At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, March 10,2006, at 12:00 P.M., in the Conference Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of TOWN OF NANTUCKET AND THE NANTUCKET PUBLIC SCHOOLS, c/o Jack McFarland, 10 Surfside Road, Nantucket, Massachusetts 02554, File No. 050-06: 2. Applicant, the Nantucket Public Schools, is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law Section 139-16C(1). Applicant is seeking relief in order to validate the nonconforming siting of a maintenance garage/workshop building located on the southerly portion of the parcel that also contains the Nantucket High School and Cyrus Pierce Middle School complex and a portion of the parking lot for the schools. The original eastern end of the shop was constructed in the 1950's. In 1979 the western portion of the shop was constructed pursuant to a validly issued building permit. A recent survey indicated that a small triangular portion of the structure is actually sited as close as about 7.66 feet from the southerly side yard lot line in a district that allows a minimum side yard setback of ten feet. Applicant is asking to reduce the side yard setback distance to the extent necessary to validate the structure. Applicant also proposes to demolish a small conforming easterly portion of the structure and construct a new addition onto the eastern end of the building in order to increase the maintenance and shop space. The new addition would be conforming in all respects to the setback and ground cover requirements. The Premises is located at 10 SURFSIDE ROAD, Assessor's Map 55, Parcel 137, Plan Book 9, Page 43. The property is zoned Residential-lO. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation. Except for the presentation by the Applicant's representatives, there was no support or opposition presented at the public hearing. 4. As presented by the Applicant's representatives, the Applicant was in the process of constructing a new conforming addition onto the easterly side of a maintenance shed located on the southerly side of the property that contains the Nantucket High School and Cyrus Pierce Middle School. The original now center portion of the shop was constructed in the 1950's and is clearly visible on the 1957 aerial in the Town of Nantucket records. In 1979 the western portion of the shop was constructed pursuant to a validly issued building permit. Upon a file review there was no evidence that there was a certificate of occupancy ever issued at that time. It was not 1 common practice at that time for the Building Department to require the submission of an "as- built" surveyed plot plan. It was evidently assumed that the structure was complying with the ten-foot setback requirements for the Residential-2 zoning district within which the property is situated and a new building permit was issued for the easterly addition and work begun. A recent survey was done after construction started related to the application for the new building permit to construct said addition onto the eastern end of the building in order to increase the much needed maintenance shop space. The new addition would be conforming in all respects to the setback and ground cover requirements. As a result of the survey, it was found that the 1979 addition was actually sited as close as about 7.7 feet at the southwesterly corner of the structure with a majority of the structure being sited outside the required ten-foot setback area. About 19 square feet of structure is sited within the required setback area. Though the siting of the structure is arguably protected under the curative statute of Chapter 40A Section 6 at a minimum, or under Section 7 with ten years being the minimum time to have elapsed since construction, as the addition was constructed pursuant to a duly issued building permit, and has existed without enforcement action having been brought for a time in excess of six years, Applicant wishes to rectify the situation by a grant of Special Permit relief to validate only so much of the structure that is sited within the required setback area by reducing said setback area to about 7.7 feet and allowing the construction of the new conforming addition. 5. Therefore, based upon the foregoing, the Board finds that the construction of the new conforming addition on the easterly side of the existing maintenance shed would have no impact on the neighborhood and would be in harmony with the general purpose and intent of the Zoning By-law and would not be substantially more detrimental to the neighborhood than the existing nonconformity. In addition, the Board finds that the intrusion into the setback area of one corner of the 1979 addition by about 2.3 feet, with the majority of the structure located outside the required ten-foot setback area, was de minimis; and that there would be no benefit to be achieved by the correction of the intrusion, particularly since no opposition was received from the abutter to the south and relief could be granted in harmony with the general purpose and intent of the Zoning By-law. The situation had existed without comment or change since 1979 and at the time the building permit was issued the setback distance was in the process of changing to ten feet causing confusion. As no certificate of occupancy was issued, the addition remained noncomplying rather than nonconforming without validation herein granted. 6. Accordingly, by a UNANIMOUS vote, the Board of Appeals GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-law S 139-16.C( 1), to reduce the southerly side yard setback distance from ten feet to about 7.7 feet to validate the siting of the existing maintenance shed and allow the proposed conforming addition on the easterly side, subject to the following conditions: (a) The siting of the structure and new addition shall be done in substantial conformance with the "Site Plan", done by Jeffrey L. Blackwell, registered land surveyor, dated Mary 23, 2006, a reduced copy of which is attached hereto as Exhibit A; (b) No further building shall be performed within the required ten-foot side yard setback area without further relief from this Board; and 2 ( c) The new addition shall be done in substantial conformance with Certificate of Appropriateness No. 44,663 issued by the Nantucket Historic District Commission, as may be amen d from time to time.
