NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will
be held at 1:00 P.M., FRIDAY, JUNE 9, 2006, IN THE CONFERENCE ROOM,
TOWN ANNEX BUILDING, 37 Washington Street, Nantucket, Massachusetts, on the
Application of the following:

Applicant is seeking reliefby VARIANCE pursuant to Nantucket Zoning By-law
Section 139-16A (Intensity regulations - ground cover) in order to validate the existing
ground cover of a single-family dwelling. The lot contains about 2,365 square feet of
ground cover in a district that allows a maximum of2,175 for this undersized lot.
Applicant purchased the property with the house under construction pursuant to validly
issued Building Permit No. 904-04 (the "Permit"), and which indicated that the structure
was to have a ground cover of 1,602 square feet. Applicant amended the Permit to
construct an additional 573 square feet of ground cover for a total of2,175 square feet.
When the project was completed and an "as-built" was done, it was found that the ground
cover exceeded the allowable by about 190 square feet. The locus is also nonconforming
as to lot size with the lot containing about 72,522 square feet of area in a district that
requires a minimum lot size of 120,000 square feet. In all other respects the lot is
conforming.
The Premises is located at 22 WIGWAM ROAD, Assessor's Map 77, Parcel 7.9,
Land Court Plan 5504-50, Lot 803. The property is zoned Limited-Use-General-3.

I purchased property from Carolyn Lazor in June of 2005. At the time of the
purchase, the house was under construction, and the existing Building Permit
(904-04) was assigned to Applicant. This Building Permit called for 1,602 square
feet of ground cover, and the total ground cover allowed on this lot was 2,175
square feet. I assumed that I had an additional 573 square feet of allowable
ground cover, and I amended my plans accordingly. I received approval from the
HOC for an addition containing 572 square feet (H.D.C. Certificate No. 46,819),
and I constructed the addition in accordance with these plans. When the as-built
was prepared, I was informed that the completed structure had a total ground
cover of 2,365 square feet which is 190:1: square feet in excess of which is
allowed. I should not have assumed that the building under construction was
built in accordance with the plans, but I made that assumption and it resulted in
this violation.
Applicant requests a variance pursuant to Chapter 139 -16A to validate the
