre-existing/nonconforming
structure/use). Applicants propose to renovate the existing single-family dwelling by
constructing an about 1,100 square-foot second-floor addition within the existing
footprint and without coming any closer to westerly side yard lot line than the existing
structure. The existing ridge height of the one-story portion of the dwelling would be
increased to about 25 feet. A new foundation would also be constructed under the entire
dwelling. There would be other alterations of the structure outside of the required setback
areas and would not need relief from this Board. The locus is nonconforming as to lot
size with the lot containing an area of about 47,282 square feet (Lot 4), in a district that
requires a minimum lot size of 120,000 square feet; as to frontage, with the lot having
about 169.34 feet of frontage along a "Way" in a district that requires a minimum
frontage of 200 feet; as to ground cover with the lot (Lot 4) containing a ground cover
ratio of about 4.71 % ( about 2,225 square feet) in a district that allows a maximum
ground cover of3% or 1,500 square feet for undersized lots, whichever is greater; and as
to setback, with the structure being sited as close as about three feet from the westerly
side yard lot line in a district that allows a minimum side yard setback for subminimum
lots of ten feet.
The Premises is located at 5 VILLAGE WAY, Assessor's Map 14, Parcels 3 and
47, Lot 4 on Land Court Plan 16220-A. The property is zoned Limited-Use-General-3.

ADDENDUM
Peter H. Tulloch and Virginia C. Tulloch, Co-Trustees of Five Village Way Nominee
Trust (the "Applicant"), seek a Special Permit pursuant to Section 139-33A( 4) of the Nantucket
Zoning By-Law for their property at 5 Village Way (the "Property"). The Applicant proposes to
renovate the existing single family dwelling on the Property and build aI, 1 00 square foot
addition to the existing dwelling. The proposed renovation and addition will increase the height
on a portion of the dwelling from a single story to approximately twenty-five (25) feet, pursuant
to the Certificate of Appropriateness No. 47665 issued by the Nantucket Historic District
Commission on February 14, 2006 (copy attached as Exhibit 1). The Applicant will also install a
new foundation within the footprint of the existing dwelling and will also reconfigure the
driveway on the Property in the approximate location and with the approximate shape as shown
on the Plan attached as Exhibit 2.
The subject property is located in the Limited Use General- 3 (LUG-3) Zoning District.
A Certificate of Occupancy was issued by the Nantucket Building Department for the single
family dwelling on the Property on July 18, 1978. At the time the Certificate of Occupancy was
issued for the dwelling in 1978, the LUG-3 Zoning District did not have a rear or side yard
setback requirement. Subsequently, the intensity regulations of the LUG-3 Zoning District were
amended to create a rear and side yard setback requirement of ten (10) feet. Accordingly, the
dwelling on the Property is considered pre-existing, non-conforming as to location. The attached
As-Built Plot Plan dated January 5, 2005 and prepared by Nantucket Surveyors, Inc., marked as
Exhibit 3, shows that the existing dwelling on the Property is located as close as three (3) feet
from the westerly lot line and within the required ten (10) foot side yard setback.
There are wetlands on the Property near the existing dwelling. The Applicant recently is
preparing a wetlands survey of the Property. The Applicant will file a Notice of Intent for the
proposed work with the Nantucket Conservation Commission concurrently with this Application
for Special Permit Relief.
Granting the proposed Special Permit will not be substantially more detrimental to the
neighborhood than the existing, non-conforming dwelling on the Property. The proposed
renovation and 1,100 square foot addition to the existing dwelling is moderate in size and will
increase the height of a portion of the dwelling from a single story to approximately twenty-five
(25) feet. The renovated dwelling will be in harmony with other houses on Village Way. Also,
by granting the requested Special Permit, the Board would be acting in a manner consistent with
the spirit and intent of the Zoning By-Law.
Accordingly, the Applicant respectfully requests the Board to grant the requested Special
Permit.
