A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will
be held at 1:00 P.M., FRIDAY, SEPTEMBER 10, 2004, IN THE CONFERENCE
ROOM, TOWN ANNEX BUILDING, 37 Washington Street, Nantucket,
Massachusetts, on the Application ofthe following:

Applicants are seeking relief by VARIANCE under Nantucket Zoning By-law
Section 139-16A (Intensity Regulations - setbacks, lot size, frontage). Applicants are
seeking validation of the Lot as separately marketable and buildable from all adjacent
land as presently configured. The current configuration of the Lot is the result of a
previous change in lot lines that rendered the Lot more nonconforming, having a lot size
of about 28,624 square feet in a district that requires a minimum lot size of 120,000
square feet and a frontage of about 184.44 feet with the minimum frontage required being
200 feet. The Locus, improved with a single-family dwelling since prior to the 1972
adoption of the Nantucket Zoning By-law, was a part of the former Lot 2 on Land Court
Plan 36116-A until Lot 2 was divided into Lots 4 (the Locus) and the adjacent Lot 3 by
Land Court Plan 36116-B, which was filed with the Land Court on April 19, 1973. The
former owner ofthe Locus (the Applicants' father) conveyed Lot 3 to an abutter by deed
dated June 3, 1973, recorded on March 28, 1974, thus rendering the Locus more
nonconforming by the removal of about 6,293 square teet of area and 11.00 teet of
frontage on Sankaty Road. The dwelling on the Locus is also nonconforming as to
setback requirements, with the structure being sited as close as about 8.3 feet from the
easterly rear yard lot line in a district that requires a minimum setback of ten feet.
The Premises is located at 107 SANKATY ROAD, SIASCONSET, Assessor's
Map 48, Parcel 46, Land Court Plan 36116-B, Lot 4. The property is zoned Limited-Use-
General-3.

ADDENDUM TO APPLICATION OF BIDDLE NOMINEE TRUST
The applicants seek relief by Variance under Nantucket Zoning By-
law ("By-law") ~139-32, from the provisions of ~139-16.A
(Intensity Regulations), in order to confirm the status of the
locus as a valid building lot under the provisions of the By-law.
The area of the locus is 28,624 square feet, and the frontage of
the locus is 184.44 feet, with the minimum required area being
120,000 square feet and the minimum required frontage being 200
feet, in the Limited Use General-3 zoning district in which the
locus has been situated since the 1973 amendments to the By-law.
The locus has been improved with a dwelling since prior to the
initial adoption of the original By-law in 1972. The locus was a
part of the former Lot 2 on Land Court Plan 36116-A until Lot 2
was divided into Lots 4 (the locus) and the adj acent Lot 3 by
Land Court Plan 36116-B, which was filed with the Land Court on
April 19, 1973. The former owner of the locus (the applicants'
father) conveyed Lot 3 to an abutter by deed dated June 3, 1973,
recorded on March 28, 1974, thus rendering the locus more
nonconforming by the removal of 6,293 square feet and 11.00 feet
of frontage on Sankaty Road. The dwelling upon the locus is also
nonconforming as to [easterly] rear yard setback, being situated
8.3 feet at the closest point from the easterly property line,
with minimum rear yard setback being 10 feet. Although the locus
has been in common ownership with the adjacent Lot B-2 on Land
Court Plan 12839-B, these lots have not merged because each of
the locus and Lot B-2 is a lot improved with a dwelling
constructed before the adoption of the By-law, and hence no
merger has occurred by virtue of the definition of "Lot" in By-
law ~139-2.
