A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will
be held at 1:00 P.M., FRIDAY, OCTOBER 15, 2004, IN THE CONFERENCE
ROOM, TOWN ANNEX BUILDING, 37 Washington Street, Nantucket,
Massachusetts, on the Application of the following:

Applicants are seeking relief by VARIANCE under Nantucket Zoning By-law
Section 139-7 A(2)(B). Applicants propose to convert an existing studio situated to the
rear of the existing single-family dwelling into a secondary dwelling. The studio is
currently attached to the main house by an about 19.1 foot integrated elevated deck due to
the steep change in grade between the two structures. In all other respects the studio
structure would comply with secondary dwelling requirements. The Locus and structure
are conforming in all other respects to zoning requirements.
The Premises is located at 22 MILK STREET, Assessor's Map 42.3.3, Parcel
36, Plan Book 19, Page 38, Lot 7. The property is zoned Residential-Old-Historic.

The Applicant is seeking requesting a Variance,
pursuant to Section 139-32 of the Nantucket Zoning By-law
(the "By-law"), with respect to the requirement set forth
under By-law Section 139-7(2) to convert an existing studio
located at 22 Milk Street (the "Premises") to a secondary
dwelling. The Variance relief is required as the By-law
provides that a second dwelling must be separated from the
main dwelling by 12 feet. The studio, and proposed second
dwelling, is currently attached to the main house by a
deck.
By way of background, the studio was constructed in
1987 pursuant to Building Permit No. 14263-97 which allowed
the construction of a two story private ceramic studio and
the extension of an existing deck. Certificate of Occupancy
No. 14263-99 was issued with respect to that permit. The
Applicants purchased the property in January, 2004. They
wish to convert the ceramic studio to a second dwelling.
Because of the steep slope at the property, the Applicant
and their architect have determined that the deck
connecting the two dwellings must remain.
In all other
respects the ceramic studio complies with the requirements
for a second dwelling.
Owing to the circumstances relating to the topography
of the land and the location of the dwellings, a literal
enforcement of the provisions of the By-law would involve a
substantial hardship to the Applicant. The Variance relief
requested would bring the Premises into compliance with the
By-law without substantial detriment to the public good.
The Applicant requests that the Zoning Board of Appeals
grant the relief requested.
