At a Public Hearing of the ZONING BOARD OF APPEALS held at 1 :00 p.m. on Friday,
November 19,2004 in the Town Building Annex, 1 East Chestnut Street, Nantucket,
Massachusetts, on the Application of JOANNE THOMPSON, FOR HERSELF AS OWNERS,
of 66 South Shore Road, and FOR W. DEXTER PAINE AND SUSAN PAINE, CONTRACT
PURCHASERS, of278 Albion Avenue, Woodside, California, 94062, Board of Appeals File
No. 077-04, the Board made the following DECISION:
1. Applicants (the Paines) are seeking a MODIFICATION of SPECIAL PERMIT
relief granted in the Decision in BOA File No. 097-93, which allowed no more than eight horses
to be stabled on the three lots at one time on the condition that no horses would be for hire or
public use. The Decision also required that the three lots be merged. Applicants are asking to
modify the Decision to allow no more than eight horses to be stabled on the two lots (combined)
of the three lots they are purchasing that would not be for hire or public use. The Owner
(Thompson), also requests a MODIFICATION of the SPECIAL PERMIT in the Decision in
BOA File No. 097-93, to allow no more than four horses on the third lot she is retaining upon the
same condition as above. The aggregate number of horses on the three lots would be not more
than twelve. All other conditions of said Decision would remain in full force and effect.
The Premises is located at 62, 64, 66 SOUTH SHORE ROAD, Assessor's Map
80, Parcels 111, 112,44, Plan File No. lOA, Lots 10, 11, 12. The property is zoned Limited-Use-
General-2.
2. The Decision is based upon the Application and materials submitted with it, prior
Board Decisions No. 047-91 and 097-93, the testimony and evidence presented at the Hearing,
and no letters of objection from abutters. One South Shore Road neighbor spoke in support ofthe
modification.
3. Applicants are the contract purchasers ofthe Property located at 62 and 64 South
Shore Road. There is an existing stable on the 64 South Shore Road property. The Owner intends
to retain ownership of the property at 66 South Shore Road. Prior Special Permit Decision No.
097-93 limits the entire property at 62, 64 and 66 South Shore Road to "... no more than eight
(8) horses..." Applicants seek a modification to the Special Permit relief granted in the Decision
in BOA File No. 097-93 to permit them to stable eight horses on the combined property located
at 62 and 64 South Shore Road and, in addition, to permit the Owner to stable four horses on the
property located at 66 South Shore Road. Between the two properties there would be an increase
from a total of eight horses as permitted in the previous Decision to a total of 12. Further,
Applicants seek a Modification of Paragraph 4d of the Decision in BOA File No. 097-93 that
provides "... the three (3) lots are merged" so that the lots comprising 62 and 64 South Shore
Road continue to be "merged" for the purposes of this Special Permit but the lot to be retained by
,
the Owner at 66 South Shore Road is deemed to be a separate, independent, and marketable lot.
As provided in said Decision, no horses would be offered for hire to the public.
4. Therefore, the Board finds that the proposed modification would be in harmony
with the general purpose and intent of the Zoning By-Law and allowing an increase in the total
number of horses stabled on the lots would have little adverse impact given that the lots are
situated in a multi-acre zone with several other stables located in the immediate area without
apparent incident or negative affect.
5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested
MODIFICATION of the SPECIAL PERMIT relief granted under Zoning By-law Section 139-
7D(2) in the Decision in BOA File No. 097-93, subject to the following conditions:
a) There shall be no more than eight horses stabled on 62 and 64 South Shore
Road at one time, and those horses are not be to for hire or public use;
b) There shall be no more than four horses stabled on the property (as 66
South Shore Road is currently vacant, a barn is proposed to be constructed at a later date
without the necessity of returning to this Board for further relief) on 66 South Shore Road
at one time, and those horses are not to be for hire or public use;
c) The stable(s) and paddocks shall be appropriately and adequately fenced
and/or screened; and
d) For the purpose ofthis Modification, the two lots at 62 and 64 South
Shore Road are merged, but the lot at 66 South Shore Road shall be deemed to be a
separate, independent, and marketable lot. \

ADDENDUM "A"
Applicants W. Dexter Paine and Susan Paine are the contract purchasers ofthe property
located at 62 and 64 South Shore Road from Josephine Thompson, who owns both lots and a
third lot located at 66 South Shore Road. Each lot has an area of approximately 80,000 square
feet and is located in the LUG-2 Zoning District. The lots are shown as Lots 10, 11 and 12 on a
Plan filed in Plan File lOA at the Nantucket Registry of Deeds. Currently there is a private horse
stable with eight stalls and a second floor apartment on the 64 South Shore Road Lot.
The Board of Appeals issued Special Permit No. 097-93 on October 15, 1993 that
allowed no more than eight (8) horses to be stabled on the three (3) lots at one time on the
condition that no horses would be for hire or public use. Further, the Board found that for the
purposes ofthis Special Permit, "... the three (3) lots are merged."
Applicants ask the Board to modify Special Permit No. 097-93 to allow them to stable no
more than eight (8) horses on the two (2) lots they are purchasing located at 62 and 64 South
Shore Road on the condition that no horses would be for hire or public use. The Owner,
Josephine Thompson, also requests a modification of Special Permit No. 097-93 to allow her to
stable no more than four (4) horses on the lot she is retaining at 66 South Shore Road upon the
same condition: no horses would be for hire or public use. The aggregate number of horses on
the three (3) lots would be not more than twelve (12).
This requested Modification of Special Permit No. 097-93 would not be substantially
more detrimental to the neighborhood than the current private stable. The Owner has provided
stables for horses owned by local riders for more than eight (8) years without complaint.
Applicants will continue to provide this service to local horse owners. Although there is no stable
on the Property, the Owner, Josephine Thompson, intends to retain, the requested modification
will allow her to stable her own horses on her property in the future. All horses stabled on the
three (3) lots will not be for hire or public use. All other terms and conditions consistent with this
Modification and set forth in Special Permit No. 097-93 shall remain in full force and effect.

At a Public Hearing of the ZONlNG BOARD OF APPEALS held at 1: 00
P.M., Friday, October 15, 1993, in the Jury Room on the second
floor of the Town and County Building, Broad Street, Nantucket,
Massachusetts, on the Application of Joanne Thompson, P.O. Box
2305, Nantucket, MA 02584, Board of Appeals File No. 097-93, the
Board made the following DECISION:
1. Applicant are seeking relief by SPECIAL PERMIT under Zoning
By-Law ;139-70(3) under Nantucket Zoning By-Law U39-30A to operate
a public stable, which is a special permit use in all districts.
Applicant intends to stable eight (8) horses on 5.52% acres, and
some of the horses will be owned by other people who win pay rent
for the stabling. Horses will not be offered for hire.
The premises are located at 62-66 SOUTH SHORE ROAD, Assessor's
Map 80, parcels 44, 111, and 112, as shown in Plan file 10-A, 'Lots
10, 11, and 12. The property is zoned LUG-2. See ZBA file 047-91.
2. The Decision is based upon the Application and materials
submi tted with it, the testimony and ev idence presented at the
Hearing, a favorable reconunendation from the Planning Board andrlO
letters of objection or support from abutters. '
3. Applicant proposes to build and operate a stable for up to
eight horses on this 5.52:t square foot tract. Applicant
represented that some of the horses may be, owned to other
individuals, and stalls may be leased for fee. Applicant stated
that no horses will be offered for hire to the public.
4. By a unanimous vote, (O'Hara, Leichter, Waine,Williams and
Hourihan) in favor, the Board finds that the proposed use is in
harmony with the general purpose and inte.nt of the By-le,w, and
GRANTS the Special Permit as requested, subject to the. following
conditions under Nantucket Zoning By-Law ~139-7D(3):
a. The stable shall be constructed in substantial conformity
with Exhibit A, attached hereto;
b. Not more than eight (8) horses are to be stabled on the
premises at one time, and those horses are not to be for hire or
public use; .
c. The stable and paddocks, shall be appropriately and
adequately fenced and/or screened; and
