Applicant (the "Appellant ") is APPEALING, pursuant to Nantucket Zoning By-
law Section 139 -31, from a "Notice of Zoning Code Violation and Order to Cease, Desist
and Abate" issued by the Zoning Enforcement Officer ( "ZEO") dated July 19, 2006,
without prejudice to the Appellant's contention that the ZEO has no power to issue such
an Order and that no appeal need be taken therefrom in order to protect the Appellant's
rights. The ZEO contends that the Appellant has expanded the pre - existing use of the
locus for exterior storage of goods and materials in conjunction with Appellant's
construction related/excavation business. Appellant contends that the pre - existing use has
continued with only normal business development and seasonal variations in the extent of
use. In the alternative, the Appellant is seeking relief by SPECIAL PERMIT pursuant to
Nantucket Zoning By -law Section 139 -33A (alteration/expansion of a pre - existing
nonconforming structure /use) to validate any expansion of the commercial use to the
extent necessary. The locus is otherwise conforming to all dimensional zoning
requirements.
The Premises is located at 80 MIACOMET AVENUE, Assessor's Map 66,
Parcel 126, Land Court Plan No. 13554 -A, Lot A. A portion of the property is zoned
Residential- Commercial -2 and the other portion is Limited- Use - General -2. The exact

ADDENDUM TO APPEAL OF PRISCILLA L. REIS
The appellant brings this appeal under Nantucket
Zoning By -law §139 -31, from a `Notice of Zoning Code
Violation and Order to Cease, Desist and Abate" issued
by the Zoning Enforcement Officer ( "ZEO ") dated July

19, 2006, without prejudice to the app a
contention that the ZEO has no power to issue such an
Order and that no appeal need be taken therefrom in
order to protect the appellant's rights. The ZEO
contends that the appellant has expanded the pre-
existing use of the locus for exterior storage of
goods and materials. The appellant contends that
pre- existing use has continued with only normal
business development and seasonal variations in the
extent of use. The Town contends that most of the
land comprising the locus is now situated in a Limited
Use General -2 zoning district as a result of the
adoption of Article 24 at the Annual Town Meeting of
2004. The appellant contends that Article 24, as it
purported to establish zoning boundaries in accordance
with the Town's G.I.S. map, was ineffective to change
the zoning district in which the majority of the land
within the locus is situated from Residential
Commercial -2 to Limited Use General -2, because the
express language of the article stated that the then -
existing zoning map, as amended prior thereto, was
incorporated in the new zoning map; accordingly, no
notice was given to voters that substantive changes
would result. In the alternative, the appellant
requests issuance of a Special Permit under By -law
§139 -33.A, to validate any expansion of the pre-
existing use.
