NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at
1:00 P.M., FRIDAY, DECEMBER 8, 2006 in the Conference Room, 2
FAIRGROUNDS ROAD, FORMERLY KNOWN AS THE NANTUCKET
ELECTRIC COMPANY BUILDING, WITH AN ENTRANCE FROM OLD
SOUTH ROAD, FIRST RIGHT AFTER FAIRGROUNDS ROAD COMING
FROM TOWN WITH ENTRANCE FROM THE FRONT OF THE BUILDING,
Nantucket, Massachusetts, on the Application of the following:

CHETWOOD NOMINEE TRUST, INC.
BOARD OF APPEALS FILE NO. 100.06
The Applicants are seeking relief by SPECIAL PERMIT pursuant to Nantucket
Zoning By-law Section 139-16C(1), to reduce the northerly side yard setback from the
required ten fe€t to five feet, in connection with the re-siting of the existing single-family
dwelling from the present zero setback location to no closer than five feet. An existing
second floor egress stairway would be removed and reconfigured and the dwelling moved
in a northerly direction in order to increase the scalar separation from the wetland
resource areas located on the southerly side of the lot. A first floor porch would be added
to the northerly side of the structure as well as other exterior changes proposed within the
required setback areas and without. The locus is also nonconforming as to lot size with
the lot containing about 10,309 square feet of area ip a district that requires a minimum
lot area of20,000 square feet.
The Premises is located at 96 BAXTER ROAD, SIASCONSET, Assessor's Map
48, Parcel 44, Land Court Plan No. 12839-B, Lot B2. The Property is zoned Residential-
2.

The applicants request a Special Permit under Nantucket Zoning By-law ~l39-
16.C(l), to reduce the northerly side yard setback from 10 feet to 5 feet,
in connection with the alteration and moving of the existing single-family
dwelling, in order to increase scalar separation from the wetland resource
areas upon the locus. The dwelling, a pre-existing nonconforming structure,
is at present sited with zero setback from the northerly side lot line, and
would be reconfigured to maintain a setback of at least 5 feet. The locus
is nonconforming as to lot area, containing about lO,309 square feet; the
minimum lot area in this Sconset Residential-2 zoning district is 20,000
square feet.
