DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on
Friday, October 15, 2004, at 1:00 P.M., in the Conference Room in the Town
Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board
made the following Decision on the Application (067-04) of NANTUCKET
ISLAND RESORTS LLC of P. O. Box 1159, Nantucket, MA 02554, in connection
with property known as Harbor House Village, 19 North Water Street,
Nantucket, Massachusetts.
2. Applicants are seeking relief by MODIFICATIONS of the SPECIAL
PERMIT relief to the extent necessary, granted in the Decisions in BOA File Nos.
011-77,042-78,008-80,069-91,004-01 and 062-02. In addition, Applicant is
seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law Section
139-10B(2). Applicant proposes to alter the use of the Harbor House (a lodging
establishment) by modifying 23 of the existing 35 guestrooms in the three-story
portion of the main building so that the rooms could be alternatively used as
either hotel guestrooms or for" treatment rooms" providing massage, fitness,
exercise, salon and ancillary personal care facilities. No exterior modifications to
the Harbor House complex would be associated with these improvements. As
part of the modifications to the guestrooms, certain other interior modifications
would be undertaken such as reducing the restaurant seating from 180 to 100
persons and function capacity from 234 to 210 persons. Eight guestrooms would
be eliminated in the Garden Cottage with it continuing to be used for ancillary
hotel guest services. No exterior modifications would be involved with those
changes. No additional parking spaces are said to be required for the changes as
proposed. The Premises is located at 19 NORTH WATER STREET, Assessor's
Map 42.4.2, Parcels 1, 2.2, 3 and 98, Land Court Plan 36477-A, Lots 1 and 2, Plan
Book 20, Page 18, Lot 2. The property is zoned Limited Commercial.
3. Our Decision is based upon the Application and accompanying
materials, and representations and testimony received at our public hearing.
The Planning Board recommendation was that the Application did not present
any issues of planning concern. At the public hearing, one abutter voiced

concerns about the Application and the increased impact on the parking
situation in the neighborhood. There were no letters on file.
4. The Applicant, through counsel, represented that NIR proposes to
modify the three-story portion of the main building on the premises to convert
up to 23 of the 35 guestrooms to be used as spa facilities open to resort guests,
guests of other hotels managed by the Applicant and the public. These
"treatment facilities" include rooms for massage, fitness, exercise, salon and
personal care as well the locker and lobby areas that would be used by spa
patrons. Applicant represented that these types of amenities are becoming more
prevalent in first-class resort facilities and many are now offered by Applicant,
but must take place within the guest's room. No exterior modifications of any
kind are proposed as part of this Application. In addition, as a part of these
modifications, Applicant is reducing the restaurant seating from 180 persons to
100 persons and the function capacity of the premises from 234 persons to 210
persons. In addition, the separate building known as Garden Cottage would be
converted to use for ancillary hotel guest services, eliminating eight guestrooms.
Nantucket Zoning By-law Section 139-10B(2) requires a special permit for "retail
sales and personal services" within which category the proposed spa use would
fall. Applicant stated that there would be no alteration of use of the basement or
the third floor. There would be no workout rooms or gym facility included in
this new uses.
5. Based on the parking calculations submitted to and reviewed by
the Board, no new parking spaces are required in connection with this change of
use. Accordingly, no additional parking waiver is requested or required. Even
though no parking waiver is needed, the Board reviewed the adequacy of the
existing parking (75 spaces on site) in light of the change of use and determined
that given the downtown location of the premises and the projection that most of
those utilizing the spa would be guests staying on the premises or at other
nearby properties managed by the Applicant, the existing parking would be
adequate for the proposed new uses on the premises, especially as the resort
provides a van service between its facilities and other areas of the Island.
6. The Board also considered whether this change in use would
trigger the Major Commercial Development provisions of the Zoning By-law.
No new commercial space is proposed, and therefore no additional parking
spaces are required. Accordingly, the Board finds that this change of use does
not constitute a Major Commercial Development and the Application is properly
before the Board.
7. The Applicant requested that the use of the area proposed for the
spa could shift between spa or guestroom uses, at the Applicant's discretion, in
response to demand. The Board was not willing to permit this portion of the
building, once converted to spa use, to be returned to use as guestrooms without

further relief from the Board. With this one qualification, the Board finds that
the proposed change of use to be in harmony with the general purpose and
intent of the Zoning By-law and not substantially more detrimental to the
neighborhood than the uses permitted under the prior Decisions of this Board.
8. Accordingly, the Board of Appeals voted UNANIMOUSLY to
GRANT the requested SPECIAL PERMIT relief under Section 139-10B(2), and to
the extent necessary, a MODIFICATION of the previous Decisions in BOA File
Nos. 011-77, 042-78, 008-80, 069-91, 004-01 and 062-02, to permit the conversion
of the first and second floors of the three story portion of the main building on
the Harbor House property to be use for so-called" spa services" such as
massage, fitness, exercise, salon and ancillary personal care facilities, on the
condition that once converted the Applicant would need to seek further relief
from this Board in order to return the rooms to guestroom use~

Addendum A
The Applicant, as owner of The Harbor House Complex (the "Property") as more fully shown
on the attached as-built survey dated December 29, 1998, updated March 14,2004 (the
"Survey") seeks (i) a minor modification of existing special permits for the Property, and (ii) a
special permit under Section 139-10B(2).
The Applicant intends to modify twenty-three (23) of the existing thirty-five (35) guest rooms in
the three-story portion of the main building as shown on the Survey, so that rooms can be
alternatively used as either hotel guest rooms or "treatment rooms" providing massage, fitness,
exercise, salon and ancillary personal care facilities ("Treatment Facilities"), which uses are
customary within a hotel! resort complex.
The Harbor House currently provides such services to guests in their hotel rooms. First-class
resort facilities, in order to maintain the highest level of guest amenities, must provide these
services. No exterior modifications to the Harbor House complex are associated with these
improvements.
As part of the modifications to the hotel guest rooms described above, and for the Board's
information, certain other interior modifications are being undertaken at the Harbor House
complex, specifically, the existing restaurant seating is being reduced (180 to 100 persons) as
well as the function capacity (234 to 210 persons). Further, guest rooms in the Garden Cottage
will be eliminated (8 rooms) with the Garden Cottage continuing to be used for ancillary hotel
guest services. Again, no exterior modifications are involved, nor any change from the allowed
hotel and related uses.
As described above, these modifications are interior only and are a continuation of the allowed
uses. These modifications to the hotel program result in a de-intensification of the hotel and
restaurant use on the Property.
The Applicant has prepared the attached parking chart detailing the uses on the Property and
the proposed modifications. As shown on the chart, even if all of the 23 rooms were utilized as
part of the Treatment Facilities, there would be no net increase in the parking requirements for
the Property. Given that the Treatment Facilities are likely to be primarily ancillary to the hotel
use, the proposed modifications result in a net decrease of parking on the property. However,
as you will note on the attached chart, we utilized the most conservative approach and assumed
that 40 parking spaces would be required for the Treatment Facilities.
Finally, this proposal does not trigger the Major Commercial Development provisions of the
Zoning By-law in that no new commercial space is created and no additional parking spaces are
required as a result of the change in use.
