DECISION:
At a Public Hearing of the Nantucket Zoning Board of Appeals, held at 1 :00 P.M.,
Friday, May 12,2006, in the Conference Room, Town Annex Building, 37 Washington Street,
Nantucket, Massachusetts, on the Application of the JEFFREY GREENBERG AND
KIMBERLY GREENBERG, of20 Orange Street, Nantucket, Massachusetts 02554, Board of
Appeals File No. 041-06, the Board made the following Decision:
1. Applicants are seeking a MODIFICATION of the SPECIAL PERMIT relief
granted in the Decision in BOA File No. 050-87 and to the extent necessary, additional relief by
SPECIAL PERMIT under Nantucket Zoning By-law Section 139-33A (alteration! expansion of a
pre-existing/nonconforming structure/use). Applicants propose to renovate the existing single-
family dwelling and construct about 37 square feet of additional ground cover and enclose an
existing greenhouse on the easterly rear of the pre-existing nonconforming single-family
dwelling. In the original Decision a predecessor-in-title was granted relief to extend the house in
the same area provided that the addition did not come any closer to the southerly side yard lot
line than the existing structure. The new small addition would not come any closer to the
southerly side yard lot line than the existing house, and would be sited as close as about 2.1 feet
from that lot line with that existing portion of the structure being sited as close as about 0.8 feet
from that lot line. The lot would continue to conform to ground cover requirements. The locus is
conforming as to lot size, front yard setback and ground cover and would continue to do so after
the construction of the addition. The lot is nonconforming as to frontage with the lot having a
frontage of about 35.35 feet on Orange Street in a district that requires a minimum frontage of 50
feet; and as to setback with the dwelling sited as close as about 0.8 feet from the southerly side
yard lot line and as close as about 2.7 feet (a shed portion of the house) from the northerly side
yard lot line, in a district that requires a minimum side and rear yard setback of five feet, and
with a separate bunkhouse structure being sited as close as about 0.20 from the southerly lot line
and at zero from the westerly side yard lot line. There is no parking on the site and none is
planned.
The Premises is located at 20 ORANGE STREET, Assessor's Map 42.3.2,
Parcel 70, Land Court Plan 11438-B, Lot C. The property is zoned Residential-OId-Historic.
2. The Decision is based upon the Application and the materials submitted with it
and the testimony and evidence presented at the Hearing. The Planning Board made no
recommendation finding that the matter did not present any issues of planning concern. There
were no letters on file and no opposition presented at the hearing.
3. The Applicants, through their representative, stated that the Locus is benefited by
a previous grant of Special Permit relief in the Decision in BOA File No. 050-87 that allowed a
rear addition and greenhouse to be constructed partially within the required five-foot southerly
side yard setback area, but no closer to the lot line than the existing main portion of the single-
family dwelling. The structure is clearly shown on the 1938 and 1957 aerials in the Town records
and thus is validly grandfathered as to siting. The Applicants are undertaking a renovation of the
structure and are proposing to enclose the existing rear greenhouse on the easterly portion of the
house to provide interior living space, and construct about 37 square feet of additional ground
cover to fill the section in to make the wall flush with the existing rear wall plane of the 1799
dwelling. The new addition would not come any closer to the southerly side yard lot line than
the previously approved addition, though there would be an easterly extension of the existing
addition, and no closer than the main portion of the house and would be one story in height. The
lot would remain conforming as to ground cover. The Historic District Commission has
approved the alterations in Certificate of Appropriateness No. 47,874.
4. Based upon the foregoing, the Board finds that a grant of the Modification of the
previous Special Permit relief granted in the Decision in BOA File No. 050-87, to enclose the
rear greenhouse to provide increased interior living space and add another about 37 square feet
of ground cover as proposed would not be substantially more detrimental to the neighborhood
than the existing structure and would have minimal to no impact on surrounding properties. The
Board notes that this section of the structure is at the rear of the property and essentially within
the existing footprint of the existing structure.
5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested
MODIFICATION of the SPECIAL PERMIT relief granted in the Decision in BOA File No.
050-87, and to the extent new SPECIAL PERMIT RELIEF under Nantucket Zoning By-law
Section 139-33A, to allow the alterations and expansion of the dwelling as proposed, based upon
the following conditions:
b.
The addition shall be done in substantial conformance with the
"Building Location Plan", done by Charles W. Hart & Associates,
Inc., dated April 14, 2006, a reduced copy of which is attached
hereto as Exhibit A; and
The alterations/expansion of the rear addition shall be completed in
substantial conformance with the Certificate of Appropriateness
No. 47,874 issued by the Nantucket Historic District Commission,
as may be amended from time to time; and

DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, APRIL
10, 1987 at 1:30 p.m. in the Town and County Building, Nantucket, made
the folllowing decision on the application of MERCIA PARK LEE (050-87)
of 20 Orange Street, Nantucket, MA 02554.
1. Applicant seeks a SPECIAL PERMIT pursuant to SECTION 139-33A,
to allow the ext4nsion or alteration of a pre-existing, non-conforming
structure. The premises are located at 20 ORANGE STREET, Assessor's
map and parcel 42.3.2-070. The premises are shown as Lot G on Land COurt
Plan 11438 B, dated 1938 and is zoned RESIDENTIAL-OLD-HISTORIC.
2. Our findings are based upon the Application papers, plans,
statements and representations received or presented at the hearing.
Based upon that information, presented by Applicant and without evidence
to the contrary, we understand that the presently existing single-family
dwelling has lawfully existed since prior to 1972 in a location that
would otherwise not conform to the side line setback requirements in the
zone as they relate to the southern boundary line.
3. Applicant proposes an approximately 45 SF (13'10" x 3'3") addi-
tion from grade in the rear of the structure and an expansion upward over
the existing structre. A portion of each of the addition from grade and
of the second story expansion will be within the five foot setback area.
(The Board need not consider other alterations to the structure for which
relief is not sought nor thought to be necessary.) The present actual
setback distance from the southern boundary line will be maintained, even
after construction of the proposed addition and expansion.
4. We find therefore, that the proposed addition and expansion,
substantially as shown on a site plan is not made more non-conforming by
the extension of the structure and that such extensio~ will not be sub-
stantially more detrimental to the neighborhood.
