CLINTON AND PATRICIA A. CLINTON (BRIAN J. FLYNN AND CHRISTINE G. FLYNN, CONTRACT PURCHASERS), of 6 York Street, Nantucket, MA 02554, Board of Appeals File No. 065-04, the Board made the following Decision: 1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By- law Section 139-33E(2)(a) to validate the existing ground cover ratio on the Locus of about 33.2% in a district that allows a maximum ground cover of30% for undersized lots without a grant of Special Permit relief. In addition, the Applicants are seeking reliefby SPECIAL PERMIT under Section 139-33A to validate the siting ofthe rear addition, that was demolished and reconstructed in 1991 and constructed in a manner so as to follow the existing nonconforming building line at less than one foot from the westerly side yard lot line without coming any closer to that side yard lot line in a district that requires a minimum side yard setback of five feet. Applicant is seeking relief under the same section to validate the siting of a shed that is located within the required five-foot westerly side yard setback area but farther away than the existing single-family dwelling. The Locus is also nonconforming as to lot size with the Lot having an area of about 3,665 square feet in a district that requires a minimum lot size of5,000 square feet; and as to frontage with the Lot having a frontage along York Street of about 37 feet in a district that requires a minimum frontage of 50 feet. See also BOA File No. 045-86. The Premises is located at 6 YORK STREET, Assessor's Map 55.1.4, Parcel 56, no plan is on record, Deed Ref. 152/17. The property is zoned Residential-Old-Historic. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation fmding that the matter did not present any issues of planning concern. There were no letters on file from abutters. 3. Applicants, through counseL represented that the lot was pre-existing and nonconforming and that the dwelling was pre-existing nonconforming with the exception of a 1992 addition and shed that are the subject of this Application. The structure in its current configuration, including the precious rear el, was clearly shown on a 1938 aerial in the Town records and again in 1957 to validate the claim that the structure was validly grandfathered. In 1991, Applicants relied on a plot plan prepared by a licensed surveyor to support their application for a building permit to demolish and rebuild the rear el of the dwelling with about 150 square feet of additional ground cover (a total of287 square feet for the new rear addition). Applicants also applied to demolish a small shed on the property that was replaced some time later without benefit of a building permit. Based on e. the 1991 plot plan, Applicants believed the reconstruction and addition would not exceed the maximum ground cover ratio allowed in the Residential Old Historic district for this subminimum lot of 30%. The previous plot plan was filed with the building permit application, and the building inspector granted a permit for the proposed construction. Applicants represented that it was the practice of the building inspector at the time to allow structures that were nonconforming as to setback to be rebuilt in place without zoning relief so long a the new portion of the structure was no closer than the existing structure. It was also said to be common for a property owner to leave the nonconforming wall of a structure in place and add onto it. There was no confirmation of which scenario took place at the time. Applicants built the addition in accordance with the Building Permit, and a Certificate of Occupancy was issued on August 2, 1992. Applicants have since obtained a plot plan drawn by Jeffrey Blackwell, licensed surveyor, dated September 8, 2004, a reduced copy of which is attached hereto as Exhibit A. This plot plan showed that the frontage, lot area, and ground cover were incorrectly shown on the 1991 plan. As a result of the errors on the previous plan, the 1992 construction inadvertently exceeded the maximum ground cover allowed in this district, resulting in a new ground cover calculation of about 33.2%. Applicants stated that they had proceeded in good faith reliance on the plot plan done by a licensed surveyor. 4. Based upon the foregoing, the Board fmds that a grant of Special Permit relief could be made to validate the existing ground cover ratio and previously demolished and reconstructed rear el as not substantially more detrimental to the neighborhood than the existing nonconformities. The Board further finds that the error in ground cover ratio was not of the Applicants' own making and was the result of a mistake made by a licensed surveyor when calculating the area of the Lot. In addition, the Applicants relied on that information, received a duly issued Building Permit for the work performed in 1992 and then a Certificate of Occupancy. The situation has existed without detriment for over 12 years and the Board finds that there would be no public benefit to tearing the rear addition down, a form of which clearly was present on a 1938 aerial in the Town records, and would cause substantial fmancial hardship to the Applicants. 5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-law Section 139-33A and 139- 33E(2)(a) to validate both the existing ground cover ratio and the demolition and reconstruction of the rear el and sited within the westerly side yard setback area but no closer than the existing structure, based upon the following conditions: a The existing shed shall be relocated or removed to a site outside of the required setback areas; and b. The ground cover ratio and siting of the principal structure shall be substantially as shown upon the "Mortgage Inspection Plan", done by Jeffrey Blackwell, licensed surveyor, dated September 8, 2004, a reduced copy of which is attached hereto and marked as Exhibit A. Clinton and Patricia A. Clinton, own the improved property at 6 York Street, Nantucket, Massachusetts, 02554 ("Property"). The Property is located in the ROH Zoning District and includes a pre-existing, non-conforming lot and dwelling. The Property has an area of 3,665i: square feet. The ROH Zoning District requires a minimum lot size of 5,000 square feet. The dwelling on the Property has a ground cover of 1 ,218i: square feet. There is also a shed on the Property with a ground cover of 32i: square feet. The aggregate ground cover on the Property is 1,250i: square feet (33.2%). The maximum allowable ground cover ratio for undersized lots in the ROH Zoning District is 30% oflot area (1,099.5 square feet). Applicants acquired the Property in 1975. There is no recorded plan showing the area of the lot. The Property has been held in separate, non-contiguous ownership from abutting lots from a time prior to the enactment ofthe Zoning By-Law in 1972 to date and the lot and dwelling are pre-existing and non-conforming. In 1991, Applicants wanted to add a master bedroom to the dwelling. They obtained a plot plan of the property from a registered Land Surveyor on Nantucket. This plan erroneously showed the Property with an area of 4,032i: square feet. In fact, the Property has an area of 3,665i: square feet. In 1991, Applicants applied for a building permit (No. 8469-91) to add a 287i: square foot master bedroom to the dwelling on the Property. Applicants completed the addition in 1992 and were issued Certificate of Occupancy No. 8469-92 for the addition. Based upon the erroneous plot plan, the aggregate ground cover ratio of the dwelling and master bedroom addition was conforming (30%). The 2004 Blackwell Plot Plan shows the Property with an area of 3,365i: square feet and an aggregate ground cover of 1,250i: square feet (33.2%). Applicants ask the Board to grant them a Special Permit pursuant to Section 139- 33E(2)(a) of the By-Law to validate and allow the existing 33.2% ground cover ratio of the dwelling and the shed and, to the extent necessary, to validate the location of the 32i: square foot shed in the five (5') foot side yard setback area. The requested Special Permit will not be substantially more detrimental to the neighborhood than the existing conditions on the Property because nothing on the Property will change. Sherman, Chairman BOARD OF APPEALS BOARD OF APPEALS TOWN OF NANTUCKET NANTUCKET, MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, MAY 30, 1986 at ~:30 p.m. in the Town and County Building, Nantucket, made the following Decision upon the Application of PATRICIA AND OWEN CLINTON (045-86)1 address 484 St. Clair, Grosse Pointe, Michigan, 48236. 1. Applicants seek a SPECIAL PERMIT under Zoning By-Law SECTION 139-7C to install an Accessory Apartment in their existing single-family residence enlarged to accommodate same. Applicants also seek SPECIAL PERMIT or VARIANCE relief from SECTION 139-16 and 18 requirements as to ground cover, setback and off-street parking. The premises are located at 6 YORK STREET, Assessor's Parcel 55.14.056 and zoned RESIDENTIAL~l. 2. Based upon the Application papers, viewings following our initial hearing of May 2, 1986, correspondence and plans, testimony and representations received at our hearings, we find that Applicants' lot contains 3725 SF, i.e., less than 5,000 SF. Allowable ground cover ratio is 30%, present ground cover ratio is 31% but an existing accessory building on the north lot line will be removed. 3. The house is non-conforming (but pre-existed our zoning) with no setback from the northerly side lot line. Applicants propose extending the house westward but spaced out of that setback to provide adequate space per Section 139-7C (2)(a) for the Accessory Apartment. The structure will thus not be more non-conforming with respect to set- back, but only as to ground cover with an about 162 SF addition. The house is to remain single-story in the addition and structure linking it to the 1 1/2 story principal dwelling. Ground cover ratio would become 35%, about 1955 SF over that specified for R-l in Section 139-16A. 4. As Accessory Apartments are strongly favored and abutters commended the enlargement, as such, without objection, we might normally have granted the requested Special Permit under Section 139-7C together (045-86) -2- with Section 139-33A relief as to ground cover (setback relief no longer being needed or sought). However, Applicants have one existing parking space off York Street and no claim to grandfathering as to a second. A second space could be provided end-to-end, normally not allowable under Section 139-18. Objection was heard on behalf of the occupant of the abutting house at Applicants' southerly boundary concerned with this arrangement. No parking plan was available fully complying with the Code. Concern was expressed about lack of parking in the area, and the Planning Board's recommeNhtion was unfavorable. 5. Accordingly, we are unable to make the findings necessary to support a parking variance. 6. Upon motion to grant the relief requested, the Board voted two in the negative and one in the affirmative (Williams). Accordingly, relief is DENIED.
