Washington Street, Nantucket, Massachusetts, on the Application of ESTATE OF
VIRGINIA L. VAN ZANDT AND FOR CHRISTOPHER J. V ALLETT, DEVISEE,
PROBATE NO. 99P-0073-EP, c/o Christopher 1. Vallett, 14 Sesepana Road, Nantucket,
MA 02554, Board of Appeals File No. 070-04, the Board made the following Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-33A(9) (alteration/expansion of a pre-existing nonconforming
structure/use). Applicant proposes to alter a pre-existing nonconforming duplex structure
by changing it to a single-family dwelling and by removing and replacing a portion of the
house without exceeding the existing ground cover ratio of about 40.5%, as part of an
overall renovation of the structure. Existing portions of the structure are being removed
and the square footage reallocated to other parts of the structure outside ofthe required
setback areas. The nonconforming rear setback intrusion is also being removed and new
construction would meet the five-foot rear yard setback requirement. A new foundation
would be constructed under the dwelling. When the rear yard setback intrusion is
removed, the Locus would be nonconforming solely as to ground cover and as to lot size,
with the Lot containing a lot area of about 3,461 square feet in a district that requires a
minimum lot size of 5,000 square feet. There is currently no onsite parking space
provided. However, a minimum of one space would be provided as part of the
renovation.
The Premises is located at 19 GARDNER STREET, Assessor's Map 42.3.4,
Parcel 117, Plan Book 6, Page 51 and Book 17, Page 148, Deed Ref. 137/165. The
property is zoned Residential-Old-Historic.
2. The Decision is based upon the Application and the materials submitted with it
and the testimony and evidence presented at the Hearing. The Planning Board made no
recommendation finding that the matter did not present any issues of planning concern.
There were no letters on file.
3. The Applicant, through his own testimony and that of his representative, stated
that he proposed to alter and expand a pre-existing nonconforming duplex structure.
Applicant stated that the structure was validly grandfathered as the building was
constructed prior to the 1972 enactment of the Nantucket Zoning By-law. To support
such a claim 1938 and 1957 aerial photographs from the Town records were submitted
into this record that showed the structure substantially in its present location and
configuration, Applicant also submitted an architectural survey form from the Nantucket

Historic District Commission office that indicted that the main portion of the building
was constructed in 1776. The form also indicated that the building originally faced
Liberty Street and over time "considerable remodeling had been done, which included
moving the front door to Gardner Street". Applicant stated that there was no evidence as
to when the structure was converted into a duplex, which use was not allowed in the
Residential-Old-Historic zoning district. Applicant stated that he had recently inherited
the property from his aunt and no work had been done on it for many years prior to that.
The structure was in desperate need of renovation. Applicant stated that he had been
issued Certificate of Appropriateness No. 44,423 by the Nantucket Historic District
Commission for the proposed renovations. Applicant proposed to substantially renovate
the structure by removing the second kitchen and returning the structure to its original use
as a single-family dwelling; placing a new foundation under the structure, that would
possibly entail moving the structure forward towards Liberty Street; removing a
nonconforming rear el and reallocating the square footage to another part ofthe structure
that would be conforming as to setbacks; and moving the front door back to face Liberty
Street. The Applicant also proposed to create at least one parking space on the easterly
side of the structure, as the property currently is nonconforming as to parking with no
space historically provided on site. As the ground cover ratio of the Lot is currently about
40.5%, and subminimum lots are allowed a maximum ground cover of 30% without a
grant of special permit relief, Applicant is seeking relief to remove and replace ground
cover without exceeding the existing maximum of 40.5%. After construction, the Locus
would only be nonconforming as to lot size and ground cover.
4. Based upon the foregoing, the Board finds that the alterations as proposed would
be an improvement to the structure and a benefit to the neighborhood with the decrease in
the nonconforming nature of the Locus, in that the rear yard nonconforming setback
intrusion and duplex use would be eliminated and a parking space would be provided on
site. The Board further finds that said alterations, including the reallocation of the ground
cover, and a possible move ofthe structure, by a grant of special permit relief would not
be substantially more detrimental to the neighborhood than the existing structure.
5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief
by SPECIAL PERMIT under Nantucket Zoning By-law Section 139.,33A(9) to allow the
alterations to the structure as proposed and reallocation of ground cover based upon the
following conditions:
a. The property shall be fully complying with setback requirements after the
alterations are completed substantially as proposed;
b. The addition shall be in substantial compliance with the Certificate of
Appropriateness No. 44,423, issued by the Nantucket Historic District
Commission, as may be amended from time to time; and
c. The maximum allowable ground cover shall not exceed 1400 square feet.

Applicant recently inherited the property from his aunt. Nothing had been done to
the structure for several years and is in need of repair and will undergo substantial
renovation. The front door was historically located on Liberty Street but was changed at
some point in the past to Gardner Street. The door will be relocated to its original spot.
As part of the renovations, the rear nonconforming el will be removed and the ground
cover reallocated to various other sides ofthe house, without increasing the
nonconforming ground cover ratio. This would make the entire structure conforming as
to setback requirements. The project has already received HDC approval in Certificate of
Appropriateness No. 44,423. There are also two kitchens in the structure, which is a
nonconforming use as duplexes are not allowed in the ROH zoning district. Applicant
will be removing one to make the dwelling a single-family use, thus reducing the
nonconforming nature of the Lot even further.
