DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, October
13, 2006, at 1:00 P.M., in the Conference Room, at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following decision on the application of LYNN S.
STABLER, AS TRUSTEE OF JKLM REALTY TRUST, c/o Reade, Gullicksen, Hanley &
Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 088-06:
2. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-16C(l) to reduce the northerly side yard setback from ten feet to eight feet in
order to validate a portion of an existing deck, constructed in 2005, that is on the northerly side
of the existing garage/ apartment. The property is benefited by a previous grant of Special Permit
relief in the Decision in BOA File No. 105-93 that allowed the demolition of an existing metal
garage structure and a portion of the existing single-family dwelling and construction of a new
garage/apartment. Said relief is no longer necessary. The locus is nonconforming as to lot size
with the lot containing about 11,257 square feet of area in a district that requires a minimum lot
size of 20,000 square feet. Other that those nonconformities previously indicated, the locus is
conforming in all other respects to the dimensional requirements of the Zoning By-law.
The Premises is located at 5 COFFIN STREET (AKA W. SANKATY
AVENUE), SIASCONSET, Assessor's Map 73.1.4, Parcel 21, Plan Book 12, Page 53, Lot A.
The property is zoned Residential-2.
3. Our decision is based upon the application and accompanying materials, and
representations and testimony received at our public hearing. There was no Planning Board
recommendation, on the basis that no matter of planning concern was presented. Except for the
presentation by the Applicant's representative, there was no support or opposition presented at
the public hearing. There was one letter from the direct abutter across Coffin Street, who stated
that there was "no impact" on his property and supported approval of the requested relief.
4. As presented by the Applicant's counsel, the Applicant constructed a
garage/apartment upon the lot several years ago. During a recent renovation a first-floor deck
was expanded in 2005 to as to be now sited within the northerly required ten-foot side/rear yard
setback area. When an as-built site plan was prepared by Charles W. Hart & Associates, Inc.,
dated July 26, 2006 (a reduced copy of which is attached hereto as Exhibit A), the plan revealed
that the structure itself was still conforming to all setback requirements but one comer of the
deck, that also contained an outdoor shower surround, on the northerly side if the structure was
inadvertently sited as close as about 8.0 feet from the northerly side/rear yard lot line. The locus
is sited in the Sconset-Residential-2 zoning district, in which the required side/rear yard setback
under Zoning By-law Section 139-16.A is ten feet. However, Section 139-16.C(l) specifically

allows the Board of Appeals, as special permit granting authority, to reduce the required side and
rear yard setbacks in this district to as little as five feet, by special permit. No specific findings
are required for the granting of a special permit under this provision, so the general special
permit standard that the granting of relief would be in harmony with the general purpose and
intent of the Zoning By-law is applicable.
5. The Applicant's counsel related that the first-floor deck and outdoor shower had
been constructed inadvertently within the setback area by the builder and unbeknownst to the
Applicant, with a large part of the deck sited outside the required ten-foot setback area. The
northerly side yard lot line is also bordered by a large, old growth privet hedge which mitigated
any impact on the neighborhood. The contractor is represented to have sited the deck himself,
and the unfortunate result was that the northwesterly corner of the deck was sited about 8.0 feet
from the property line, as stated above. Therefore, since the Zoning By-law expressly allows for
special permit relief to reduce the setback from ten feet to five feet, the Applicant brought the
present application for relief under this provision.
6. Therefore, based upon the foregoing, the Board of Appeals finds that the Applicant
had proceeded in good faith in the construction of the garage/apartment; that the intrusion into
the setback area, of about two feet at one corner, with the majority of the deck located outside the
required setback area, was de minimis; and that there would be no benefit to be achieved by the
correction of the intrusion, particularly since no opposition was received from the direct abutter
to the north. The Board also finds that the requested relief would be in harmony with the general
purpose and intent of the Zoning By-law. The Board also noted that a previous grant of a
"Finding" in the Decision in BOA File No. 105-93, was no longer necessary as the excess
ground cover over 1500 square-feet that had been allowed, was never constructed and thus the
Premises is conforming as to ground cover requirements.
7. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief by
SPECIAL PERMIT under Nantucket Zoning By-law Section 139-16.C(l), to reduce the
northerly side/rear yard setback distance applicable to the locus to as close as about eight feet to
validate the siting of the deck and outdoor shower surround on the northerly side of the existing
garage/apartment, subject to the following conditions:
(a) This relief is limited to the siting of the existing deck and outdoor shower
attached to the northerly side of the garage/dwelling as shown
upon the Exhibit A plan; and
(b)

Dear Chair Roggeveen and Commissioners,
Attached please find an application for a deck, as built. In 2005 my client hired a
contractor to repairs an HDC approved outdoor shower enclosure on her cottage/garage.
While it is no excuse, she unknowingly believed the contractor when he said that no
approvals or permits would be needed for adding a small deck. Quite to her
consternation, she discovered otherwise when she attempted to get a building inspection
for a new shed. She also discovered that the deck is a zoning violation, which we are
addressing separately.
Please find enclose an application check in the amount of $52 to cover the
penalty, a copy of the HDC approved plans showing the elevations of this side ofthe
house, current photographs of the deck from three sides (to the extent possible due to the
privet hedge), and an as-built survey. If you require anything else, please so advise.
