At a public hearing of the Nantucket Zoning Board of Appeals, held on Friday, July 14, 2006, at 1:00 P.M., in the Conference Room at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the Application in BOA File No. 055-06 of DAVID B. POOR AND PATRICIA M. BEILMAN, of 25 West 94th Street, New York, NY 10025, in connection with property known as 5 Lauretta Lane (portion) and 7 Lauretta Lane, Nantucket, Massachusetts. 2. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law Section 139-33A (alteration/ expansion of a pre- existing/nonconforming structure/use). Applicants propose to renovate the existing single-family dwelling with most alterations taking place outside of the required setback areas and within the maximum ground cover allowed and thus not needing relief for those aspects of the project. However, as part of said renovation, Applicants would construct a second floor dormer on the easterly portion of the structure that would lie partially within the required 20-foot side ~____~ yard setback area. There would be no expansion of the footprint within the s~tback area and the new dormer would be contained within the existing footprint of the structure, which is sited as close as about 9.6 feet from the easterly side yard lot line. The lot is conforming to all other dimensional requirements. The lot is benefited by a previous grant of Variance relief (BOA File No. 038-78) due to a ground cover issue, which has since been rectified with the purchase of an abutting parcel to render the lot conforming as to size and ground cover. The Premises is located at 5 LAURETTA LANE (PORTION) AND 7 LAURETTA LANE, Assessor's Map 14, Parcels 53 and 54, Land Court Plan 1622O-W, Lot 64 and Land Court Plan 16620-A,Lot 20, respectively. The property is zoned Limited-Use-General-3. 3. Our Decision is based upon the application and accompanying materials, representations and testimony received at our public hearings. The Planning Board made no recommendation finding that the application did not present any issues of planning concern. No abutter comment was received either in favor of or against the application and there were no letters on file. ~ 4. Applicants, through counsel, represented that the dwelling to which the improvements are planned (known as 7 Lauretta Lane) had been constructed pursuant to a Variance issued by the Board of Appeals in the Decision in BOA File No. 038-78, which allowed that Applicant to exceed the permitted ground cover ratio on the parcel, then shown as Lot 20 on Land Court Plan No. 16220-A. Applicants acquired the land and improvements known as 5 Lauretta Lane, then shown as Lot 5 on Land Court Plan No. 1622O-A. In 2002, Applicant subdivided 5 Lauretta Lane into two parcels, the northern most of which is shown as Lot 64 on Land Court Plan No. 16220-W, and then filed a further subdivision plan which merged Lot 64 and Lot 20 to create a single lot, conforming in size to the current zoning requirements which lot is shown as Lot 65 on Land Court Plan No. 16220-X. At the time of the subdivision, the Planning Board also approved the creation of the new, conforming parcel with two existing dwelling units and found that the two driveways that service those dwellings are permitted pursuant to Section 139-20.1(i) of the Zoning Code. The only remaining nonconformity of the property is therefore the siting of a portion of the house within the required 20-foot easterly side yard setback area. The subdivisions of the properties did not affect the nonconformity. 5. Applicants now propose to renovate the structure by removing the garage and making modifications to the house, including a dormer that would be constructed within that portion of the structure that lies within the required easterly 20-foot side yard setback area As a result, the mass of the building would increase within said setback but the structure would come no closer to that lot line than the existing structure. No change in the height of the ridge of the structure is proposed. Additional accessory structures may be constructed by the Applicants, but all would conform to current zoning requirements and would not need relief from this Board. Applicants represented that all of the proposed alterations to the house have been approved by the Historic District Commission in Certificate of Appropriateness No. 48,710. 5. Therefore, based upon the foregoing, the Board finds, given the modest impact of the proposed alteration by adding a dormer to that portion of the dwelling that is situated within the required side yard setback area, that though there would be an increase in the massing with the required setback area, the proposed project would not be substantially more detrimental to the neighborhood than the existing nonconforming structure. 7. Accordingly, by a UNANIMOUS vote, the Board of Appeals GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By- law Section 139-33A, to allow the increase in mass of the structure within the setback thereby expanding the pre-existing nonconforming dwelling on the property as proposed, based upon the following condition: 2 Dated: August a. Poor and Patricia M. Beilman 7 Lauretta Lane, Nantucket The applicants request a Special Permit pursuant to Section 139-33 to add a dormer to a portion of their existing home that lies within the side yard setback, as show on the attached copy of a portion of the Botticelli & Pohl plans for the project. No increase in the ridge height of the building is proposed, but the new dormer will increase the mass of the building within the 20 foot required setback. When constructed the house and the garage complied with the then applicable setback requirements, but exceeded the maximum ground cover ratio for which a variance (038-78) was granted. The applicants have combined the grandfathered undersized lot referred to in the 1978 decision with sufficient adjacent land to create a compliant lot that meets the minimum lot size and ground cover requirements. '1\ l\'fll 'i <& .O;Jf\(JttCIJItJ. .~ -i. ,: . ~ . . .tt ' ~ ::2. . ,( ~ .~ i :2- BOARD OF APPEALS Nantucket, Massachusetts DECISION: At a regular meeting of the Board of Appeals held December 19, 1978, at the Town Building, in the matter 0 the petition of WILLIAH YARHY (038-78), after due deliberation, the Board found: 1. The petitioner owns a one-acre lot in Pocomo in a district zoned LUG-3 requiring 120,000 square feet. Under the by-law, he could construct a house of 1,429 square feet, but requests a variance to construct a house of 2,784 square feet on Lot 20, Land Court Plan No. 16220-A. Of this area, the house itself will cover 1,684 square feet and the balance will be garage space. The area is sparsely populated and the petitioner's lot is in an area dedicated to open-space preservation. 2. The petitioner has owned this land since 1974, has recently sold his previous home and desires to construct a suitable residence for his family. He has encountered a hardship since the configuration of his lot in this area would dictate an unusually small house under the allowable ground cover ratio. The policy of the Board favoring construction of garages in area such as this, the actual extent of the dwelling are~is not detrimental to the neighborhood. Therefore, a literal enforcement of the by-law would involve substantial hardship. 3. Relief may be granted without substantive detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the by-law. 4.
