DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, December 8, 2006, at 1:00 P.M., in the
Conference Room at 2 Fairgrounds Road, Nantucket, Massachusetts,
the Board made the following Decision on the application of SUSAN
G. GOODALL and HERBERT W. GOODALL, c/o Reade, Gullicksen, Hanley
& Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts
02584, File No. 103-06:
2. The Applicants are seeking MODIFICATION of the Decision
in Board of Appeals File No. 019-98, which granted Variance
relief from Nantucket Zoning By-law ~ 139-16.A to validate a
second-story balcony located on the northerly side of a pre-
existing, nonconforming single-family dwelling. The Applicants
now wish to widen the balcony and increase its depth, reducing
the rear yard nonconforming setback from about 1.7 feet to about
0.2 foot in a district in which the minimum side and rear yard
setback is five feet. No other changes are proposed as a part of
this application. The locus is also nonconforming as to side
yard setback, with the structure being sited as close as about
3.6 feet from the easterly side yard lot line; as to use, with
the lot containing six dwelling units held as a condominium, with
two dwelling units on one lot being the maximum in this zoning
district; and as to ground cover, with the structures upon the
locus having a ground cover ratio of about 52%, with the maximum
ground cover ratio in this district being 50% . The lot is
conforming as to lot area and frontage. The locus is situated at
18 STILL DOCK, Assessor's Map 42.3.1, Parcel 85, is shown on a

plan recorded with Nantucket Registry of Deeds in Plan File 28-A,
and lies wi thin a Residential-Commercial zoning district. The
locus has been declared as a condominium known as the Still Dock
Condominium, and the subject unit is Unit 6.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
recei ved at our public hearing. There was no Planning Board
recommendation, on the basis that no matter of planning concern
was presented. A letter in support was received from the
President of Old North Wharf Cooperative, Inc., the owner of the
property immediately abutting the rear of the locus and thus
closest to the proposed addition. Written consents were received
from the owners of all other units in the Still Dock Condominium.
Except for the presentation by the Applicants' representative,
there was no support or opposition presented at the public
hearing.
4. As presented by the Applicants' representative, the
subject dwelling is now improved with a small second-story
balcony on the northerly side of the structure. Applicant states
that the balcony is not of sufficient size to allow for
comfortable use, and the Applicants propose to increase its depth
by about 1.5 feet, and increase its width from about 7.5 feet to
about 18 feet. The Applicants' representative showed several
photographs of other balconies facing Old North Wharf, which were
considerably wider than the balcony now existing upon the locus
and stated that the proposed balcony would not be inharmonious
with the surrounding neighborhood. The locus abuts Old North
Wharf, but obtains its frontage and access from Still Dock;
however, it is effectively a part of the streetscape of Old North
Wharf. The proposed expansion of the deck has been approved by
the Nantucket Historic District Commission ("HDC") in Certificate
of Appropriateness No. 49,190.
5. Therefore, based upon this presentation and the
materials received, the Board of Appeals, by UNANIMOUS vote, made
the finding that the proposed Modification of the Variance relief
in File No. 019-98 would have no adverse impact upon the
neighborhood nor upon any of the findings upon which the original
relief was granted; and by the same UNANIMOUS vote, GRANTED the
requested MODIFICATION, in order to allow the expansion of the
second-story balcony as proposed, subject to the following
conditions:

Dear Members:
r write to you to comment on the proposal of Herbert Goodall to expand
a second floor balcony on 18 Still Dock and to inform you that the Old
North Wharf Coop is in favor of the project.
We see no detriment to the neighborhood from the expanded balcony.
Rather, we believe the new balcony would promote civil life on the
wharf as the additional presence of the Goodalls, on their new balcony
in the public space of the Wharf, would have the good effect ascribed
to .public characters" as discussed in The Death and Life of Great
American Ci~ies~ Jane Jacobs, pp68ff, 1961.
