DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, August 11, 2006, at 1:00 P.M., in the
Conference Room, 2 Fairgrounds Road, Nantucket, Massachusetts,
the Board made the following decision on the application of
LOUISB MacDOUGALL, as Trustee of MacDOUGALL LIVING TRUST, c/o
Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669,
Nantucket, Massachusetts 02584, File No. 066-06:
2. The Applicant is seeking relief by SPECIAL PERMIT under
Nantucket Zoning By-law ~139-16.C(1), to reduce the required side
yard setback from ten feet to five feet, in order to validate the
siting of an addition that was constructed in 2005 onto the
northerly side of an existing single-family dwelling. The new
addition, about 9' x 9.5', is sited as close as about 9.0 feet
from the northerly side yard lot line. The locus is nonconforming
as to lot area, containing about 9,106 square feet, with the
minimum lot area in this zoning district being 20,000 square
feet. The locus and structures thereon are otherwise conforming
to the dimensional requirements of the By-law. The locus is
situated at 9 BAYBERRY LANE, SIASCONSBT, Land Court Plan 32527-B,
Lot 3, is shown on Assessor's Map 49 as Parcel 184, and is in a
Sconset Residential-2 zoning district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matter of planning concern
was presented. The owner of the immediately abutting property to
the north of the locus at 91 Sankaty Road, appeared at the public
hearing and spoke in favor of the granting of relief. One letter
in support of the application was also received; no opposition
was received, in person, through representatives, or in writing.
4. As presented by the Applicant, through counsel, the one-
story addition consists of a new bathroom added to the northerly
side of Applicant's dwelling. The architectural plans prepared
by the Applicant himself and included with the building permit
application materials submitted to the Building Department
indicated that the intended setback on the northerly side of the
structure was to be ten feet. However, Building Permit
Application No. 93-05 (the "Permit") also incorrectly indicated

that the northerly setback was to be 18 feet after completion of
the proj ect. The Historic District Commission ("HDC") approved
plans (Certificate of Appropriateness No. 45,205) indicated that
the addition was to be 9' x 9.5' in size, which would result in a
noncomplying setback of nine feet from the northerly side yard
lot line rather than the intended ten feet. Also included with
the HDC approved plans was a site plan dated August 1, 19871 done
by Charles W. Hart, registered land surveyor, which stated that
the northerly side yard setback of the dwelling was 18 feet. This
inconsistency was overlooked throughout the permit process and
the Applicant received the Permit. Applicant constructed the
addition as proposed under the duly issued Permit and received a
"sign-off" from the HDC to validate that the addition was
constructed per the plans approved. It was not until the
Applicant sought the Certificate of Occupancy and a new "Building
Location Plan", dated July 13, 2006 and done by the
aforementioned surveyor, a reduced copy of which is attached
hereto as Exhibit A, that the error was brought to light.
5. Applicant stated that under Zoning By-law S139-16.C(I),
the Board of Appeals is empowered to grant relief by Special
Permit to reduce the side or rear yard setback in the
Residential-2 (including SR-2) zoning district from ten feet to
five feet. No specific standard for the grant of this relief is
contained in the Zoning By-law, and therefore the general special
permit criterion that the relief is in harmony with the general
purpose and intent of the Zoning By-law is applicable. In this
instance, it is apparent that there would be little benefit from
the removal of the structure's minimal encroachment upon the ten-
foot side yard setback area, and the immediate abutter, who is
the owner most affected by the placement of the addition, spoke
strongly in favor of the application.
6. Accordingly, by UNANIMOUS vote, the Board of Appeals
made the finding that the reduction in the northerly side yard
setback area from ten feet to nine feet, only to the extent
necessary to validate the siting of the existing structure, would
be in harmony with the general purpose and intent of the Zoning
By-law, and would not be substantially more detrimental to the
neighborhood, and by the same UNANIMOUS vote GRANTED the
requested relief by SPECIAL PERMIT under Zoning By-law ~139-
16.C(l), reducing the minimum required ten-foot northerly side
yard setback to nine feet, to validate the siting of the existing
structure only, based upon the following conditions:
a. The siting of the structure shall be substantially as
shown upon the Exhibit A plan; and
b. No further construction may take place closer than
ten feet from the northerly side lot line without
further relief from the Board of Appeals.
