At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, July 14, 2006, at 1:00 P.M., in the Conference Room, at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of FREDERICK N. LBVINGBR, as Trustee of LEVINGER FAMILY REALTY TROST, c/o Reade, GUllicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 060-06: 2. The Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law ~139-18.B(1) (Parking requirements - off- site). The Applicant proposes to construct a conforming single- family dwelling upon the locus, a vacant lot, not requiring any zoning relief. However, the Applicant seeks relief in order to si te the one required parking space upon the adj acent lot (5 Lincoln Avenue, Lot 2, Land Court Plan 14438-B), immediately abutting the locus to the southeast, by permanent easement. The locus is situated at 7 Lincoln Avenue, Land Court Plan 14438-B, Lot 1, is shown upon Nantucket Assessor's Map 30 .as Parcel 139.1, and is situated in a Residential-1 zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matter of planning concern was presented. Except for the presentation by the applicant's representative, there was no support or opposition presented at the public hearing. 4. As presented by the Applicant's representative, the Applicant proposes to place the required parking space for the dwelling to be constructed upon the locus upon the adj acent property, by permanent easement, as described above and as shown upon the "Plot Plan", done by Emack Surveying dated June 16, 2006, a reduced copy of which is attached hereto as Exhibit A. The locus fronts upon two streets, Cobblestone Hill (formerly known as Beach Street), and Lincoln Avenue. The Applicant argued that because of the slope, layout width and proximity of Cobblestone Hill, it would be difficult to have direct access from that street and contrary to public safety to have a driveway access from the locus onto Lincoln Avenue that close to the 1 intersection with Cobblestone Hill. While it would be feasible to place a driveway access on Lincoln Avenue, it would necessitate backing into Lincoln Avenue. This intersection presents challenges to drivers approaching it because of the grade of Cobblestone Hill and poor sight lines. 5. Based upon the foregoing presentation, the Board of Appeals, by UNANIMOUS vote, made the finding that practical difficulties prevented locating the required off-street parking space upon the locus, and by the same UNANIMOUS vote GRANTED relief by SPECIAL PERMIT to allow the use of off-site premises (5 Lincoln Avenue, Lot 2, Land Court Plan 14438-B) for provision of the required parking space by permanent easement, subject to the following condition: . a.
