At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, June 9, 2006, at 1:00 P.M., in the Conference Room in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Nantucket Zoning Board of Appeals made the following Decision on the Application (044-06) of PAUL R. SKLAREW and BARBARA B. SKLAREW, of 244 Willow Street, Yarmouthport, Massachusetts 02675, and the TOWN OF NANTUCKET, of 16 Broad Street, Nantucket, Massachusetts 02554, in connection with two (2) parcels ofland known as 12 and 14 Maine Avenue, Nantucket, Massachusetts. 2. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By- law Section 139-33A(8) (configuration change to a pre-existing non-conforming lot). Applicants (Sklarew) propose to acquire from the Town of Nantucket one (1) adjacent vacant parcel ofland (shown on Assessor's Map 60.3.1, Parcels 431 and 432) located to the northwest of the . Applicants lot (shown on Assessor's Map 60.3.1, Parcel 463). The Town awarded the parcel to the Applicants through the Town sponsored "Nantucket Yard Sale" program and the Applicants propose to combine the Town lot with the Applicants lot. The Applicants lot and the Town owned lot each currently contain about 4,00Oi: square feet of area, and the two (2) parcels combined would contain about 8,00Oi: square feet of area in a district that requires a minimum lot size of20,000 square feet. Applicants' lot is improved with a single-family dwelling and detached shed structme. The newly created lot would be less nonconforming but would continue to be nonconforming as to the minimum lot size requirement. In addition to the above noted nonconformities, the Applicants property is nonconforming as to ground cover as the structures (dwelling and shed) constitute an approximately 17.5% ground cover ratio, in excess of the maximum allowed of 12.5%; and as to setbacks, with the shed structme sited within the required thirty-foot front yard setback area and within the required ten-foot easterly side yard setback area, and with the dwelling being sited within the easterly and westerly side yard setback areas and as close as zero (0) from the northerly rear yard setback lot line. Said nonconforming ground cover ratio, rear yard setback violation and front yard setback violation would be eliminated with the merger of the two (2) lots for zoning purposes. Neither lot meets the 75-foot minimum frontage requirement with both lots having approximately fifty (50) feet of frontage along their respective roads. Applicants are also seeking reliefby SPECIAL PERMIT under Nantucket Zoning By-law Section 139-16C(l) to validate the siting of the existing structures on the lot by reducing the side yard setback distances from ten (10) feet to five (5) feet as part of the merger of the two (2) parcels. The Applicants property is located at 14 MAINE AVENUE (WITH ACTUAL FRONTAGE ON CALIFORNIA AVENUE), MADAKET, Assessor's Map 60.3.1, Parcel 463, Land Court Plan 2408-M, Block 34, Lots 43 and 44, (hereinafter Applicants property is referred to as the "Locus"). The Town of Nantucket property is located at 12 MAINE AVENUE, MADAKET, Assessor's Map 60.3.1, Parcels 431 and 432, Land Court Plan 2408-M, Block 34, Lots 5 and 6. The properties are located in the Residential-2 (R-2) Zoning District. 3. The Decision of the Board is based upon the Application and accompanying materials, representations and testimony received at the public hearing. The Planning Board made no recommendation as there was no Planning Board meeting that was held in a timely manner to render a recommendation. Other than the presentation by the Applicants counsel, there was no comment at the public hearing from abutters and the Board received no letters regarding the requested relief. 4. Applicants, through counsel, stated that they purchased the Locus in 1998, which was improved with a nonconforming single-family dwelling and shed constructed in calendar year 1967 as estimated by the records in the Town of Nantucket Assessor's Office. Applicants, through counsel, provided the Board with an Affidavit attesting to the existence of the dwelling and shed on said Locus from a time prior to the 1972 enactment of the Nantucket Zoning By- laws and thus were "grandfathered" as to the nonconformities of the structures and lot. Applicants propose to purchase one (1) adjacent parcel of vacant land from the Town of Nantucket. Applicants were awarded said parcel as part of the "Nantucket Yard Sale" program, in which Town owned undersized vacant parcels ofland are conveyed to qualified abutters provided the abutters obtain special permit relief pursuant to Nantucket Zoning By-law Section 139-33A(8), where applicable. The Town of Nantucket, as owner of the adjacent parcel of land, has joined in this Application for relief and submitted a letter into the file supporting the relief requested by Applicants. 5. Applicants, through counsel, stated that the total lot area of the combined parcels (Locus and Town lot) would be approximately 8,000 square feet. Because the Locus and adjacent vacant parcel are nonconforming as to the area requirements of the Zoning By-law, once purchased by the Applicants and held in common ownership, the parcels would automatically merge together as one (1) single lot for zoning purposes with a perimeter plan and application to the Land Court necessary to complete the process. While the resulting merged parcels would have a total new lot area of approximately 8,000 square feet, the lot size would still not conform to the 20,000 square-foot minimum required in the R-2 district, but would be less nonconforming and would not increase existing nonconformities or create new nonconformities. Under Nantucket Zoning By-law Section 139-33A(8), the change in lot lines of a pre-existing nonconforming lot, and Nantucket Zoning By-law Section 139-16C(I), validating the siting of the existing structures on the lot by reducing the side yard setback distance from ten (10') feet to five (5') feet as part of the merger only to validate the siting of the structures and not to allow further building in the setback areas, may only be done pursuant to a special permit issued by the Board of Appeals. 6. Therefore, based upon the foregoing, the Board finds that the proposed reconfiguration of the lot lines of the Locus to allow the merger of the two (2) parcels into one (1) single lot reduces the nonconformity as to lot size of the Locus and eliminates the ground cover ratio violation and rear and front yard setback violations of the existing structures on said Locus. The Board further finds that such reconfiguration of the lot lines and validation of the existing siting of the structures on the Locus by reducing the easterly and westerly side yard setback distances to about five (5) feet and about six (6) feet, respectively, would not be substantially more detrimental to the neighborhood than existing nonconformities. In addition, the Board finds that the merger of the Locus and the adjacent vacant parcel does not create any new nonconformity nor increase any existing nonconformities and in fact would reduce and/or eliminate existing nonconformities. 7. Accordingly, by UNANIMOUS vote, the Board of Appeals GRANTS the requested SPECIAL PERMIT relief under Nantucket Zoning By-law Section 139-33A(8) to allow the reconfiguration of lot lines of the Locus by merging the adjacent vacant parcel with the Locus and SPECIAL PERMIT relief under Nantucket Zoning By-law Section 139-16C(l) to validate the siting of the existing structures on the lot by reducing the easterly and westerly side yard setback distances as part of the merger, once the vacant parcel has been acquired by the Applicants, based upon the following conditions: a. The resulting new merged lot shall be comprised as shown on the plan entitled "Site Plan of Land to Show Proposed Acquisition of 12 Maine Ave. (Lots 5 & 6) by Owners of 14 Maine Ave. (Lots 43 & 44)", drawn by Charles W. Hart & Assoc., Inc., P.L.S., dated June 5,2006, a reduced copy of which is attached hereto as Exhibit A; b. The Locus and the vacant lot shall be merged for zoning purposes into one (1) buildable lot; and c. In addition to the above noted nonconformities, the Sklarew's property is nonconforming as to ground cover as the structures constitute an about 17.5% ground cover ratio, in excess of the maximum allowed of 12.5%; and as to setbacks, with the shed structure sited within the required 30- foot front yard setback area and within the required ten-foot easterly side yard setback area, and with the dwelling being sited within the required easterly and westerly side yard setback areas and as close as zero from the northerly rear yard setback lot line. Said nonconforming ground cover ratio, the rear yard setback violation of the deck and front yard violation of the shed on Applicants' lot would be eliminated with the merging of the two lots for zoning purposes.
