At a Public Hearing of the ZONING BOARD OF APPEALS held at 1 :00 P.M.,
Friday, September 8,2006, in the Conference Room at the Town Building Annex, 2
Fairgrounds Road, Nantucket, Massachusetts, on the Application of NANTUCKET
CAMPFIRE LLC, of 3 West 57th Street, New York, New York 10019, Board of Appeals
File No. 078-06, the Board made the following Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law
Section 139-33A (alteration/expansion of a pre-existing nonconforming structure/use).
Applicant proposes to construct an about 60 square-foot conforming addition onto an
ancillary structure, currently used as a studio, that is nonconforming as to the ten-foot
side yard setback requirement, being sited as close as about 2.5 feet from the
northeasterly side yard line and less than ten feet from the southerly side yard lot line.
The primary structure and lot are conforming in all other respects to dimensional zoning
requirements and would remain conforming after the addition is constructed.
The Premises is located at 64 MONOMOY ROAD, Assessor's Map 43, Parcel
109.1,109.3 and 109.4, Land Court Plan 13219-E, Lots 13 and 16. The property is
zoned Limited-Use-General-1.
2. The Decision is based upon the Application and materials submitted therewith,
and the testimony and evidence introduced at the hearing. There was no
recommendation from the Planning Board as the Board determined that the matter was
not of planning concern. There were no letters on file and no opposition expressed at
the hearing. Attorney Arthur Reade appeared on behalf of Stephen Meister, the abutter
to the north. Attorney Reade explained that his client had no objection to the grant of
the requested special permit relief provided there is no increase in the height of the
structure.
3. Applicant, through counsel, represented that the Applicant proposed to construct
an addition of approximately 60 square feet to an existing studio as part of an overall
renovation of the structure. The addition would conform in all respects to the
requirements of the Nantucket Zoning By-law, but since the existing studio building is
nonconforming as to side line setback requirements, a special permit relief is required in
order to construct this addition. The addition would add a bathroom to the building. The
studio is clearly visible on the 1938 and 1957 aerial photographs in the Town of
Nantucket records and is thus validly grandfathered as to siting within the required ten-
foot easterly side yard setback area. The Applicant stated that there would be no
increase in the height of the structure and the structure would not be used for human
habitation.
4. Therefore, based upon the foregoing, the Board of Appeals finds that the
proposed addition is in keeping with the residential character of the neighborhood, does
not violate the spirit or the intent of the Zoning By-law, and is not substantially more
detrimental to the neighborhood than the existing nonconforming building and does not
increase any zoning nonconformity. In addition, the Board finds that though the addition
is conforming in all respects as to the Zoning By-law requirements, special permit relief
is necessary due to the fact that relief is necessary to expand ancillary structures that
are nonconforming as to setback.
5. Accordingly, by a vote of four in favor (Waine, O'Mara, Koseatac and Tupper) to
one opposed (Sevrens), the Board GRANTS the requested Special Permit relief under
Nantucket Zoning By-law Section 139-33A to allow the construction of the about 60
square-foot addition to the existing studio as proposed, subject to the following
conditions:
a. The addition shall be constructed in substantial conformance with the
"Plot Plan to Accompany Board of Appeals Application", done by Leo
Asadoorian, registered land surveyor, dated July 21, 2006, a reduced
copy of which is attached hereto as Exhibit A;
b. The alteration and expansion of the studio shall be done in substantial
conformance with the plans approved by the Historic District Commission
in Certificate of Appropriateness No. 48,501, as may be amended from
time to time;
c. The structure may contain a bathroom but no bathtub;
d. There will be no increase in the height of the structure from what presently
exists;
e. The studio shall not be used for human habitation; and

332 sqnare feet. The addition will comply with all zoning reqnirements, however, the existing stndio
violates the sideline setback as it is 2.5 feet from the easterly sideline in a zoning district that reqnires a ten-
foot sideline setback. The lot contains 69,207 sqnare feet in the LUG-I zoning district and has 100 feet of
frontage. The present ground cover is 5.85% and with the addition it will increase to 5.95% and 7% is
