At a Public Hearing of the Nantucket Board of Appeals held at 1:00 p.m.,
Friday, November 3, 2006, in the in the conference room of the Town Building
located at Two Fairgrounds Road, Nantucket, Massachusetts, on the Application
NICHOLAS S. ALBANO, SARA S. ALBANO, MILTON P. SMITH AND
SHERRY B. SMITH, with an address of 62 Allen Place, Scituate, MA 02066,
Board of Appeals File No. 095-06, the Board made the following Decision:
1. Applicants are seeking relief by VARIANCE pursuant to Nantucket
Zoning By-law Section 139-16A (Intensity Regulations - setback). Applicants are
seeking validation of certain alterations and additions to the existing single-
family dwelling that were made in 1979. At the time of construction the required
side yard setback was three feet and the addition was constructed as close as
about 2.8 feet from the westerly side yard lot line, with a minimum of five feet
currently required. Applicants are seeking variance relief to validate the siting of
that portion of the structure that is sited closer than three feet from the westerly
side yard lot line. In the alternative, the Applicants are APPEALING the
decision under Nantucket Zoning By-law Section 139-31 of the Zoning
Enforcement Officer ("ZEOli) in a letter dated October 4,2006, in which the
request for the Certificate of Occupancy was denied in part based upon the side
line intrusion of about 2.8 feet, with the Applicants arguing that said intrusion is
protected from enforcement action under the curative provisions contained in
MGL c. 40A, Section 7. The Locus is nonconforming as to lot size with the lot
containing about 4,896 square feet of area in a district that requires a minimum
lot size of 5,000 square feet; and as to side yard setback, with the structure being
sited as close as about 2.8 feet from the westerly side yard lot line in a district
that requires a minimum side yard setback of five feet.
The Premises is located at 5 GALEN AVENUE, Assessor's Map 29, Parcel
122, Land Court Plan 37064-A, Lot 1. The property is zoned Residential-1.
2. This Decision is based upon the Application and materials submitted with
it, along with the testimony and evidence presented at the hearing where
testimony was taken. The Planning Board made no recommendation as there
were no issues of planning concern. There were no letters on file. Except for the
presentation by the Applicants' representative, there was no support or
opposition presented at the public hearing.
3. Applicants, through counsel, stated that after purchasing the Premises in
1989, Applicants discovered that the Premises were subject to an open building
as soon as the violation was discovered by the Applicants and about which no
enforcement action was taken at the time.
6. Therefore, based upon the foregoing, the Board finds that owing to the
circumstances relating to the shape and topography of the 1979 addition to the
dwelling on the Premises, being the de minimus setback violation created by a
prior owner and disclosed to the Nantucket Building Department before
substantial additional improvements were made to the dwelling, which
circumstances do not affect generally the zoning district in which Locus is
situated, a literal enforcement of the Zoning By-law would involve substantial
hardship to the Applicants. Accordingly, the Board finds that granting the
requested Variance may be done without substantial detriment to the public
good and without nullifying or substantially derogating from the intent or
purpose of the Zoning By-law. Having found that variance relief may be
granted, the Board found no need to address Applicants' Appeal of the decision
of the Nantucket Zoning Enforcement Officer and thus considered it withdrawn
without prejudice.
7. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested
relief by VARIANCE pursuant to Nantucket Zoning By-law Section 139-16A to
validate the current siting of the single-family dwelling with a westerly side yard
setback of about 2.8 feet, upon the following conditions:
a. The current siting of the addition to the single-family dwelling is in
substantial conformance with the "Building Location Plan", done by Jeffrey L.
Blackwell, registered land surveyor, dated May 29, 2006 and revised September
25,2006, a reduced copy of which is attached hereto as Exhibit A;
b. That portion of the rear deck that was added after January 24, 1989,
the date of the "Mortgage Plot Plan", done by Charles W. Hart, registered land
surveyor, a reduced copy of which his attached hereto as Exhibit B shall be
removed; and
c. There shall be no further expansion of the structure within the
westerly required five-foot side yard setback area without further relief from this
Board.

ADDENDUM TO APPLICATION

Applicants are seeking relief by Variance pursuant to Nantucket Zoning By-law
Section 139-32 from the provisions of Nantucket Zoning By-law Section 139-16A
(Intensity regulations - setback) to allow to an existing addition to remain,
notwithstanding a minor intrusion into the westerly required five-foot side yard setback
area, when the addition was constructed around 1979. No new construction is
proposed in this application.
Applicants purchased the Premises in 1989. After purchasing the Premises,
Applicants discovered that the Premises was subject to an open building permit issued
in 1979 for an addition and deck. Applicants complied with the requests of the
Nantucket Building Department at the time, obtained all requested sign-offs of the
permit, and submitted a current as-built plot plan. The 1989 as-built plan showed that
one comer of the addition was located as close as about 2.7 feet from the westerly side
yard lot line. At the time the original building permit was issued the minimum side
yard setback requirement was three feet. (An as-built plan prepared in 2006 shows the
addition location to be sited as close as about 2.8 feet from the westerly side yard lot
line). The 1979 permit was fully signed-off though no Certificate of Occupancy was
issued at the time, and the Nantucket Building Department issued two new building
permits to Applicants for interior alterations, construction of a second floor, and
addition of a roofwalk and porch to the Premises.
The Nantucket Zoning Enforcement Officer has denied the Applicants' request
for Certificates of Occupancy for 1989 building permits, based in part on the setback
violation from around 1979. The Nantucket Zoning Enforcement Officer has also ruled
that the 1979 permit requires a Certificate of Occupancy, which he has also denied on
the basis of the setback violation.
Applicants' request for relief is based on Applicants' good faith effort to comply
with the requirements of the Nantucket Building Department in 1989 when they
discovered the open building permit for work completed by the prior owner of the
Premises. Applicants believed the Nantucket Building Department was satisfied as to
the 1979 permit after disclosure of the minor setback intrusion, the permit was fully
signed-off, and the Nantucket Building Department issued two new permits for
additional work immediately after the final sign off of the 1979 permit. Applicants
relied on the action of the Nantucket Building Department in completing considerable
improvements to the Premises under the new permits without knowledge that the
permits would not be eligible for Certificates of Occupancy when such permits were
sought.
Substantial hardship to Applicants will result if they are now required to remove
a portion of the dwelling to correct a de minimus setback violation known to the
Nantucket Building Department for more than seventeen years.
In the alternative, Applicants appeal the decision of the Nantucket Zoning
Enforcement Officer pursuant to Nantucket Zoning By-law Section 139-31, set forth in
his letter of October 4, 2006, on the grounds that no relief is required, pursuant to
Massachusetts General Laws, chapter 40A, section 7, which states that no action, the
effect or purpose of which is to compel the removal, alteration or relocation of any
structure by reason of an alleged zoning violation shall be maintained more than ten
years after the commencement of the alleged violation. The de minimus encroachment
has been known by the Nantucket Building Department to have been in existence for
more than ten years, and the practical result of the Zoning Enforcement Officer's
decision to require a Certificate of Occupancy for the 1989 permit and deny Certificates
of Occupancy for all permits is to compel the Applicants to remove the work permitted
in 1979 that is in violation as described above.
The Premises are located in the R-1 zoning district. The lot is pre-existing,
nonconforming as to area, with the lot consisting of about 4,896 square feet of area in a
district where the minimum lot size is 5,000 square feet. The lot is conforming as to
frontage. The original dwelling was built before 1972 and conforms to all other
dimensional requirements. In 1979, the minimum side yard setback requirement
increased from three feet to five feet in this zoning district.
The other issues address by the Zoning Enforcement Officer will be corrected by
the Applicant and do not need relief from this Board.

Your request for a Certificate of Occupancy (C.O.) for Building Permit #1095-79, #7019-
89 and #7173-89 for work at 5 Galen Ave. (Map# 29, Parcel# 122) has been denied for
the following reason(s):
A portion of the addition constructed under the 1979 permit was constructed within the
then-required 3-foot setback and requires Zoning Board of Appeals (ZBA) relief.
Additionally, per the submitted site survey dated September 25,2006, the rear deck was
extended without permit and within the now-required 5-foot setback. Said work requires
ZBA relief, Historic District Commission approval and a building permit. The
September, 2006 survey also shows that a porch has been constructed at the front of the
dwelling also without the required permits. Finally, the completed permit card for the
work completed under permit #7173-89 is required.
You are required to pursue and receive the appropriate relief and permitting for this
property before Certificates of Occupancy may be issued. Please contact Linda Williams,
ZBA Administrator, at 508-228-7215 for information regarding applications for Board of
Appeals relief.
