Portions of the dwelling which are being expanded upward lie within the front yard setback area of 30 feet and the southerly side yard setback area of 10 feet; these portions of the dwelling are situated at their closest point about14.2 feet from the front lot line along Baxter Road, and about 8.2 feet from the southerly side lot line, respectively. The applicant requests in addition, or in the alternative to relief for alteration within the required side yard, a Special Permit under ~139-16.C(1), to reduce the southerly side yard setback requirement from ten feet to five feet.
