DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on
Friday, May 12, 2006, at 1:00 P.M., in the Conference Room in the Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the
following Decision on the Application (040-06) of HADLEY INVESTMENTS
LLC of 68 Stephen Mather Drive, Darien, CT 06820, in connection with property
known as 54 Monomoy Road, Nantucket, Massachusetts.
2. Applicant is seeking relief by SPEGAL PERMIT under Nantucket
Zoning By-law Section 139-33A (alteration/ expansion of a pre-existing
nonconforming structure/ use) and to the extent necessary, relief by VARIANCE
pursuant to Zoning By-law Section 139-l6A to complete the project as proposed.
Applicant proposes to renovate the existing single-family dwelling and to
demolish and reconstruct the existing garage on the lot, both of which are said to
be pre-existing nonconforming as to front yard setback requirements, and with
the garage sited within the required side yard setback area. Applicant proposes
to construct a new foundation under the dwelling, demolish the newer rear
addition on the southeasterly side of the dwelling, and reconstruct a more
conforming addition in the same area, reducing the nonconforming front yard
intrusion from about 21.2 feet to about 33 feet in a district that requires a
minimum front yard setback of 35 feet. Side yard setback requirements would be
met by the new addition to the dwelling. In addition, Applicant proposes to
demolish the existing garage, which is presently sited as close as about two feet
from the front yard lot line and as close as about 1.6 feet from the easterly side
yard lot line, in a district that requires a minimum side yard setback of ten feet;
and construct a new garage that would be located as close as about 22 feet from
the front yard lot line and no closer to the northeasterly side yard lot line than
the existing garage. The new garage would be about four feet taIler than the
existing structure and oriented differently. In addition to the above-noted
nonconformities, the property is nonconforming as to lot size with the lot
containing less than the required 40,000 square feet of lot area.
The Premises is located at 45 MONOMOY ROAD, Assessor's Map
43, Parcels 42, 55 and 56, Land Court Plan 13572-A, Lots AI, Bl, and Cl. The
property is zoned Limited Use General -1.
3. Our decision is based upon the application and accompanying
materials, and representations and testimony received at our public hearings.
The Planning Board made no recommendation finding that no issues of planning
concern were presented. There was no public comment at the meeting other than
by the Applicant's representative and no letters on file.
4. The Applicant, through counsel, proposed to renovate the main
dwelling and reduce its intrusion into the front yard setback so that only
approximately 1.5 feet of the dwelling would remain in the setback, by
demolishing the rear el and constructing a new addition that would meet all side
setback requirements. That portion of the new addition that would be sited
within the required front yard setback would have a ridge height of about 22
feet. The original rear one-story addition had a ridge height of about 11 feet. The
new addition would not be sited in the same footprint as the existing rear eI. The
Board felt that given the nature and extent of the proposed renovations to the
house, including the new foundation that was proposed, the Applicant had
alternative ways to design the rear addition so as not to violate the required 35-
foot front yard setback area and therefore there would be little to support a grant
of such relief. The Board, while mindful of the proposed project's reduction in
the structure's nonconformity by having the building sited farther from
Monomoy Road, did not find that circumstances on the site would justify the
continued presence of portions of the dwelling within the front yard setback. In
other respects the renovation proposed would comply with dimensional
requirements with respect to the house and not need relief from this Board. The
ground cover for the project was shown to be based on the combined area of all
three parcels held in common ownership by the Applicant, and any changes
would be in compliance with the 7% maximum ground cover ratio requirement
for this lot.
5. Applicant, through counsel, stated that the existing garage is in
poor condition and has been approved for demolition by the Historic District
Commission. The redesigned garage would have a new ridge height of about 16
feet, whereas the existing garage has a ridge height of about 11 feet, with a
slightly different footprint. The proposed new garage would be sited farther
from Monomoy Road, although not sited out of the required front yard setback
area. The Board recognized that the Applicant could have demolished the
original garage and reconstructed a new garage with substantially the same
dimensions, use and siting as the existing ancillary structure without relief from
this Board as allowed under Zoning By-law Section l39-33D(l). However, even
though the proposed new garage would be less nonconforming as to siting than
the existing garage, the Board found that due to change in location of the new
garage the demolition and reconstruction would not be allowed under said
section. The unusual features of this site include the wetland and steep, sandy
bank that affect the northerly portion of the property, its narrow rectangular

shape, the distance from the traveled road surface to the property line (giving an
appearance of a much greater front yard setback than actually exists), and the
topography of the existing structures on this site and in particular on the
abutting property to the east as well as neighborhood context. The easterly
abutting property's improvements were shown by aerial photographs to be sited
very close to the common property line, making a move of the garage wholly out
of the setback imprudent, and at a location very close to the abutting cottage. The
Board's concern focused primarily on the side yard setback intrusion, especially
given the proximity of the structures on the abutting property. The Board felt
that as the garage was being reconstructed the Applicant could provide at least a
five-foot side yard setback from the easterly side yard lot line in order for the
project to proceed in a manner that was not detrimental to the public good and
that would be consistent with the Nantucket Zoning By-law in which five feet is
generally the minimum side yard setback required.
6. Therefore, based upon the foregoing, the Board finds that the
difficulty in siting the reconstructed garage given the location of the wetlands,
coastal bank, siting of the historic dwelling on the lot, neighborhood context and
the proximity of the structures on the abutting property, creates a hardship for
the Applicant in limiting the siting of the proposed new garage structure. The
situation and facts presented do not generally affect the zoning district but rather
are uniquely related to the topography of the lot and the structures, both the
existing buildings on this site and those on the adjacent parceL The Board finds,
based on the information presented at the hearing that the desirable relief may be
granted without substantial detriment to the public good and without nullifying
or substantially derogating from the intent or purpose of the Zoning By-law. The
Board also notes that the new garage would be substantially less nonconforming
than the existing garage. The Board also notes that the front yard setback
intrusion of the single-family dwelling would be eliminated as a condition of
relief and would provide a benefit to the public good.
7. Accordingly, the Board of Appeals, by a vote of four in favor
(Waine, Toole, Wiley, Koseatac) and one opposed (Sevrens), GRANlS the
requested relief by V ARIANCE from the requirements of Nantucket Zoning By-
law Section l39-l6A to allow the existing garage to be demolished and a new
garage to be constructed within the front and side yard setbacks as conditioned
below, based on the following conditions:
a. The reconstructed garage structure shall be sited at least 22.5
feet from the southerly front yard lot line along Monomoy Road and at least five
feet from the easterly side yard lot line, without further relief from this Board;
and

b. The dwelling, once renovated, shall conform to all setback
requirements, unless further relief is granted by this Board.

Once, this house sat on a larger piece of prop-
erty; now it has only a hundred feet of
frontage, but a great heritage. In 1890 it had been the
first property Squire Frederick Russell bought, and
we believe he built it as we see it today, except for the
porch, which was modified some forty years later.
Albert G. Brock bought it in [894. He was th~
son of whaling captain Josiah C. Brock, whom
Russell's father had visited in 1889 and who may,;
have led to Frederick Russell's invol vement witD
Monomoy Heights. Brock founded his eponymOui
insurance company in 1886, and it still thrives toda1J

" In its front-page obituary, the Inquirer and Mirror
'. led Brock "unquestionably the leading citizen of
antucket." As an example, he had served as execu-
.r of Squire James H. Gibbs's considerable estate in
, 08 (see Chapter Nine), In addition to his thriving
: urance business, he served as president of the
'. ernc National Bank, helped form the Gas & Elec-
ic Company, and had roles in the Historical Asso-
ciation, the 'Boston Chamber of Co'mmer'ce, the
antucket Civic League, and the Cottage Hospital.

William Brock, now nIDning the insurance com,
pany, and his sister Mary (Mrs. Frank E.) Lewis
owned the Monomoy house from [930 and rented it
to another prominent family until they sold it in 1937.
Enter Edgar W. Jenney and his wife, Kate, who
,. were to enliven the Nantucket scene as few others
have, with irresistible exuberance-and so much

more. Edgar was an artist who turned his talents to
interior decorating. His fIrm designed and painted
the interiqrs of the Rockefeller house at Pocantico
Hills, the Morgan Library in New York, the Arts &
Science Building in Washington, Ottawa's Parlia-
ment Building, Yale's Woolsey Hall, New York Tele-
phone, Standard Oil, and many churches and banks
around the country. 16
Jenney preserved his work through watercolors,
forty-five of which were exhibited by the Metropol-
itan Museum of Art in ! 940. "The watercolors are
simple, spontaneous, and alive. , . , Chairs and tables
stand soberly at ease, their various textures of
mahogany, maple, and pine are secrets revealed for
an understanding eye. Sunlight flooding a polished
table top : . . the intricate reflections .of a crystal
~ha~delier, or the icy higWights of porcelain against
a paneled wall, are difficult problems easily mastered
here. Human figures are never architects' robots giv-
ing scale to a background, but real Nantucketois [sic]
as native as the windy moors and cobbled streets.
Mr, Jenney has given us a history of Nanwcket,"11
Jenney retired from his New York firm in [927
and moved his legal resi:cnce to :-< Jr11l!cket, to paint
and teach pupils there. This led to his painting nostal.

which he released as lith-;graphs on July 7, [932.
Jenney was one of', H~ first presc)'\'ationists and
"made a constructive c:rort to S,l\(' I\:mtucket's old
houses. . . by explaining the methods of the old
housewrights to local carpenters and contractors
and the need to preserve the original fabric." 18 His

exuberance spilled over to many activities, one
memorable one being at the Yacht Club celebration
of the MassachusettsTercentenary in 1930, Jenney
designed the sets and acted in skits with Austin
Strong, while fellow Monomoyite and opera singer
Marie Tiffany sang "La Marseillaise,"19 Although he
contributed much to the Island's cultural scene,
Monomoyites claim Jenney as their own, for it was
his pleasure to respond to homeowners who had dif-
ficult renovation and decorating probl~ms to solve
in their now-aging cottages. (Mistover and
Shawkemo were among those whose interiors to this
day reflect Edgar Jenney's fine touch.) Myth has it
that he invented names for all the Monomoy cot-
tages, but the mist~ of time have obscured what he
. .named his own horrie.
It is known, however, that he remodeled his
porch overlooking the Harbor. He added little
wings on the east and west ends so that he could get
the best lighting for his painting there. The east
wing is evident in the house picture at the begin-
ning of this section.
Edgar Jenney died at sixty-nine at his ,
home on Vestal Street, and twenty-eight years'
in 1967, his widow, Kate Gilman Jenney, died tIi
also. Both are buried in Prospect Hill Cemetery. .
The house passed in 1 945 to the Ed
Newhalls, a delightful couple from Maryland:
