DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, July 14, 2006, at 1:00 P.M., in the
Conference Room, 2 Fairgrounds Road, Nantucket, Massachusetts,
the Board made the following decision on the application of
REBECC~I M. ODEGAARD and J. EDWARD ODBGAARD (the "Applicants"),
joined in by the TOWN OF NANTUCKET (the "Town"), as owner of a
part of the land which is the subject of this application, c/o
Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669,
Nantucket, Massachusetts 02584, File No. 059-06:
2. The Applicants (Odegaard) are seeking relief by SPECIAL
PERMIT under Nantucket Zoning By-law §139-33.A(8) (change in
configuration of a pre-existing, nonconforming lot). The
Applicants propose to acquire two vacant parcels of land,
adjacent to the Applicants' existing parcels, from the Town, and
merge the parcels to be acquired from the Town with the
Applicants' existing parcels, to create a single merged lot for
zoning and building purposes. The Town has awarded the right to
purchase the parcels now owned by the Town to the Applicants
through the Town-sponsored "Nantucket Yard Sale" program. The
Applicants' parcels consist of a lot containing about 8,000
square feet, known as 7 Maine Avenue, consisting of Lots 3, 4, 5
and 6 on Land Court Plan 2408-M, which is now improved with a
shed and does not contain a dwelling unit, and a lot containing
about 3,990 square feet, known as 9 Maine Avenue, consisting of
Lots 14 and 15 on Plan 2408-M, which is improved with a single-
family dwelling. The Town's vacant parcels consist of a lot
containing about 3,132 square feet, known as 5 Maine Avenue,
consisting of Lots 12 and 13 on Plan 2408-M, and a lot containing
about 3,955 square feet, known as 4 New Hampshire Avenue,
consisting of Lots 7 and 8 on Plan 2408-M. The combined area of
the merged lots would be abaut 19,077 Square feet, with the
minimum lot area in this Residential-2 zoning district being
20,000 square feet. The Applicants' two existing lots are
contiguous to each other at only a single point and do not share
a lot line, and accordingly have not merged under applicable law.
The dwelling upon the Applicants' lot at 9 Maine Avenue is

Yee ~es~ than that now applicable to the Applicants' two existing
unmerged lots, if added together. The 9 Maine Avenue lot,
containing about 3F990 square feet of lot area, is entitled to
have a maximum 30% ground cover ratio, as applicable to lots
containing less than 5,000 square feet, or 1,197 square feet;
while the 7 Maine Avenue lot, containing about 8,000 square feet,
is entitled to have up to 1,500 square feet of ground cover;
thus, the total available ground cover is 2,697 square feet. The
merged property, including the Town property, would be entitled
to 12.5 ground cover, or 2,384 square feet.
5. Accordingly, by UNANIMOUS vote, the Board of Appeals
made the finding that the proposed change in boundaries would not
be substantially more detrimental to the neighborhood than the
existing nonconformity, and that no new nonconformity would be
created nor any existing nonconformity increased; and in fact,
certain existing nonconformities would be eliminated by the
merger. By the same UNANIMOUS vote, the Board GRANTED the
requested relief by SPECIAL PERMIT under Nantucket Zoning By-law
X139-33.A{8), to allow the reconfiguration and merger of the
subject lots as proposed, based upon the following conditions:
a. The resulting merged lot shall be substantially
as shown upon the ~~Plot Plan to Accompany
Application for Special Permit", done by Nantucket
Surveyors, LLC, dated May 19, 2006, a reduced copy
of which is attached hereto as Exhibit A; and
b. The merged Locus shall be considered one building
lot for zoning purposes.

Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-33A(8) (configuration change to apre-existing, non-conforming lots).
Applicants (Odegaard) propose to acquire two adjacent vacant parcels of land (shown on
Assessor's Map 60.3.1, Parcels 423 and 418, Lots 12, 13, 7 and 8 on Land Court Plan
2408-M), located to the east and south of Applicants' lots, from the Town of Nantucket.
The Town awarded right to purchase the Town-owned parcels to the Applicants through
the Town-sponsored "Nantucket Yard Sale" program and the Applicants propose to
combine the Town-owned parcels with their present lots to create a single merged lot for
zoning purposes. Applicants' lots contain about 8,000 square feet (7 Maine Avenue) and
about 3,990 square feet (9 Maine Avenue) of area and the Town owned lots currently
contain about 3,132 square feet (5 Maine Avenue) and about 3,955 square feet (4 New
Hampshire Avenue). The combined lot area of the merged lot would be about 19,077
square feet in a district that requires a minimum lot size of 20,000 square feet.
Applicants' present lot at 9 Maine Avenue is improved with asingle-family dwelling that
is currently nonconforming as to the front yard setback requirement being sited as close
as about 12.3 feet from the lot line along Maine Avenue in a district that requires a
minimum setback of 30 feet; and as to side yard setback with the dwelling being sited as
close as about six feet from the westerly lot line in a district that requires a minimum side
yard setback often feet. The merger would not increase the nonconformity of the
dwelling and the only remaining nonconformities would be related to lot size and side
yard setback. Applicants' present lot at 7 Maine Avenue does not share a lot line with 9
Maine Avenue and these parcels are treated as separate lots at the moment, but would
both be included in the merger when the Town owned lots are added to Applicants' lots
to create a single lot as set forth above. Applicants' 9 Maine Avenue is nonconforming as
to use with a shed sited on the lot without being ancillary to a residence on the same lot.
This nonconformity would be eliminated with the merger.

ADDENDUM TO APPLICATION
OF
REBECCA M. ODEGAARD AND J. EDWARD ODEGAARD
The applicants have entered into an agreement with the Town of
Nantucket under the so-called "Yard Sale" program to acquire two
Town-owned parcels, abutting the applicants' parcels, to be
merged with the applicants' property as a single lot for
building and zoning purposes. The applicants at present own 7
Maine Avenue, containing about 8,000 square feet of lot area,
and 9 Maine Avenue, containing about 3,990 square feet of lot
area; minimum lot area in this Residential-2 zoning district is
20,000 square feet. 9 Maine Avenue is a lot of record, improved
with a pre-existing single-family dwelling; 7 Maine Avenue is
also a lot of record, improved with a pre-existing shed (and,
having no dwelling upon it, is nonconforming as to use). 7
Maine Avenue and 9 Maine Avenue touch only at a point, and
accordingly are separate lots and have not merged with each
other. The vacant parcels owned by the Town consist of 5 Maine
Avenue, containing about 3,132 square feet, and 4 New Hampshire
Avenue, containing about 3,955 square feet. The result of
merging the applicants' parcels and the present Town parcels
together as a single lot in the applicants' ownership will be
that the total lot area will be about 19,077 square feet, so
that the lot area of the merged lot will be nonconforming, but
less nonconforming than either of the applicants' parcels at the
present time. Furthermore, the effect of~the merger will be to
eliminate the use nonconformity of 7 Maine Avenue, and to
eliminate the existing front yard setback nonconformity of 9
Maine Avenue, the dwelling thereon now being sited about 12.3
feet from Maine Avenue, and with 30 feet front yard setback
required. Front yard setback for the merged parcel will be
measured from New Hampshire Avenue, and will be conforming.
After the merger, the only remaining nonconformities will be lot
area, as set forth above, and northwesterly side yard setback of
the existing dwelling, which is sited about 6 feet from the lot
line along New Jersey Avenue.
Accordingly, the applicants request relief by Special Permit
under Nantucket Zoning By-law §139-33.A(8), to change the
boundaries of their existing nonconforming lots of record by
merging them and the present Town parcels together as a single
lot upon their proposed acquisition of the Town parcels, without
creating any new nonconformity nor increasing any existing
nonconformity.
