At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1 :00 p.m.,
Friday, June 9, 2006, in the Conference Room of the Town Annex Building, 37
Washington Street, Nantucket, Massachusetts, on the Application of the REV A AND
MORTON SCHLESINGER, 45 India Street, Nantucket, MA 02554, Board of Appeals
File No. 042-06, the Board made the following Decision:
1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-33A (alteration/expansion of a pre-existing/nonconforming
structure/use), and to the extent necessary, relief by V ARlANCE pursuant to Zoning By-
law Section 139-16A (Intensity regulations - ground cover). Applicants propose to
construct an about 15 square-foot shed structure on the northwesterly side of their pre-
existing nonconforming single-family dwelling in order to shield the existing oil tank
from the elements due to chronic freezing of the apparatus. The attached shed would
increase the nonconforming ground cover of about 67% by about .007%. In addition, the
shed would be sited within the required five-foot northeasterly side yard setback area but
no closer than the existing structure which is sited less than one-foot from that lot line.
The property is nonconforming as to lot size with the lot containing about 2,178 square
feet of area in a district that requires a minimum lot size of 5,000 SF; as to ground cover
with the lot containing about 67% ground cover ratio in a district that allows a maximum
ground cover ratio for undersized lots of 30%; as to setback, with the structure being sited
less than one foot from the northeasterly side yard lot line, and as close as about three feet
from the easterly side yard lot line, in a district that requires a minimum side yard setback
of five feet; and as to parking with the lot containing no parking historically and none is
planned in relation to this application.
The Premises is located at 45 INDIA STREET, Assessor's Map 42.3.4, Parcel
123, no plan on record, Deed Ref. Plan Book 873, Page 350. The property is zoned
Residential-Old-Historic.
2. This Decision is based upon the Application and materials submitted with it,
along with the testimony and evidence presented at the hearing. The Planning Board did
not make a recommendation. There were no letters on file and one abutter spoke in favor
of the Application at the public hearing.
3. Applicants represented that their property is a nonconforming lot of record and
the single-family dwelling contained thereon was constructed in substantially the same
site and configuration during a period between 1804 and 1813, and both the lot and
structure are validly grandfathered as to the dimensional and parking nonconformities.
Applicants state that their above-ground oil tank is located in an exposed location against
the house on the northwesterly side and has been prone to freezing in inclement weather,
causing disruption in their ability to provide heat for their year-round home. Applicants
state that the problems have caused them financial harm in having to make constant
repairs to the system. Applicants were advised by their service technician to enclose the
tank in a small insulated shed structure that would be attached to their house. Applicants
are seeking relief to be able to site the shed within the required five-foot side yard setback
area and to increase ground cover in order to construct an attached one-story about 5' x
3' shed. As the Applicants have not had a formal survey done by a licensed surveyor, all
data available was based upon the Assessor's Office records. The Assessor's records state
that the lot contains about 2,270 square feet of area and a separate Town of Nantucket
GIS website states that the lot area is about 2,178 square feet. Based upon the Assessor's
records the increase of about 15 square feet of new ground cover would increase the
ground cover ratio by about .006887 or about .01% to about 67%. Based upon the GIS
map information the ground cover would increase by about .0066079 or again about
.01% for a total ground cover of about 64%. The existing house has a ground cover of
about 1,458 square feet based upon the Assessor's records. Applicants state that such an
increase would be minimal and have no negative impact on the neighborhood. Applicants
state that the oil tank was placed in that location in 1957 by a previous owner. Said
owner Dorothy McGarvey submitted a letter dated February 10,2006 stating that she had
put the tank in the current location in 1957 when they installed "central heat". Applicants
state that there is no other location to move the tank to due to the siting of the house and
the irregular shape of the lot and variance relief would most likely have to granted to re-
site it.
4. Therefore, based upon the foregoing, the Board finds that special permit relief can
be granted to extend the structure within the required five-foot side yard setback as the
shed is not proposed to come any closer to the lot line than the existing dwelling, and
finds that this proposal would not be substantially more detrimental to the neighborhood
than the existing nonconformities and would have minimal impact. In addition, the
Board finds that a grant of variance relief can be made owing to the unique shape of the
triangular lot, bordered on three sides by streets, and topography of the structure, a
historic single-family dwelling, and especially affecting the Locus but not affecting
generally the Residenetial-Old-Historic zoning district, a literal enforcement of the
provisions of the Zoning By-law would involve substantial hardship to the Applicant
(specifically, the potential financial impact of repeated damage done to the oil tank and
house), and that desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the intent or purpose
of the By-law.
5. Accordingly, by a UNANIMOUS vote, the Board hereby GRANTS the SPECIAL
PERMIT relief under Nantucket Zoning By-law Section 139-33A and V ARlANCE relief
under Section 139-16A to construct the shed as proposed, based upon the following
conditions:
a. The shed expansion shall be done in substantial conformance with the plan
approved by the Historic District Commission in Certificate of
Appropriateness No. 47,985, as may be amended from time to time;
b. The maximum ground cover ratio shall be no greater than 67%, and the
permitted ground cover of about 15 square feet is not transferable to a
different location and/or use without further relief from this Board; and

ADDENDUM
Applicants are seeking relief by Special Permit under Nantucket Zoning By-law Section
139-33A and to the extent necessary pursuant to Zoning By-law Section 139-16A.
Applicants propose to enclose an existing exterior oil tank located on the northwesterly
side of the structure with an about 3' x 5' one-story shed. Applicants state that the tank
freezes in the winter and the only way to protect it is to cover it and insulate the
enclosure. The tank was in its present location since before the 1972 enactment of the
Zoning By-law and is thus grandfathered as to siting. The structure covers almost 67% of
the lot and is sited at about zero feet from the front and the side yard lot lines. There is no
other place to re-site the tank safely. The shed would be attached to the house and would
be no closer to the northwesterly side/rear yard lot line than the house and could be done
by special permit. The Applicants have never undertaken having a formal survey done
and the only records of the house are contained on the GIS maps on the town website and
